In the events of:-(i)::8::Rejection of my/our supplies described in paragraph above or.(ii) My/Our failing, dealing, neglecting or delaying to comply with any demand or requisitionor otherwise not executing the same in accordance with the terms of contract, the officeroperating the contract shall be at liberty (without prejudice to any other) remedy the Govt. mayhave no account for any claim for compensation against loss and inconvenient cause by suchbreach or not performance of the contract to purchase or to procure or to arrange from the Govt.or otherwise my/our expenses such supplies as may have been rejected or that I/we have failed,declined, neglected or delayed to supplies or such authorised substitute therefore as are specifiedin the schedule hereto and are approved by the officer operating the contract or any excess costincurred over the contract price (together with all incident) charges or arranging of such stocks orsupplies (together with all incidental charges or expenses) shall be recoverable from me/us ondemand.8. The officer sanctioning the contract may rescind this contract by notice to me/us in writing :-(i)If I/we assign of sublet my/our without this written approval, or if I/we attempted to do so.(ii) If I/we or any of my/our agent servants shall :-a) Be guilty to fraud in respect of the contract or any other contract entered by me/uswith the Govt.b) Directly or indirectly given promise or offer any bribe gratuity, gifts, loans,Rewards and advance pecuniary otherwise to any officer or person in the employment ofthe Govt. in any way relating to such officer or person’s office of emolument.(iii) If any such officer and person mentioned to sub paragraph of this Para become in any waydirectly or indirectly interested in the contract.(iv) If I/we decline, neglect or delay to comply with any demand or requisition or in any otherway fail to perform or observe any condition of the contract.(v) If I/we or any of my/our partners becomes insolvent or apply for relief as an insolventdebtor or commence any instance or make any imposition with my/our creditor or attempt to doso or in the case of our being a registered company any order be duly passed for the winding upof the company.(vi) If it should transpire that I am/we are doing business conjointly with any other reputedfirms/ manufacturers/authorised agency/whole sale dealers or that I am/we are the partners in anyother firm(s) on the approved contractors.In case of such rejection my/our security deposit for (or such portion) the officersanctioning the contract shall be considered (or adequate) shall stand forfeited and be absolutelyat the disposal of Govt. without prejudice to if this remedy or action that the Govt may have totake. Notwithstanding anything herein before contain without prejudice thereto the officeroperating the contract may recover from me/us as compensation such as he consider reasonable.(i) If any goods entrusted to me/us under the contract be lost, damaged or depreciated unlesssuch loss, damage or depreciation be due to the act of Govt. and enemies of the Govt.(ii) If I/we fail to observe or perform any condition of the contract.10. Decisions for recovery of money from me/us in respect of purchase or arrangement atmy/our expense or of compensation by order of the officer operating the contract underparagraph 7 or 9 above and any order for rescission or the contract by the officer sanctioning thecontract under paragraph and above shall be subjected to appeal if preferred in writing by me/uswithin 15 days of issue of such decision or order to Govt. Officer whose decision will beaccepted as final. If such appeal were not duly notified to the Govt. within this period theoriginal decision or order in question shall be accepted as final.11. I/We shall be liable to pay rent for any Govt. land if occupied by me/us in the course ofthe contract at rate to be fixed by the officer sanctioning the occupation of the land and intimatedby the officer sanctioning the contract.12. No payment will be made in advance for any supplies under this contract.13. On the supplies being accepted, I/we shall be entitled to be furnished with a certificatefrom the proper officer of the Govt. to the effect that such supplies have become the property ofGovt. for the purpose of enabling me/us detain a refund of amount paid by me/us for octroi dutyin respect of such supplies provided such refunds is permissible by the law under which suchoctroi duty has been levied.14. If during the currency of the contract the specification of any article or articles to besupplied there under be changed. I/we shall continue to supply the said article or articles inaccordance with the new specification of a rate to be mutually agreed to in writing at the time ofsuch change and in default of such agreement, the contract in so far as is related to the said articleor articles in respect of which no agreement has been arrived at shall be rescinded but no suchchange shall effect the supply of any of the other articles under the contract or entitle me/us toany compensation.15. I/We shall oblige my/our servant and agents to confirm any reasonable instructions toensure their punctuality in attendance of supply clean line and respectful behavior that may begiven by the officer sanctioning the contract or the officer operating the contract.16. i) I/We shall submit the bills for supplies made under the contract to the ConcernedDIG (TEZPUR) ITBPF or his representative duly accepted. These bills will be presented byme/us on the correct printed form shall be pre-receipted by me/us and be supported by thereceipted vouchers given to me/us and by the receiving officers. The charges in these always beentered at the same rate for each supply as are shown in the schedule of the contract and suchclause of the schedule as pertains to it and is specified by the officer operating the contract in therequisition or order.ii) If any retrenchment be made in payment of any bills submitted by me/us other than inrespect of ordinary audit objection and except in respect of recoveries under paragraph 7 & 9above on which final decision have already been given, such retrenchment shall be subjected toan appeal if preferred by me/us in writing within two month to the officer sanctioning thecontract whose decision shall be accepted by me/us as final. Inspection of the stores will be carried out at respective Battalions locations by Unitsrepresentatives in the presence of the supplier. The supplier will be responsible to make up forenroute breakages / Leakage etc.10. Validity of rates for the supply of liquor will be up to 31.03.12 from the date of acceptingoffers which can be terminated any time at the discretion of accepting authority.
