It is fast approaching and eachyear is seems there is more to do with less membershelping out. I would like to send out my personalrequest to please come join us and enjoy thecamaraderie <strong>of</strong> your fellow members working togetherto put on a successful event. This is themajor fundraiser for our chapter and we really doneed your help.We moved Spooks to the first weekend to reduce the conflict with other events.Bring your friends and family, volunteer a few hours, remember those that wehave lost, and enjoy the best event there is.Be vigilant, ride safe and have fun.RichardOur Vice President’s Voice:It is that time <strong>of</strong> year, Spooks is rapidly approaching and there ismuch work to be done from this time until it is over. We havechanged to the first weekend <strong>of</strong> <strong>Oct</strong>ober to draw a larger crowd, thiswas done due to other events close to our location also havingevents. Help will be needed in all areas <strong>of</strong> the event and volunteerswould be appreciated. We need people to help the few that have been doing all the work formany years.We have a meeting the 26 th <strong>of</strong> September for moving trailers and equipment to Sertoma. The icemachine has been repaired and will be up and running this weekend to provide ice for the beverages,this will take several weeks <strong>of</strong> making ice, bagging them and putting in our freezer. Supplieshave to be purchased and signs have to be made. I have matured a lot being in <strong>ABATE</strong> all these years and I hope tobring all that and more to the Secretary's Position for our chapter.Spooks N Scoots is right around the corner and we will needall the help we can get. This time <strong>of</strong> year it's hot, it rains a lot, and there are lots <strong>of</strong>bugs at night. With this time <strong>of</strong> year comes varying tire pressures, so check yours everyweek. When you are checking tire pressures, check all your lights (headlight, tail/brake lights, turnsignals (if you've got them). Also, clean your windshield. Those dried bugs, roadway grime anddried rain drops add up, and make your job <strong>of</strong> riding safely more difficult than it has to be. Plus,when it does rain and you get caught in it, your clean but wet windshield will be much easier tosee through than dirty.Ride safe… Jim

Only approximately 22%eligible to vote in <strong>Florida</strong> voted in the primary back in August. “Blame the rain” said thepolitical pundits. Hell we live in <strong>Florida</strong> where it rains pretty much every day <strong>of</strong> the weekin the summer. I’m pretty secure in knowing we as bikers, we as <strong>ABATE</strong> <strong>of</strong> <strong>Florida</strong> <strong>Inc</strong>. members and especiallywe as members <strong>of</strong> the <strong>Hillsborough</strong> Co. <strong>Chapter</strong> did our duty and all voted (with the exception <strong>of</strong> theindependents) right? If you didn’t vote, good news, you have a chance to redeem yourselves on November 2,<strong>2010</strong> for the full blown election (independents included). If you require an umbrella just let me know.If you don’t vote don’t complain. If you’re not a registered voter there’s still time to signup, instructions arelocated in this newsletter.<strong>Florida</strong> Supreme Court <strong>of</strong>ficially strikes Amendment 3, 7 & 9 from ballotTALLAHASSEE, <strong>Florida</strong>: It's <strong>of</strong>ficial; <strong>Florida</strong> voters will see only six statewide measures on this year's <strong>2010</strong>ballot. On August 31 the state's high court upheld previous lower court decisions to throw out <strong>Florida</strong> PropertyTax Limit, Amendment 3, <strong>Florida</strong> Redistricting, Amendment 7 and <strong>Florida</strong> Health Care Freedom, Amendment9. All were legislatively-referred constitutional amendment. All three were struck down by a 5-2 vote, withChief Justice Charles Canaday and Justice Ricky Polston dissenting.Specifically, the high court ruled that theproposed Amendment 3 was misleading because the ballot language did not clarify to voters that the taxbreak applied only to property bought after January 1, <strong>2010</strong>. On Amendment 7, the court ruled that the measurewas also misleading because it did not highlight to voters the effect on the state's district requirementsand because it would undermine the state's current requirement that districts be "contiguous." The SupremeCourt ruled similarly on Amendment 9. "The ballot language put forth contains misleading and ambiguouslanguage. Currently our only recourse is to strike the proposed constitutional amendment from the ballot,"said the justices. <strong>Hillsborough</strong> <strong>County</strong> <strong>Chapter</strong> Page 9Just when you thought all the vertical license plate noise was overThere have been some questions about the new vertical license plate amendment that was attached to HB971 by Rep. Aubuchon from Cape Coral. Our State Legislative Trustee, Darrin "Scribe" Brooks contacted his<strong>of</strong>fice to inquire why this amendment was added and was told that the problem with vertical tags was that thetoll cameras could not read them correctly enough if someone ran a toll booth without paying. Aubuchon compromisedby stating that bikes with vertical plates MUST have a prepaid transponder. The Bill was signed bythe Governor Crist. Drivers will have to pay tolls using a transponder or be billed using a photograph <strong>of</strong> thevehicle's license plate. Drivers who do not have a transponder, when they receive their bill in the mail willhave to pay an additional $2.50 service charge. The new electronic toll booths are currently under constructionin the Miami area. Despite efforts by <strong>ABATE</strong> <strong>of</strong> <strong>Florida</strong> <strong>Inc</strong>. lobbyist Doc Reichenbach, Rep. Aubuchonpushed the amendment. Vertical license plates WILL be a moving violation if you DO NOT have a toll roadtransponder. Here’s the bill: 316.2085 Riding on motorcycles or mopeds.—(3)The license tag <strong>of</strong> a motorcycle or moped must be permanently affixed to the vehicle and may not be adjustedor capable <strong>of</strong> being flipped up. No device for or method <strong>of</strong> concealing or obscuring the legibility <strong>of</strong> thelicense tag <strong>of</strong> a motorcycle shall be installed or used. The license tag <strong>of</strong> a motorcycle or moped may be affixedhorizontally to the ground so that the numbers and letters read from left to right. Alternatively, a licensetag for a motorcycle or moped for which the numbers and letters read from top to bottom may be affixed perpendicularlyto the ground, provided that the registered owner <strong>of</strong> the motorcycle or moped maintains a prepaidtoll account in good standing and a transponder associated with the prepaid toll account is affixed to the motorcycleor moped.(7)A violation <strong>of</strong> this section is a noncriminal traffic infraction, punishable as a moving violation as provided inchapter 318.Whether or not this bill will bring back the $1000.00 fine and all the other crap that went with it, I don’t know,I’m still looking for those answers. I went through the entire “CHAPTER 318 DISPOSITION OF TRAFFIC IN-FRACTIONS” and can’t find anything relating to this statute, stay tuned.Traffic cameras killed in Brooksville <strong>Florida</strong>Red light cameras around the state have always been a pain in my butt, nothing more than a way <strong>of</strong> raisingmoney for the local governments and now the state. It's good to see one city has finally made the right choicein changing a really bad idea. News article from the Hernando <strong>County</strong> Political Buzz Examiner: Residentsin Brooksville, <strong>Florida</strong> have finally seen the end to the traffic camera debate. Those against the computerizedticket machines have chalked up a victory; the red light cameras in Brooksville have gone blind. In a St.Pete Times editorial, a local resident wrote, “Brooksville finally did the right thing and ended its misguided redlightcamera program.” Adding, “I find the claim that red-light cameras would somehow prevent a wreckcaused by a drunken driver not only baseless, but ludicrous. If someone is so impaired due to drugs and alcohol,how can you claim with a straight face that a camera will stop them? Red-light cameras are a billing device,not a safety device!”Throughout the debate, motorists have claimed that the traffic cameras did little toimprove road safely. To the contrary, some yellow signals where red light cameras were installed had theirwarning time reduced to just 3 seconds, “In a desperate effort to balance their budget, Hernando <strong>County</strong> hasshortened the timing <strong>of</strong> yellow lights at intersections with cameras to just 3 seconds, in order to issue moretickets. With much <strong>of</strong> the local population over the age <strong>of</strong> 50, many drivers are years past race car driver reflexes.Changing the timing <strong>of</strong> yellow lights at intersections with cameras to just 3 seconds is dangerous – especiallyon a wet road. " (and for motorcyclists) "Since the entire purpose <strong>of</strong> traffic signals is to increaseroad safety, deliberately making them more dangerous by shortening yellow lights solely to hand out moretickets - should be illegal.” With the traffic cameras now going dark, opponents have reason to celebrate.

I saw this on the MRF website and wanted to share it with you.01-July-<strong>2010</strong> MRF News Release – Lobby Ban Supported - Washington DCToday, 5 Members <strong>of</strong> the House <strong>of</strong> Representatives introduced a resolution that “supports efforts toretain the ban on the National Highway Traffic Safety Administration’s ability to lobby state legislaturesusing federal tax dollars and urging NHTSA to focus on crash prevention and rider education”.The ban is current Federal law, the resolution simply supports the lobby ban and puts the Obama Administrationon notice that this is an important law and should remain in place.There is recent activity to support the fact that the current Administration would like the ability back tolobby state legislatures. At a hearing, Obama’s NHTSA chief, Mr. Strickland, has said the motorcyclehelmet use will be the core <strong>of</strong> NHTSA’s approach to motorcycle safety. He went on to say that“anything the Congress does that would support the movement <strong>of</strong> riders into helmets would producethe desired effect <strong>of</strong> safety.”So, we are pleased that Representatives Sensenbrenner (WI), Ryan (WI), Rehberg (MT), Lanborn(CO), and Petri (WI) have all sponsored H Res 1498 today, and the Motorcycle Riders Foundation(MRF) hopes more <strong>of</strong> their colleagues will follow suit. The bill is a direct result <strong>of</strong> the MRF’s springride to the capitol known as Bikers Inside the Beltway. A group from <strong>ABATE</strong> <strong>of</strong> Wisconsin broughtthis issue up with Congressman Sensenbrenner and he agreed to do the resolution.Prior to 1996, NHTSA could and did send paid staff to State legislatures, uninvited, to testify in favor<strong>of</strong> State helmet laws. This irked the constituents and Members <strong>of</strong> Congress, who felt that it was awaste <strong>of</strong> tax payer money. They felt that the feds should not be able to use taxpayer moneys againstthe will <strong>of</strong> the taxpayers. So, Congress passed a law that forbids NHTSA staff from entering state assembliesuninvited. Sensenbrenner led the charge back in ’96.He had this to say about the issue “It is the job <strong>of</strong> Congress to defend the freedom and individual responsibilitiesthat motorcycle riders across the nation enjoy as they travel the open roads <strong>of</strong> America,”Congressman Sensenbrenner said. “Mr. Strickland’s plan greatly concerns me as it is not the job<strong>of</strong> the federal government to create one-size-fits-all helmet laws. Mr. Strickland appears to be intenton pursuing all means possible to enact mandatory helmet laws, either at the federal level or by violatingthe principles <strong>of</strong> the 10th Amendment and bullying the States into enacting mandatory helmetlaws.”Remember you make <strong>ABATE</strong> <strong>of</strong> <strong>Florida</strong> <strong>Inc</strong>. and the HCC work; we arenot a force <strong>of</strong> one we are a force <strong>of</strong> many. But keep in mind that <strong>Florida</strong> maintains aclosing date for registration to vote in a particular election. This is important for voters to realize because if youmiss the closing date you can’t vote in the election. This is why it’s critical to register to vote as soon as possible.Closing dates in <strong>Florida</strong> are 29 days prior to the elections or, July 26, <strong>2010</strong> for the primary election <strong>of</strong> August 24,<strong>2010</strong>, and <strong>Oct</strong>ober 4, <strong>2010</strong> for the general election <strong>of</strong> November 2, <strong>2010</strong>. In other words, register to vote today! Ifyou wish to vote in a primary, <strong>Florida</strong> is a “closed primary state”, you must be a registered member <strong>of</strong> one <strong>of</strong> thepolitical parties for which you intend to vote. For example, voters registered as independent, or a member <strong>of</strong> the“Green Party”, can’t vote in the Republican or Democratic primaries. The only exception to this rule is a 1998 <strong>Florida</strong>constitutional amendment that states that if all candidates share the same party affiliation, all registered votersregardless <strong>of</strong> party can vote in the primary election.The General Election ProcessThe General Election is always held in November <strong>of</strong> even-numbered years with the Primary Election taking place10 weeks before the General Election. During presidential election years, every four years, the presidential primaryin <strong>Florida</strong> is held in January. Keep in mind that the presidential primary and the Primary Election are two differentvoting events. So if you would like to vote in the presidential primary, you need to make sure you are registered intime. In other words, register to vote today!The Absentee Ballot ProcessIf you are a resident <strong>of</strong> <strong>Florida</strong> but will not be in <strong>Florida</strong> during the election, you have the right to request an absenteeballot. To obtain an absentee ballot simply contact your local <strong>of</strong>fice <strong>of</strong> Supervisor <strong>of</strong> Elections either in person,in writing, or over the phone and request a ballot. If you are mailing your request make sure to include all relevantinformation including:Name Address (your physical residence) Mailing AddressBirth date Driver’s license number SignatureWhich election you wish to receive the ballot forIt’s very important to include all <strong>of</strong> the required information or your request can be denied. After you send in yourrequest, make sure to call the <strong>of</strong>fice to follow up with the process. Don’t assume that you will receive your ballotuntil you’ve received confirmation back in writing.Change <strong>of</strong> Address ProcessIf you moved and have a change <strong>of</strong> address to another county, you need to fill out a <strong>Florida</strong> Voter Registration Applicationagain to provide notice <strong>of</strong> your new address. This application can be obtained from your local <strong>of</strong>fice <strong>of</strong>Supervisor <strong>of</strong> Elections. It’s important to have your correct address on file because <strong>Florida</strong> law requires you to votein the precinct where you live. If you go to the wrong precinct, you won’t be allowed to vote. Make sure you areaware <strong>of</strong> your correct voting precinct before Election Day so that you don’t run into any problems.Voting is a RightRemember, voting is a right and not a privilege; no one can stop you from voting. However, you still need to followand obey <strong>Florida</strong>’s voting laws in order to enjoy that right. The laws are in place in order to keep elections fair forall candidates. Make sure you understand the rules, register early, and on election night, make your voice heard!

He has made the contacts for getting an appointment set for a meeting inearly May with the Commissioner – he suggested that members be there for the meeting andphotos.9. PR/COMMUNICATIONS TRUSTEE: “Beamer” reported that we have another booth eventat the Music St. Music and Motorcycles event in Zephyrhills on April 10 th . She asked for volunteersfor the event. 3 members volunteered and made plans to meet on next Saturday. Shealso talked about the Freedom Rights Rally and the importance <strong>of</strong> our members going. SERGEANT AT ARMS: Wayno Coulter reported that his shoulder is healing (surgery 8weeks ago). He also mentioned that once the chapter elections are completed at the JuneMeeting that he would like to schedule a work day (separate from a meeting day) for inventoryon the Spooks N Scoots trailer.8. LEGISLATIVE TRUSTEE: Milton Gonzalez reported on the visits he was able to completewhile he attended the <strong>2010</strong> Freedom Rights Rally in Tallahassee in April. We have 17 StateRepresentatives and 5 State Senators for the counties our chapter serves. He was able to get 5appointments scheduled with some <strong>of</strong> our State Representatives – none <strong>of</strong> them were availablethat day to keep their appointments with him. He was able to get 2 appointments scheduledwith our State Senators. Mike Fasano was available for his appointment. Milton reported thathe had a good meeting with Mr. Fasano and what his past support for <strong>ABATE</strong> has been. Mr.Fasano plans to continue with that support. He will be terming in 2012 and agreed to come to achapter meeting in the near future. Milton then gave a detailed report on what happened withSB 1918. Due to a set <strong>of</strong> unfortunate events – this billed died before it went to the Senate floor.SB 448 (Red Light Bill) did pass – raised the fines to $158 – no points to driver’s license – finewill be accessed to the Registered Owner <strong>of</strong> the vehicle. The Governor is expected to sign <strong>of</strong>fon this one. HB 1235 (opposition to Cell Phone Texting while driving) was “killed” on the 2 ndreading. There are still no new laws against this unsafe practice. Milton also announced thatthe meeting with Hillsb. <strong>County</strong> Commissioner Ken Hagen to promote the proclamation (forHillsb. <strong>County</strong>) for “May is Motorcycle Awareness Month” is set for 5/5/10 at Mr. Hagen’s <strong>of</strong>ficeat 1:15pm. Plans were discussed to meet at the Pole Barn at 12:15pm for travel to Mr. Hagen’s<strong>of</strong>fice. All members were invited to attend this important event.9. PR/COMMUNICATIONS TRUSTEE: “Beamer” reported that we she will begin PR forSpooks N Scoots on the motorcycle websites now. She thanked Milton for his help with thislast year and in advance for his help this year. There is a PDF file (current Spooks Flyer) availablefor download on the chapter website. Board Members present were: Richard Nasrallah,James Sewell, Bill Nasrallah, Barbara “Beamer” Cronk, James Cass, Darlene Newland, OpalGierschke and Patti Nasrallah.1. INTRODUCTIONS & PRESIDENTS REPORT: Richard welcomed all guests and visitors.Richard led pledge <strong>of</strong> allegiance and a moment <strong>of</strong> silence.2. VICE PRESIDENT’S REPORT: James Sewell announced that the Board has decided thatour <strong>Oct</strong>ober chapter meeting will be on Sept. 26 th (since Spooks N Scoots falls on our regularfirst Sunday <strong>of</strong> the month).3. SECRETARY’S REPORT: Beamer reported that were no changes submitted for the chaptermeeting minutes. Motion made by James Sewell that last month’s minutes will be printed inthe newsletter and therefore do not need to be read to the chapter at this time – Motion Secondedby Dar Newland - <strong>Chapter</strong> voted & this motion carried.4. TREASURER: Bill Nasrallah reported the chapter’s current bank accounts balances. Billalso reported that the chapter spent money on Insurance for our upcoming Spooks event, Paperfor the Flyers and some expenses for the Memorial Tent. He also announced to the chapterthat the current month’s expense and balance report is available for any member to viewafter the meeting. Motion made by Beamer to accept the Treasurer’s Report – seconded byJude Redding. <strong>Chapter</strong> voted & this motion carried.5. MEMBERSHIP TRUSTEE: Steve Nasrallah reported that we have 249 members as <strong>of</strong> todayand encouraged members to carry trifolds chapter with them at all times.6. PRODUCTS TRUSTEE: Dar Newland reported on the progress with the Spooks Shirt andPatch order. The design for this year’s order will be available soon. She will circulate that tothe board (via email) as soon as it is available.7. SERGEANT AT ARMS: James Cass reported on the upcoming Spook Trailer Inventorycoming up this Saturday – the 7 th @ 9am. Board is expected to attend – any one else wishingto volunteer to help is welcome. He also discussed the need for volunteers for security forSpooks. His phone number and email are on the chapter website.8. LEGISLATIVE TRUSTEE: Richard reported that Milton Gonzalez had to resign form thisposition due to personal reasons. Richard spoke <strong>of</strong> what a great job Milton had done. Richardalso spoke to the chapter about how important it is that we fill this position as soon as possible.9. PR/COMMUNICATIONS TRUSTEE: “Beamer” reported that on Sept. 11 th , we will have abooth at the next Main St. Music & Motorcycles event. She and Steve Nasrallah will head upthe team for that event and volunteers are needed. Beamer also announced that the Spooksflyers were now available and encouraged people to take some and help with distribution. Another5,000 flyers will be available at the Sept. Meeting. She also spoke on the Bike Tickets(for State Fundraiser) are on sale now and that Steve Nasrallah is coordinating getting ticketsout to members to get them sold.10. STATE BUSINESS: Patti Nasrallah reported that Leadership Seminars (in July) went well.Richard thanked the 4 board members from HCC that attended the Seminars. Patti also reportedthat “Doc” (our state president) has promised to find another hotel for this event nextyear. Our Delegates voted at the last state meeting for the state board elections as the chapterhad decided. Patti explained the state election results. The next state meeting will be inPutnam <strong>County</strong> on 8/14/10. Our State Delegates will be Richard and Steve Nasrallah for thatmeeting.

SAFETY TRUSTEE: James Cass reported that this past Friday had been a very bad dayfor motorcycle accidents in <strong>Hillsborough</strong> <strong>County</strong>. Leroy Collins (former Exec. Director <strong>of</strong> VeteransAffairs for the state <strong>of</strong> <strong>Florida</strong> as well as the son <strong>of</strong> the former Governor Leroy Collins)had been hit and killed while riding his bicycle on Bayshore Blvd. Beamer reported thatWayno (our former Sgt. at Arms) had been involved in a motorcycle accident on June 19 th .12. NEWSLETTER EDITOR: Opal Gierschke is our new newsletter editor. She is in trainingunder Patti and James Sewell’s supervision. Her email address is: opg@tampabay.rr.com .Beamer said that she will bring the information for the Advertising files to Opal at the nextchapter meeting.13. WEB MASTER: Patti Nasrallah reported that most <strong>of</strong> the work for the chapter site is done(on the State Server) the old web address now takes (forwards) you directly to the correct site.14. OLD BUSINESS: Richard Nasrallah had a discussion with Bill Howe (Tampa CMA <strong>Chapter</strong>)regarding the Children’s Tent for Spooks N Scoots. His wife, Cathy Howe, will be their coordinatorthis year. He also asked if they could please have a pop corn machine rather than asnow cone machine for the tent his year.15: NEW BUSINESS: No New Business16. GOOD OF THE ORDER: Discussion on better ways to get more members to volunteer tohelp at Spooks N Scoots this year. Beamer discussed that if people cannot get there to helpduring the event, that it would be really nice to have some “fresh bodies” to help load the trailerson Sunday after the event is done.50/50: Beamer won the 50/50 Drawing – donated a portion back to the chapter for hearse repairs.Motion Made by Ralph Holder to adjourn the Meeting – Motion seconded by SteveNasrallah - <strong>Chapter</strong> voted and motion passed.
