<strong>Safeguarding</strong> <strong>Vulnerable</strong> <strong>Groups</strong> <strong>Act</strong> <strong>2006</strong> (c. 47)Schedule 4 — Regulated <strong>Act</strong>ivityPart 2 — Regulated activity relating to vulnerable adults69do not include any arrangements made for purposes which are merelyincidental to the purposes for which the charity is established.(6) In this paragraph—“area committee” has the same meaning as in section 18 of the LocalGovernment <strong>Act</strong> 2000 (c. 22);“charity” and “charity trustee” have the same meanings as in theCharities <strong>Act</strong> 1993 (c. 10);“executive”, in relation to a local authority, has the same meaning as inPart 2 of the Local Government <strong>Act</strong> 2000;“local authority” has the same meaning as in the Education <strong>Act</strong> 1996(c. 56);“social services functions”, in relation to a local authority, has the samemeaning as in the Local Authority Social Services <strong>Act</strong> 1970 (c. 42).(7) In relation to a local authority—(a) which is a children’s services authority (within the meaning of the<strong>Children</strong> <strong>Act</strong> 2004 (c. 31)), and(b) which has not appointed a director of children’s services undersection 18 of that <strong>Act</strong>,in sub-paragraph (1)(b) above the word “adult” must be ignored.9 The Secretary of State may, by order, provide that in such circumstances asare specified an activity which is a regulated activity in relation tovulnerable adults is not to be treated as a regulated activity.PART 3THE PERIOD CONDITION10 (1) The period condition is satisfied if the person carrying out the activity doesso at any time on more than two days in any period of 30 days.(2) In relation to an activity that falls within paragraph 2(1)(a), (b), (c) or (d) or7(1)(a), (b), (c), (d) or (g), the period condition is also satisfied if—(a) the person carrying out the activity does so at any time between 2a.m. and 6 a.m, and(b) the activity gives the person the opportunity to have face-to-facecontact with children or vulnerable adults (as the case may be).SCHEDULE 5 Section 11APPROPRIATE VERIFICATIONPART 1DEFAULT POSITION1 (1) A regulated activity provider obtains an appropriate verification inaccordance with this Part if, during the prescribed period—(a) he obtains relevant information relating to B in pursuance of anapplication under section 30, or
