38<strong>Safeguarding</strong> <strong>Vulnerable</strong> <strong>Groups</strong> <strong>Act</strong> <strong>2006</strong> (c. 47)Crown51 Crown application(1) Subject to the provisions of this section, this <strong>Act</strong> and any regulations or ordersmade under it bind the Crown.(2) No contravention by the Crown of any provision of this <strong>Act</strong> or of anyregulations or order made under it makes the Crown criminally liable.(3) Despite subsection (2), this <strong>Act</strong> and any regulations or orders made under itapply to persons in Crown employment (within the meaning of theEmployment Rights <strong>Act</strong> 1996 (c. 18)) as they apply to other persons.(4) Subsection (2) of section 6 does not apply in relation to any activity carried outby the Crown.(5) Each government department and other body performing functions on behalfof the Crown—(a) if the department or body engages in regulated activity, is the regulatedactivity provider in relation to the activity;(b) if the department or body engages in controlled activity, is theresponsible person (within the meaning of section 23) in relation to theactivity.(6) In subsection (5) “body” includes office-holder.(7) Nothing in this section is to be taken as in any way affecting Her Majesty in herprivate capacity (within the meaning of section 38(3) of the Crown Proceedings<strong>Act</strong> 1947 (c. 44)).Miscellaneous52 Referrals: findings of fact immaterial(1) <strong>For</strong> the purposes of the provisions mentioned in subsection (2), it is immaterialwhether there is a finding of fact in any proceedings.(2) The provisions are—section 35(3)(b) and (c);section 36(4)(b) and (c);section 39(2)(b) and (c) and (5)(a);section 41(2)(b) and (c) and (5)(a);section 45(2)(b) and (c) and (5)(a).53 Fostering(1) Despite section 58, this <strong>Act</strong> applies to activity that is regulated activity byvirtue of paragraph 1(5) of Schedule 4.(2) Subsection (1) does not affect the operation of this <strong>Act</strong> in relation to any otheractivity that is carried out in connection with a foster child.(3) Subsection (4) applies if a person (P)—(a) makes arrangements for another person to foster a child as a privatefoster parent, and
