My only concerns as Independent Reviewer are that the UK should not put at risk itsability to rely on such pre-Lisbon measures as are of genuine assistance in the fightagainst terrorism and, more broadly, that it should not diminish the beneficialinfluence over other countries’ approach to counter-terrorism that it has earnedthrough the EU over the years.14. PURPOSE / RECOMMENDATIONS1.1 Purpose of Paper1.1.1 This paper is written in response to the call for evidence from the House of LordsSelect Committee on the European Union in consideration of the 2014 opt-outdecision under Protocol 36 of the Treaty of Lisbon.1.1.2 Many of the questions contained within the call for evidence are properly forconsideration by the legislature or the judiciary; in preparing this paper, ACPO isonly able to give a view on operational policing matters and how they may beaffected by the opt-out decision for each of the Third Pillar Measures (TPMs)1.1.3 As such the purpose of this paper is to determine which of the TPMs ACPO shouldrecommend that the UK opt back into from a policing and community safetyperspective. It should be noted that ACPO’s analysis has concentrated on thosemeasures that impact directly on policing and it has not considered in full theadvantages and disadvantages of opting back into measures which do not have suchimpact.1.2 Recommendations1.2.1 ACPO:• Recommends that 13 separate TPMs are opted back into.• Recommends that 12 TPMs should not be opted back into• Recommends above all else, that the EAW be opted back into under thesame arrangements that are currently in place.2. BACKGROUND2.1 The Opt Out Decision2.1.1 ACPO recognise that arguments pertaining to police operational efficiency andeffectiveness and will be important in influencing decision-making but on their ownmay not be the determining factor. However it is important that appropriate weightis given the impact of changes on policing and community safety. From this stance,ACPO seek to give clarity about the relative priority attached to each of themeasures affected and to proffer arguments about their importance supported bypractical evidence.2.2 Assessment Methodology2.2.1 The assessment has been undertaken by a small team led by Commander AllanGibson, ACPO lead for Extradition and Mutual Legal Assistance.2.2.2 The assessment approach has comprised:5
