Rule 42. PROVISION REGARDING EMPLOYEES LENT TO GOVERNMENT /SUBSIDIARY COMPANY OR OTHER PUBLIC UNDERTAKINGS,ETC.(1) Where the services of an employee are lent to the Government or any authoritysubordinate, or to a Subsidiary Company or to any other public sector undertaking( hereinafter referred to as the “borrowing authority”) the borrowing authority shallhave the powers of the appointing authority for the purpose of placing such anemployee under suspension and of the disciplinary authority for the purpose ofconducting disciplinary proceedings against him, provided that the borrowing authorityshall forth with inform <strong>BSNL</strong> ( hereinafter referred to as the lending authority ) of thecircumstances leading to the order of suspension of an employee or the commencementof the disciplinary proceedings as the case may be.(2) In the light of the findings of the inquiring authority against the employee:(i)If the borrowing authority is of the opinion that any of the penalties specified inClauses (a) to ( e ) of Rule 33 ( minor penalties ) should be imposed on theemployee, it may, after consultation with the lending authority, make suchorders in the case, as it deems necessary:Provided that in the event of a difference of opinion between the borrowing authorityand the lending authority, the services of the employee shall be replaced at the disposal of thelending authority.(ii)Explanation:If the borrowing authority is of the opinion that any of the penalties specified inclauses (f ) to ( j) of Rule 33 should be imposed on the employee, it shallreplace his services at the disposal of the lending authority and transmit theproceedings of the inquiry for such action as deemed necessary to that authority.The disciplinary authority may make an order under this clause on the record ofinquiry transmitted to it by the borrowing authority or by holding such further inquiries, asit may deem necessary , as far as may be in accordance with Rule 35,36 or 37Rule 43.SPECIAL PROVISIONS IN RESPECT OF D.O.T STAFF ON PERMANENTABSORPTION IN <strong>BSNL</strong> – CONFERRING SAFEGUARDS RELATING TOSECURITY OF SERVICE ON DISMISSAL/REMOVAL.The D.O.T. employees on absorption in <strong>BSNL</strong> shall be governed by these rules from thedate of their absorption in the company/date of issue of these rules. However,dismissal/removal from the service of <strong>BSNL</strong> after absorption, for any subsequentmisconduct shall not amount to forfeiture of his retirement benefits for the service renderedin the Central Govt. Also in the event of dismissal/removal of such an employee from<strong>BSNL</strong> (i.e. D.O.T. staff permanently absorbed in <strong>BSNL</strong>), the employee concerned will beallowed protection to the extent that D.O.T. will review such order before final decision istaken by <strong>BSNL</strong>.34<strong>BSNL</strong> CDA <strong>RULES</strong> <strong>2006</strong> (Updated upto 24-01-2013)
