50Safeguarding Vulnerable Groups Act 2006 (c. 47)Schedule 1 — Independent Barring BoardFunding11 The Secretary of State may make payments to IBB of such amounts, at suchtimes and on such conditions (if any) as he thinks appropriate.Accounts12 (1) IBB must keep its accounts in such form as the Secretary of State determines.Status(2) IBB must prepare annual accounts in respect of each financial year in suchform as the Secretary of State decides.(3) Before the end of the specified period following the end of each financialyear to which the annual accounts relate IBB must send a copy of theaccounts to the Secretary of State and the Comptroller and Auditor General.(4) The Comptroller and Auditor General must—(a) examine, certify and report on the annual accounts;(b) send a copy of the accounts and of his report to the Secretary of State,who must lay them before each House of Parliament.(5) The financial year is—(a) the period starting on the day IBB is established and ending on thenext 31st March;(b) each succeeding period of 12 months.(6) The specified period is such period as the Secretary of State directs.13 (1) IBB is not to be regarded—(a) as the servant or agent of the Crown, or(b) as enjoying any status, immunity or privilege of the Crown.(2) IBB’s property is not to be regarded as property of, or property held onbehalf of, the Crown.Payments in connection with maladministration14 (1) If IBB thinks—(a) that action taken by or on behalf of IBB amounts tomaladministration, and(b) that a person has been adversely affected by the action,IBB may make such payment (if any) to the person as it thinks appropriate.(2) “Action” includes failure to act.Incidental powers15 (1) In connection with the exercise of any of its functions IBB may—(a) enter into contracts and other agreements (whether legally bindingor not);(b) acquire and dispose of property (including land);(c) borrow money;(d) do such other things as IBB thinks necessary or expedient.
Safeguarding Vulnerable Groups Act 2006 (c. 47)Schedule 1 — Independent Barring Board51Documents(2) The power conferred by sub-paragraph (1)(b) includes accepting—(a) gifts of money, and(b) gifts or loans of other property,on such terms as IBB thinks appropriate.(3) But IBB may exercise the power conferred by sub-paragraph (1)(b) or (c)only with the consent of the Secretary of State.(4) Such consent may be given—(a) with respect to a particular case or with respect to a class of cases;(b) subject to such conditions as the Secretary of State thinksappropriate.16 A document purporting to be signed on behalf of IBB shall be received inevidence and, unless the contrary is proved, be taken to be so signed.Staff transfer schemesSCHEDULE 2 Section 1TRANSFERS TO IBB1 (1) The Secretary of State may make a scheme (a “staff transfer scheme”)providing—(a) for a person employed in the civil service of the state to become anemployee of IBB;(b) for his terms of employment to have effect (subject to any necessarymodifications) as the terms of his contract of employment with IBB;(c) for the transfer to IBB of the rights, powers, duties and liabilities ofthe Crown under or in connection with his terms of employment;(d) for anything done (or having effect as if done) before that transfer byor in relation to the Crown in respect of the terms of employment orthe person to be treated as having been done by or in relation to IBB.(2) A staff transfer scheme may provide for a period before a person became anemployee of IBB to count as a period during which he was such an employee(and for the operation of the scheme not to be treated as having interruptedthe continuity of that period).(3) A staff transfer scheme may provide for a person in the civil service of thestate who would otherwise become an employee of IBB not to become suchan employee if he gives notice objecting to the operation of the scheme inrelation to him.(4) A staff transfer scheme may provide for any person who would be treated(whether by an enactment or otherwise) as having his employmentterminated by the operation of the scheme not to be so treated.
