G. In the event that a majority of the Committee does not agree on the resolution of aparticular grievance, either party may initiate proceedings before a tribunal establishedpursuant to law or by agreement within six months of the Committee’s written decisionhaving been rendered.Time Claims:The employee or his representative for the initial claim or grievance underSection 2 A submits time claims to the Superintendent within 60 days of thedate of occurrence.Step 1: In the event the claim or grievance is disallowed the BLE Local Chairmanmay appeal the matter to the Superintendent . The Superintendent, or designate, has 60days from receipt of the grievance to pay or decline the claim . Within 60 days from thedate received, the BLE Local Chairman will be notified of payment or disallowance .Step 2: Claims declined under Section 2 B may be appealed by the BLE GeneralChairman to the Company's Director Human Resources, or designate, within 60 days.The Director Human Resources, or designate, has 60 days from receipt of the grievanceto pay or decline the claim . Within 60 days from the date received the BLE LocalChairman will be notified of payment or disallowance.Step 3: The BLE General Chairman will list any claims or grievances with theDirector - Labor Relations 30 days before the next scheduled Labor/ManagementMeeting under Section 2 D and E .Step 4: Any unresolved disputes subsequent to the Labor/Management ResolutionCommittee meeting may be advanced before a tribunal established pursuant to law oragreement.Discipline:Step 1: The BLE Local Chairman has 60 days to resolve the issue locally with theSuperintendent, or designate.Step 2: In the event the matter remains unresolved between the Superintendent, ordesignate, and BLE Local Chairman the General Chairman has 180 days from the datethe discipline was assessed to present an appeal to the Director Human Resources . TheDirector Human Resources, or designate, has 60 days from receipt of the grievance torespond to the claim.Step 3: The BLE General Chairman will list unresolved grievances with theDirector - Labor Relations 30 days prior to the next scheduled Labor/ManagementMeeting under Section 2 D and E .General: Claims and grievance appeals disallowed by the Company will be barred fromfurther handling unless, not less than thirty (30) days prior to the next scheduled quarterlymeeting date, the General Chairman lists existing unresolved grievances to the Committee.The Committee will consider the entire record of each dispute submitted to it . Decisionsmade pursuant to this process will be written by the Company within forty-five (45) days44
