46Safeguarding Vulnerable Groups Act 2006 (c. 47)as the person making the subordinate legislation thinks necessary orexpedient.(2) The Secretary of State may by order may make such further provision as heconsiders appropriate—(a) for the general purposes, or any particular purpose, of this Act;(b) in consequence of any provision made by this Act;(c) for giving full effect to this Act or any provision made by it.(3) Subordinate legislation under subsection (1) or (2) may amend, repeal, revokeor otherwise modify any enactment (including this Act).(4) References in this section to subordinate legislation are to an order orregulations under this Act.(5) Nothing in this Act affects the generality of the power conferred by this section.65 CommencementThis Act (except this section and section 55) comes into force on such day as theSecretary of State appoints by order.66 Extent(1) Subject to subsections (2) to (4), the preceding provisions of this Act extendonly to England and Wales.(2) Sections 1, 28, 29 and 55 and Schedule 1 and, so far as relating to thoseprovisions, sections 59 to 61 and 65 also extend to Northern Ireland.(3) The amendment of an enactment in Schedule 9 has the same extent as theenactment amended, but the amendments made by paragraph 14 of thatSchedule do not extend to Scotland.(4) Her Majesty may by Order in Council direct that this Act extends, with suchmodifications as appear to Her Majesty to be appropriate, to any of theChannel Islands or the Isle of Man.67 Short titleThis Act may be cited as the Safeguarding Vulnerable Groups Act 2006.
Safeguarding Vulnerable Groups Act 2006 (c. 47)Schedule 1 — Independent Barring Board47SCHEDULESSCHEDULE 1 Section 1INDEPENDENT BARRING BOARDMembership1 (1) IBB shall consist of—(a) a chairman;(b) such number of other members as the Secretary of State decides.(2) The chairman and other members—(a) are to be appointed by the Secretary of State;(b) must appear to the Secretary of State to have knowledge orexperience of any aspect of child protection or the protection ofvulnerable adults.Tenure of office2 (1) The chairman and members hold and must vacate office as such inaccordance with the terms of their respective appointments.(2) The appointment of a person to hold office is for a term not exceeding fiveyears.(3) A person holding office may at any time resign that office by giving noticein writing to the Secretary of State.(4) The Secretary of State may by notice in writing remove a person from officeif satisfied that any of the following applies to him—(a) he has, without reasonable excuse, failed, for a continuous period ofthree months, to carry out his functions;(b) he has been convicted (whether before or after his appointment) of acriminal offence;(c) he is an undischarged bankrupt or his estate has been sequestratedand he has not been discharged;(d) he is the subject of a bankruptcy restrictions order or an interim orderunder Schedule 4A to the Insolvency Act 1986 (c. 45) or an order tothe like effect made under any corresponding enactment in force inScotland or Northern Ireland;(e) he has made a composition or arrangement with, or granted a trustdeed for, his creditors;(f) he has failed to comply with the terms of his appointment;(g) he is otherwise unable or unfit to carry out his functions as chairmanor member.
