Association of Chief Police Officers –Written evidence9. 2004/757/JHA - Laying down minimum provisions on the constituentelements of criminal acts and penalties in the field of drug trafficking. UKlegislation already exceeds the issues raised in this TPM which makes it largelyirrelevant.10. 2008/206/JHA - Defining 1-benzylpiperazine (BZP) as a new psychoactivesubstance which is to be made subject to control measures and criminalprovisions. See 1999/615/JHA, ante.11. 2009/936/JHA - Adopting the implementing rules for Europol analysiswork files. This is an unnecessary measure that is not required for our membershipof Europol or Eurojust.12. 2010/348/EC - Concerning the conclusion of the Agreement between theGovernment of the Russian Federation and the European Union on theprotection of classified information. ACPO forces have their own rules on theexchange of information with Russia. We do not use this measure and ACPOrecommend against implementation as is in the interest of national security and goodlaw and order that the various branches of UK policing decide both the general andprecise ways that information is shared with Russia.TPMs that have been replaced by post Lisbon measures or are likely to be beforeDecember 20141. 1996/747/JHA - Creation and maintenance of a directory of specializedcompetences, skills and expertise in the fight against internationalorganized crime. This directory was closed down in February 20122. 1998/427/JHA - Good practice in mutual legal assistance in criminalmatters. This measure basically required the member states to provide a statementof intent on how MLA matters would be dealt with. When the EIO comes into forceat the end of 2014 (likely to be the same time as the TPMs move across) it will repealall of the MLA TPMs. As the UK is signed up to the EIO, it makes these TPMs largelyacademic.3. 2000/261/JHA - Improved exchange of information to combat counterfeittravel documents. This is a defunct system that is no longer in use.4. 2001/220/JHA - The standing of victims in criminal proceedings. ThisDecision has been superseded by PE-CO S 37/12 and so no longer resides within theTPM.5. 2003/577/JHA - Execution in the European Union of orders freezingproperty or evidence. It is important to be able to quickly seize physical evidenceand evidence although the current measures will be superseded once the EIO comesinto force, removing this measure from the TPM list. As such, the issue of optingin/out is not a live one.30
