PRESIDENT'S PERSPECTIVE
Just when you think it is safe to turn off your TIVO® …
Just when you think it is safe to turn off
your TIVO® and start watching TV live again
because the elections are over, another
specter is looming in media land: the 2012
Presidential elections.
Candidates like Newt Gingrich, Mitt Romney
and Sara Palin will be vying to become the
Republican standard-bearer to challenge the
“Obama Dragon.” All of them and more will take
to the news talk channels and rubber chicken
circuit, trying to call in the chits they doled out
during the 2010 election cycle helping congressional,
state and local candidates win elections
or mightily challenge the Democrats.
This next election on the horizon brings up an
ugly sore in the Republican and Democratic
corpus. No, I am not talking about unwinding
ObamaCare or fixing Social Security. Those are
patty-cake games compared to the Big Problem
for politicians: primary elections.
If you recall – in what seems like light-years
ago – Florida and Michigan were particularly
piqued that their significant delegate count
would hardly matter in the Silly Season of the
Presidential Party Primaries.
Every candidate, no matter how crazy or brilliant, has an opportunity
to soar, or crash and burn from these runway states.
4 BUILDING CENTRAL FLORIDA NOVEMBER 2010
Those states, Iowa and New Hampshire, have
populations that are antithetical to most
populous states and are the darlings of the
candidates and the party apparatchik. To them,
the Iowa Caucuses were the “kiddy wading
pool” for presidential contenders. The media
markets are cheap, and winning in those states
is all about putting together an army of supporters,
which anyone can do.
Every candidate, no matter how crazy or brilliant,
has an opportunity to soar, or crash and
burn from these runway states.
Like Little League parents of a Frank Viola
watching the coach installing his son of questionable
abilities to be the starting pitcher,
Florida and Michigan said “No Mas!”
Those states’ political parties thought they
should also be invited to the dance.
(How many metaphors do you think I can cram
in this column? I am going for the record!)
When Florida moved up its primaries to January
of 2008, you would have thought the state had
contracted Ebola and it quickly became the pariah
of the contenders.
Votes cast for Obama or Hillary, McCain or
Romney would not be counted in the conventions,
and delegates from these states would
not be seated at the party conventions. (Never
mind that party conventions are little more
than poorly staged Shakespeare plays, with a
well-known script and outcome.)
When Florida announced its date in late January,
both Iowa and New Hampshire moved their
elections up to early January, and pledged titfor-tat
if any state tried to move earlier.
It was only resolved in 2008 when Obama and
McCain came out of the pack and secured the
necessary delegate votes by the middle of the
summer. Then both graciously agreed to seat
those delinquent delegates at the party conventions.
Lord knows what would have happened
if either had been a close race.
It did help the public understand that the
primary races are actually private elections.
That is, they are not open to the public. If you
are not a party registered voter in most states,
you cannot vote in the primary election. Also,
the National Party determines the rules, not
the Constitution, not the state legislature or
even the state party. (Tell me again why tax
money should go to pay for these primary
election costs???)
So, here we are at the starting line of the 2012
presidential elections, and nothing has been
resolved. Unless the disenfranchised states like
Florida, Ohio, Texas and California are allowed
to be part of the decision-making process,
particularly in the Republican primaries, you
might see the primary elections a year or more
earlier than 2008.
Given the ugliness in this primary, the litany
of blame and accusation, don’t look for these
folks to suddenly become Solomon and
Mother Teresa when it comes to winning the
big prize in 2012.
Where are my TIVO® instructions?
Barton Malow Company
… is proud and excited to be a part of the upcoming
two-project expansion to the Give Kids
The World (GKTW) Village in Kissimmee, Florida.
Barton Malow Company is eager for the opportunity
to manage construction services for
the Gallery of Hope - remodel project, and
the Star Tower - new additions project. The
Gallery of Hope is the transformation of an
existing Caring Center, into a fully interactive
Center that will tell the story of Give
Kids The World, its partners, and its founder,
Henri Landwirth. The Star Tower project will
provide a new tower addition to the existing
Castle of Miracles building. Upon arriving
at the Village, each child visits the Castle of
Miracles and writes their deepest wish onto a
gold star. Then, with the aid of animation, the
star “magically” disappears. The next morning
when the family returns, they are captivated
to see that the Star Fairy has placed the
star on the ceiling, with all of the other stars!
The castle sky is running out of room – no star
is ever removed from the ceiling, as family
members often return once their child has
passed on, to find their star and think back
to the best week of their lives. In order to
make room for the 8,000 stars a year that are
added to the castle sky, Barton Malow will
help provide space for an additional 10 years
worth of stars and wishes!
Both of these projects will be complete in
time for the Give Kids The World 25th Anniversary
Celebration that will take place in
spring 2011.
NOVEMBER 2010 BUILDING CENTRAL FLORIDA 17

For Here or
In the struggling restaurant market, builders
are finding opportunities in old, familiar places.
Buffalo Wild Wings
18 BUILDING CENTRAL FLORIDA NOVEMBER 2010
TO GO?
It doesn’t take an advanced economics degree
to know the restaurant business is still
climbing out of a funk. Reams of sales data
and market research can confirm it, but the
restaurant industry's tale can likely be told by
anecdotes culled from any American family.
We’re eating out less, spending less per check
and changing the way we perceive value in a
bought-and-paid-for meal.
The stakes for this industry are high. According
to the National Restaurant Association,
about one in every ten working Americans is
employed in the restaurant industry, including
more than 804,000 Floridians. Even in an off
year, the restaurant business is expected to
generate $27.6 billion in sales, and there is a
positive outlook for the future. The Association
expects restaurant employment to grow by
nearly 16 percent during the next ten years.
The current cloud over the market, however,
remains.
The National Restaurant Association's monthly
Restaurant Performance Index report for
September 2010 shows restaurants are still
missing targets for sales, capital expenditures
and customer traffic. The last time the Index
showed consistently positive results in those
categories was the summer of 2007. In lieu
of numbers, take a drive through your town's
main street to see the evidence firsthand.
Empty storefronts are an all-too-common
sight in most Central Florida communities,
and in many of those holes a thriving restaurant
once stood.
For ABC Central Florida members, however,
those empty spaces are turning out to be
part of the solution, not just a symptom of
the problem. A glut of available space and
aggressive pricing from contractors is creating

a shift in the buying and building strategies
of many of the area's largest restaurateurs.
A new focus on renovation and remodeling
of old and existing restaurant space is giving
quick-thinking contractors an infusion of new
work on projects that were completely off
the radar for corporate and private restaurant
owners only a few short years ago.
“About 30 percent of our restaurant business
today is remodel or buildout work,” says Brian
Roehn, project manager for Schmid Construction
in Clermont. “When I started with the
company five years ago, we had plenty of
projects, but virtually none of them involved
the renovation of existing space, especially
not in the restaurant sector. It’s a different
story today, and we’re seeing a major shift
toward cost-effective use of old or existing facilities.
Fortunately, it’s helping to offset some
of the new, vertical construction business that
has yet to re-materialize.”
Buffalo Wild Wings Grill and Bar, together
with the company’s local franchisees, has
been a major Schmid client for several years,
and the sports-themed eatery’s recent expansion
strategy is a perfect example of the
emerging balance between building out and
building up. Schmid recently completed two
new ground-up restaurants for the company,
one in Kissimmee and another in Clermont.
Meanwhile, two more Buffalo Wild Wings locations
are on the horizon for Schmid, but the
new stores in Lake Buena Vista and Daytona
will both be retrofits of existing freestanding
restaurants that had gone out of business.
Schmid’s success with Buffalo Wild Wings
and its other restaurant clients is the result
not only of aggressive bidding, but a change
in the contractor’s working relationship with
the property owners themselves. Brian reports
that he and his colleagues at Schmid
are working much more closely with owners
directly and getting involved in projects, both
new vertical and remodel, sooner than they
have in the past.
The owners who are still expanding or renovating
are looking for more value than ever
before,” Brian says. “That means we’re meeting
directly with them early in the pre-planning
stages of projects to evaluate potential
costs and give them as much value for the
dollar as possible. Nothing gets overlooked.
Fixtures that cost $25 each instead of those
that cost $100 make a big difference, and
those types of decisions are being scrutinized
harder and sooner than before.”
It’s a similar experience at Window Interiors,
a provider of cutting-edge window treatments
and shades to a variety of commercial
clients, including several of the largest fastfood
and casual-dining restaurant chains in
the country.
Kafé Kalik – A recent Window Interiors project.
“Owners are relying on subcontractors a lot
more now to keep costs down and find new
ways to trim net operating income once the
new building is up or the remodel is completed,”
according to Christine Cutler, director of
business development at Window Interiors in
Altamonte Springs. “Instead of leaving many
of the decisions to the designers or architects,
we’re being brought in at the earliest
planning stages to incorporate money-saving
ideas from the beginning.”
Early involvement is taking place in both new
construction and remodeling projects by Window
interiors's restaurant clients, and just as
it is at Schmid Construction, the shift toward
renovation business is significant.
“Our largest fast-food client predicted several
years ago that renovation of current stores
would be a major focus in 2010 and 2011,”
Christine says. “As such, about one-third of
our business with that client now occurs at
existing locations. There will always be new
vertical construction projects, but the new
emphasis on buildout work is huge, and I expect
the mindset to continue even after the
economy rebounds. Owners have discovered
that smart use of existing facilities can be
profitable and cost-effective. Together with
the desire to be more environmentally conscious
and energy efficient, we expect clients
to make expansion via buildout a major part
of their growth plans from here on out.”
At the same time, a merger involving one of
Window interiors's largest sit-down restaurant
clients is creating even more opportunities
for remodel work as newly acquired locations
are renovated to incorporate the style
and branding of the new parent company.
“Mergers are happening often right now
because acquisition prices are so attractive,”
Christine says. “For us and many of the subcontractors
we work with, it’s providing a lot
of much-needed work.”
For those general- and sub-contractors who
rely heavily on the restaurant business, the
new emphasis on retrofit construction is helping
to keep the doors open and staff levels
stable, but it also means smaller contracts
per project. Consequently, a greater number
of remodel projects are needed to match the
revenue-generating power of traditional vertical
construction. Both Schmid Construction
and Window Interiors have seen a decline
in dollars per contract bid, but a spike in the
number of contracts in-house and those in
the bidding pipeline. Competitors, no doubt,
are in the same boat. Therefore, while the
supply of renovation jobs is up, demand
among all the competing contractors is higher
still. The natural result is severe downward
pressure on pricing, making remodel business
far from ideal, but necessary in today’s environment
to keep revenue streams flowing.
“It’s aggressive, no doubt about it,” says
Brian, who reports that Schmid Construction
has been able to hold steady at around
25 employees through the last several lean
years. They’ve even added a couple of superintendents
to the payroll to accommodate
the larger number of open projects. “Talk to
ten clients, and pricing is at the top of each
of their lists of concerns, and it can’t come
at the expense of job quality, either. Smaller,
more nimble contractors can be aggressive
in the bidding and still deliver high-quality
work with a lot of value. We’ve seen a lot of
medium and large-sized contractors go out of
business, but we’ve managed not to fall into
any big holes.” ■
Moving to the High Five
Training, Education, and Management (TEAM) Awards
Who is responsible for
training at your company?
Let’s continue to uncover treasures of successful
companies for the purpose of helping
your company improve your training
program. Categories A and B were discussed
in September and October issues of Building
Central Florida.
C. RESPONSIBILITY FOR
TRAINING DEFINED
Scoring:
0 points – Responsibility for training has not
been defined within the company
2 points – Training Coordinator has full
responsibility for results of the training program.
Supervisors look to training coordinator
to perform training activities.
4 points – Responsibility for training defined
for all levels of company, however, it is not
in writing. Operating supervisors have key
responsibilities.
6 points – Responsibility for training is defined
for all levels of company and is in writing
and part of training/Human Resources
manual. Operating supervisors have key
responsibilities.
Take a look at this! The average score for
this category was 5.21 points. 33 companies
scored themselves with all six points and
here’s the breakdown:
• 401 plus employees – 6 companies
• 201 to 400 employees – 6 companies
• 101 to 200 employees – 6 companies
• Up to 100 employees – 15 companies
An opportunity to demonstrate your company’s
commitment to training! Before deciding
there’s just no way for your company to
designate someone responsible for training,
let’s dissect this, consider some options, and
make an educated decision.
20 BUILDING CENTRAL FLORIDA NOVEMBER 2010
Benefits of defining responsibility
for training
1. Training will be aligned with company goals.
2. Learning can be applied to the job to
make a positive difference in individual,
group, and company business results.
3. Track that employees are in a continuous
learning mode.
4. Define what the employee needs to
learn achieving both personal and professional
results, ROI (return on investment).
5. Engage employees in company goals and
how those larger goals are affected by
the department and by the work of individual
employees.
Let’s explore what the High-Five TEAM Award
winning companies do:
• All employees are required to annually
complete a specific number of training
hours and this is tracked by a dedicated
person.
• Intranet courses are available to all
employees and the software tracks progress.
• Training Coordinator is responsible for
locating and tracking training with input
from managers.
• Training Committee is responsible for determining
company training goals, working
on curriculum, instructors, sources,
and budget.
• Learning plan defined by job title and
aligned with performance reviews and
may be tracked through an LMS (learning
management system). Learning plan
developed by upper management and/
or Board of Directors.
• Supervisors are responsible for training
employees assigned to them and are
evaluated in their performance review
for their effectiveness in coaching, training,
and mentoring these employees.
Here are some options for assigning responsibility
for training at your company:
If your company does not have spare resources
(people or time):
Have supervisors define training goals for
individual employees. Develop an Excel
spreadsheet for all employees to access and
individual employees log their own training
achievements as they occur. Supervisors use
this information during performance reviews.
Distribute the responsibility among multiple
employees:
Divide training into categories and among
multiple knowledgeable employees: safety,
CEUs, soft skills, computer skills, leadership,
estimating, marketing, business skills, financial,
continuing education, etc. Each category
includes options for training providers and
specific topics. Track all training in one common
file or software. Supervisors define what
training their employees need to accomplish
in a defined period of time and record accomplishments.
Progress is reviewed and communicated
monthly, quarterly, etc. as part of
performance reviews.
Develop a Committee
The committee’s objective is to develop, implement,
and continuously improve training
procedures, programs, policies and practices.
All goals should be aligned with company
goals and clearly communicated to employees.
Include upper management, supervisors,
and employees and define an annual
meeting schedule. Managers and supervisors
work from what the committee establishes
and training is tracked in one common file or
software.
Training Mentors or Coaches
Employees in your company have mastered
skills in various areas. Effectively use these
skills by engaging them to help others learn

and give both the mentor/coach and the
learner credit on their performance reviews.
LMS (Learning Management System)
Purchase an LMS which is customized to
include a wide variety of training courses
supporting learning plans developed for each
employee. Classes can be taught internally or
by external resources. The LMS will communicate
and track all available training as defined
by your company. Progress is evaluated in
performance reviews.
Assign responsibility for training
Employ a dedicated employee to make available
and track employee training that sup-
ASE Technicians
Your owner’s manual for your vehicle is helpful
for keeping you up-to-date on the maintenance
intervals and checks necessary to
keep your vehicle running smooth. But some
answers to the most commonly asked questions
are not found in the manual. We have
compiled a list of frequently asked questions
about vehicles and vehicle maintenance, with
answers provided by the ASE certified technicians
at Enterprise Fleet Management.
24 BUILDING CENTRAL FLORIDA NOVEMBER 2010
Speak Out
on Maintenance
By Hollis Allen, Enterprise Fleet Management
How can I make my tires last longer?
Properly maintaining you tires including
pressure, alignment and rotation is the key
to making them last longer. Try to check tire
pressure at least once a month and before
any long road trips. If possible, have your
tires rotated in conjunction with every other
oil change. Tire rotation is important and can
extend the life of the tires by as much as 20
percent. Another factor that can affect the life
of your tire is driving conditions such as on or
off road, frequent turns, rapid acceleration
and hard braking. Also, overloading the vehicle
can cause extra wear on your tires as well.
Can I extend my oil change intervals by
switching to synthetic oil?
Even with synthetic oils, you need to change
your oil at or before the manufacturer’s recommended
interval. It is important to follow
these intervals for preventive maintenance
set by the manufacturer to ensure that the
vehicle’s warranty stays valid and the vehicle
keeps running well.
What causes the foul odor when I turn
on my air conditioner?
This is especially likely in humid climates. The
most common cause for the air conditioner
to emit a foul odor is that the evaporator
case has collected moisture due to condensation.
The mold and mildew left behind by the
moiswture causes the odor. In most cases,
you can spray Lysol or a similar product into
the system’s air intake (usually located at
the base of the windshield) with the blower
on high to kill the odor causing mold. Some
products available at local automotive parts
vendors are specifically designed to fix this
problem, but it may be necessary to have a
professional automotive technician disinfect
the evaporator case if the problem persists.
Do I need to take my vehicle in for a
tune-up at 30,000 miles?
At 30,000 miles we do not recommend replacing
your vehicle’s spark plugs. Most of
today’s vehicles have engines equipped with
platinum tipped spark plugs that do not require
replacement for up to 100,000 miles.
The only instance you would consider replacing
these spark plugs prior to 100,000 miles is
if you are experiencing drivability problems,
poor fuel mileage or similar problems that
can be attributed to the spark plugs. Consult

your owner’s manual for the recommended
tune-up interval.
Why do the brakes on some vehicles
wear out more rapidly than others?
There are several factors that can contribute
to brake wear. A major factor is the quality
of material used to make the brake pads.
This depends on the make and model of the
vehicle. Like the tires, the wear on the brakes
is also affected by the driving conditions in
which they are used. Whether or not they are
used in the city, on the highway, or in a hilly
or flat area makes a big difference on how
quickly the brake pads will wear out. Heavily
loaded vehicles and vehicles pulling trailers
are also harder on brakes. The more stops the
driver makes and, even more importantly, the
more quick or sudden stops a driver makes,
the more wear there will be on the brakes.
How often do filters need to be changed?
The filters that keep your engine clean and
running smoothly should be examined regularly
and changed when necessary. Engine
oil filters should be replaced every 5,000 to
6,000 miles, along with an oil change. Air filters
should typically be changed at 50,000-mile
intervals or as needed. In situations where
vehicles are operating in extremely dusty conditions,
the filters should be checked daily or
weekly and replaced when needed. The fuel
filter should be replaced every 30,000 miles for
gasoline engines and every 12,000 to 15,000
miles for diesel engines. Finally, the automatic
transmission filter and fluid should be replaced
at 60,000 mile intervals. If your vehicle is pulling
a trailer, carrying heavy loads or doing a
lot of stop-and-go driving, it may be necessary
to service the transmission more frequently
because transmissions in these situations can
develop excess heat. Because vehicle specific
service intervals may vary, check the owner’s
manual for your vehicle.
Finally, remember always to pay close attention
to the manufacturer’s warranty information
in the owner’s manual. Failing to adhere
to specific guidelines established by the
manufacturer may prevent your repairs from
being covered by warranty. ■
The
Williams
TEAM
awards
As the inspiration to start a training
a “learner” himself, Bob Lipscomb,
president of Williams Company, got
program from a book he was reading. The book,
“First, Break All the Rules: What the World's
Greatest Managers Do Differently” is based on
in-depth interviews by the Gallup Organization
of over 80,000 managers in 400 companies.
In reading the book, Lipscomb learned that
without satisfying an employee’s basic needs
first, a manager can never expect an employee
to give stellar performance. These basic needs
are: knowing what is expected of the employee
at work and giving him/her the equipment and
support to do the work right. “It is critical to
make sure everyone has the tools they need,”
said Lipscomb. “Then, they need to know how
to use those tools.”
From there, the Williams “Knowledge College”
was born.
To get the Knowledge College kicked off, Cheryl
Ranier was selected as the training coordinator.
The program requires that each employee
complete 32 training hours each year, and a
training budget is set based on a percentage
of payroll.
The training runs the gamut based on each
particular person’s needs and interests. Training
hours have been earned for attending
a conference in Seattle, trade association
training sessions, tuition reimbursement for
someone seeking their bachelor or master’s
degree and more. There is currently no maximum
amount for each person, and although
the training budget has been affected by the
current economic slowdown, it has also given
the team at Williams the opportunity to get
As one of only five companies to receive a Five-star T.E.A.M
award, Williams Company in Orlando isn’t just riding out
this storm. Through effective management and leadership’s
committee to the entire team, this company is taking the bull by
the horns. Through training and education, employees continue
to sharpen their skills to be the best of the best in their industry.
creative by utilizing subs and vendors for lunch
‘n learns and having internal team members
with specializations teach classes.
Ranier tracks training material and efforts on
a monthly basis and sends updates quarterly
to keep employees on track. Quarterly reports
that document the progress of training efforts
for each individual are completed, and the
completion of training goals is a factor during
performance evaluations conducted by
management. The training credits are tracked
by Ranier in an Access database, and the company
Intranet site is utilized for distribution of
training material.
Special incentives such as gift cards given to
the employee with the most training hours or
a trip with family for the first three employees
to receive the LEED AP designation are also
available to keep employees motivated and
excited about their training.
Another successful program was the launch of
the annual “Training Camp,” where the office
was set up like a campus, and several classes
ranging in a variety of topics were offered
throughout the day. “The Power of Thanks,”
“Williams Company History” and “Scheduling,”
were just some of the topics covered. The
Training Camp was held during a traditionally
slow time for the company and gave employees
the opportunity to fulfill their training requirements
before the end of the year.
According the Lipscomb, the training program
has helped Williams in two ways: On the technical
side, it has helped the team get the most
pertinent and current technical education, and
on the soft side, it has helped with skills such
By Kati Trisler
Energy Air, Inc.
as understanding customer relations, time
management and organization.
Williams has received numerous TEAM
awards, and Lipscomb feels the true benefit
comes from the employees realizing the company
is at the forefront of the industry and all
the hard work is paying off. “We want this to
be a special place where people say, ‘Wow,
what a great company that’s really interested
in my betterment,” said Lipscomb. “If they
don’t stay, they’ve at least taken some valuable
stuff with them.”
The biggest challenges in managing and maintaining
the training program according to
Lipscomb and Ranier are keeping people interested
and getting the field employees to take
time out of their schedules to come into the
office for training.
If a company is only able to do the basics, safety
should be a mandatory training effort and
then customer service, said Lipscomb. “We’re
in the service business,” he said. “All you really
have is the level of service you provide. Hold
employees accountable.”
When asked what advice he would give fellow
ABC members considering a training program,
Lipscomb said, “Determine what you are trying
to accomplish. Determine your training goals,
and you must have full support of management.
Think to yourself, “What do we need to get
better at?” he said. Lipscomb also stressed the
importance of having management’s support.
“It must come from the top that it’s important
to your culture,” he said. “You can’t fake it.”

Safety
Why Should It Be Important
to My Company?
By Luis Santiago
In my two previous articles (September and
October), I described a day’s work when you
learn of a serious incident at one of your
sites, the disruption it caused to your operations,
and to top it off, the arrival of the OSHA
inspector on site. For more details, please
read those previous articles.
Why safety? The aftermath; continued.
Upon arrival, the inspector identifies herself
and explains her presence while walking
to where the incident happened. She takes
plenty of notes, video and pictures, conducts
soil tests, and bags some soil samples from
the excavation. She talks privately with the
excavator operator and your foreman, who
was already warned about the unsafe conditions.
Your foreman is struck with grief. The
inspector also talks to other employees who
had been in the vicinity or in the hole when
and before the incident happened. After she
finishes talking with nearly everyone on site,
she talks to first responders and the county
inspector. She tells you that the inspection
will continue and leaves the site. The foreman
approaches you and blames the accident on
the push for completion. He feels guilty, quits
his job, and leaves the site.
You visit the injured worker at the hospital to
learn from his sobbing wife that the doctor allegedly
told her that if her husband survived,
he might not walk again. His two young children
are also in the room. You try to comfort
them but you do not know what to say or do.
In the following days, the inspector calls to
coordinate interviews on and off site with
other employees. Every time the inspector is
onsite, operations come to a crawl and, she
visits for several days. In the meantime, you
resolve the situation with the developer and
the county inspector at the other site where
work was stopped for a week. Now you’re
behind schedule on both sites.
The OSHA inspector calls to meet with you
and have her closing conference. During the
conference she summarizes her findings from
the incident and indicates that citations may
be issued. Several months later, you receive
the OSHA correspondence and citations are
issued. Some carry a Willful designation and
some Serious. Total penalties are in excess of
$300,000.
Everything goes through your mind again.
How will this affect the future of your business?
Your attorney says you probably need
to contest the citations because the Willful
designation weakens workers compensation
protections. Your carrier also informs you that
they plan to drop your coverage and might
not even cover your claim because the injured
was an undocumented worker. You now
remember that an officer from ICE was at the
hospital when you visited the injured worker
and briefly spoke with you.
Can we quantify the costs incurred and those
not yet known? Because there were Willful
citations, you opened the door to being sued
and, if the worker dies, you and your foreman
could be criminally charged. On top of that,
your mod/rate changes, the project delays represent
additional costs, you are turned down
at other sites you were bidding, ICE is investigating
you, legal costs are quickly adding up,
and I could go on and on. Your liability is now
in the millions of dollars. Do your own math.
Was it worth taking chances?
If you would have implemented and enforced
an effective onsite safety program, workers
would have been safe and the accident would
not have happened. Work would have been
on schedule at both sites. Your company
would continue to thrive.
Can this happen to you? It did! The owner is
now employed elsewhere.
PERFORMANCE!
WHAT YOUR
LAWYER NEEDS
FOR A BID
PROTEST
By John Horan of Foley & Lardner LLP
Bid protests usually present acute situations
with tight deadlines. Your lawyer must quickly
analyze your legal position and prepare the
appropriate documents that preserve your
rights. Sometimes the bid protest must be
filed within a few days, or within hours of the
agency’s notice of the award. You can help
your lawyer by quickly providing the documents
that need to be reviewed in an organized
fashion. The following is a list of what
your attorney needs:
• The solicitation documents issued by the
agency, including all addenda and amendments
issued during the solicitation process
• Responses to the solicitation submitted by
you and other bidders/proposers
• The Bid Tabulation
• Minutes or transcripts of any
pre-bid meetings
• Minutes or transcripts of any
meetings of evaluators
• Letters, emails, or other communications
from or to the agency
• Notes of conversations with
agency personnel
• An outline of your own analysis of
why you want to file a protest
• Applicable bid protest procedures
and deadlines
Most of these documents should be in your
files; but what is not in your files can be obtained
from the agency either consensually
or by your attorney through applicable public
records laws. One final point, bid protest
procedures are not uniform. Make sure you
understand the bid protest procedures and
deadlines. If they are not included in the solicitation
documents, you should get a copy
and give it to your lawyer.
