The <strong>in</strong>tend<strong>in</strong>g tenderers from other States may remit the Earnest Money to theExecutive Eng<strong>in</strong>eer <strong>in</strong> the <strong>for</strong>m <strong>of</strong> Bank Draft <strong>of</strong> the State Bank <strong>of</strong> India or any otherScheduled Bank <strong>of</strong> the district where the <strong>of</strong>fice <strong>of</strong> the Executive Eng<strong>in</strong>eer is situated.2.7 Earnest money which has been deposited <strong>for</strong> a particular work will not ord<strong>in</strong>arily beadjusted towards the earnest money <strong>for</strong> another work, but if tender <strong>of</strong> a contractor<strong>for</strong> a work <strong>in</strong> the same division has been rejected and the earnest money has notbeen refunded to him due to some reason it may be so adjusted by ExecutiveEng<strong>in</strong>eer.2.7.1 Applicable to percentage rate <strong>Tender</strong>s – Forms A only.- The percentage tenderedby the contractor will only apply to those rates which f<strong>in</strong>d place <strong>in</strong> the UnifiedSchedule <strong>of</strong> Rates <strong>of</strong> Water Resources Department <strong>in</strong> <strong>for</strong>ce from 01-12-............... orhave been derived from the said schedule <strong>of</strong> rates and not to other items <strong>of</strong> work.2.8 – The security deposit shall be 5% <strong>of</strong> the amount <strong>of</strong> contract.2.8.1. –Security <strong>for</strong> Per<strong>for</strong>mance :- Security <strong>for</strong> Per<strong>for</strong>mance deposit @ 15% <strong>of</strong> theamount payable to the contractor, <strong>for</strong> work <strong>of</strong> the contract. from its runn<strong>in</strong>g bills,shall be deducted till 70% <strong>of</strong> the agreemented amount <strong>of</strong> the work is completed bythe contractor. The 70% <strong>of</strong> contract amount shall not <strong>in</strong>clude any additionalitem/quantity. This security <strong>for</strong> per<strong>for</strong>mance shall be refunded to the contractorimmediately after satisfactory completion <strong>of</strong> the work.2.8.2 - Unbalanced <strong>Tender</strong> :-In item rate tender if the tender rate <strong>of</strong> some items are very much higherthan the estimated rates and <strong>for</strong> some other items <strong>of</strong> work to be executed <strong>in</strong> laterstage or otherwise, the rates quoted by contractor is much lower than the estimatedrates, then this type <strong>of</strong> tender is known as an “ Unbalanced <strong>Tender</strong>”.Payment <strong>of</strong> runn<strong>in</strong>g bills <strong>of</strong> all items <strong>in</strong> unbalanced item rate tenders.( In whichquoted rates are very much higher than the overall tender percentage) should be madeat the estimated rates <strong>of</strong> those items and payment <strong>of</strong> difference amount should not bepaid to the contractor, and should be kept as “additional security deposit”.This additional security deposit shall be paid to the contractor <strong>in</strong> proportion <strong>of</strong> theitems <strong>of</strong> lower rates be<strong>in</strong>g completed by the contractor. The procedure <strong>of</strong> payment<strong>of</strong> this additional security deposit shall be fixed by the <strong>of</strong>ficer accept<strong>in</strong>g / sanction<strong>in</strong>gthe tender. The authority sanction<strong>in</strong>g the unbalance tender shall mention the aboveprocedure <strong>in</strong> writ<strong>in</strong>g at the time <strong>of</strong> sanction<strong>in</strong>g such tender so that this maybecome a part <strong>of</strong> the agreement.2.9 The authority competent to accept a tender reserves the right <strong>of</strong> accept<strong>in</strong>g the tender<strong>for</strong> the whole work or <strong>for</strong> a dist<strong>in</strong>ct part <strong>of</strong> it, or <strong>of</strong> distribut<strong>in</strong>g the work between oneor more tenders.

II ]157[ Appendix <strong>2.10</strong> A<strong>2.10</strong> The tenderer whose tender has been accepted (here<strong>in</strong>after referred to as thecontractor) shall produce an appropriate solvency certificate, if so required by theExecutive Eng<strong>in</strong>eer and will execute the agreement <strong>in</strong> the prescribed <strong>for</strong>m with <strong>in</strong> a<strong>for</strong>tnight <strong>of</strong> the date <strong>of</strong> commu<strong>nic</strong>ation <strong>of</strong> acceptance <strong>of</strong> his tender by the competentauthority. Failure to do so will result <strong>in</strong> the earnest money be<strong>in</strong>g <strong>for</strong>feited toGovernment and tender be<strong>in</strong>g cancelled.2.11 The submission <strong>of</strong> a tender by a contractor implies that he has read the notice andconditions <strong>of</strong> tender and contract and has made himself aware <strong>of</strong> the scope andspecifications <strong>of</strong> the work to be done and has seen the quarries with their approaches,sites <strong>of</strong> works etc. and satisfied himself regard<strong>in</strong>g the suitability <strong>of</strong> the materials at thequarries. The responsibility <strong>of</strong> open<strong>in</strong>g <strong>of</strong> new quarries and construction andma<strong>in</strong>tenance <strong>of</strong> approaches thereto shall lie wholly with the contractor2.12. The contractor shall not, without the prior approval <strong>of</strong> the competent authority <strong>in</strong>writ<strong>in</strong>g, sublet or assign to any other party or parties the whole or any portion <strong>of</strong> thework under the contract. Even where such approval is granted the contractor shall notbe relieved <strong>of</strong> any obligation, duty or responsibility which he under takes under thecontract.2.13. All the conditions <strong>of</strong> the tender notice will be b<strong>in</strong>d<strong>in</strong>g on the contractor and will<strong>for</strong>m a part <strong>of</strong> the agreement to be executed by the contractor <strong>in</strong> addition to theconditions <strong>of</strong> contract <strong>in</strong> the prescribed <strong>for</strong>ms and special conditions <strong>of</strong> contract.2.14. Conditional tenders are liable to the rejected.2.15. The tender will be opened at the time and place stated <strong>in</strong> para. 2.1 by the………………………… <strong>in</strong> the presence <strong>of</strong> the tenderers or their duly authorizedagents who may choose to attend. The ………………………….. (as <strong>in</strong> para. 2.1)under unavoidable circumstances may depute another <strong>of</strong>ficer <strong>in</strong> his absence toreceive and open tenders on his behalf.2.16. The ………………………… does not b<strong>in</strong>d himself to accept or to recommend <strong>for</strong>the acceptance <strong>of</strong> the tender to higher authority the lowest or any tender.2.17.1 All dues regard<strong>in</strong>g taxes <strong>in</strong>clud<strong>in</strong>g the commercial tax, Octroi duties, etc. levied onthe contractor’s work by Government and Local bodies or private <strong>in</strong>dividuals willbe payable by the contractor. The Works Department will grant a certificate <strong>for</strong> thequantities actually used on the work but will not enterta<strong>in</strong> any claim on this account.2.17.2. The royalty charges <strong>for</strong> extract<strong>in</strong>g m<strong>in</strong>or m<strong>in</strong>erals <strong>for</strong> Government work will be paidby the contractor to the Collector or local body as per rules.2.17.3. Income Tax at the rate <strong>of</strong> …… from any sum payable to the contractor shall at thetime <strong>of</strong> credit <strong>of</strong> such sum or at the time <strong>of</strong> payment to the contractor by cash, cheque

II ]158[ Appendix <strong>2.10</strong> Aor Draft or any other mode shall be deducted at the source from his runn<strong>in</strong>g, f<strong>in</strong>al orany type <strong>of</strong> payment <strong>for</strong> this contract as per section 194 <strong>of</strong> Income – tax Act, 1961.2.17.4. It is open to the contractor or the Sub-Contractor as the case may be to make anapplication to the Income Tax Officer concerned and obta<strong>in</strong> from him a Certificateauthoriz<strong>in</strong>g the payer to deduct tax at such lower rate or deduct no tax as may beappropriate to his case. Such certificate will be valid <strong>for</strong> the period specified there<strong>in</strong>unless it is cancelled by the Income Tax Officer earlier.Model Rules <strong>for</strong> Water Supply, Sanitation <strong>in</strong> Labour Camps2.18. The contractor will be bound to follow the Madhya Pradesh Model Rules relat<strong>in</strong>g tolay out <strong>of</strong> water supply and sanitation <strong>in</strong> labour camps ( vide Annexure A).Fair Wages to Labourers2.19 The contractor shall pay not less than fair wages to labourers engaged by him on thework ( copy <strong>of</strong> rules enclosed vide Annexure B.)Right to Take up Work Departmentally or to Award on Contract2.20. The Eng<strong>in</strong>eer-<strong>in</strong>-charge reserves the right to take up departmental work or to awardworks on contract <strong>in</strong> the vic<strong>in</strong>ity without prejudice to the terms <strong>of</strong> contract.Issue <strong>of</strong> Materials by the Department2.21.1. In case <strong>of</strong> departmental supply <strong>of</strong> steel, all waste pieces will be returned by thecontractor to the department. If the waste pieces exceed 3 percent that excess will becharged to the contractor at departmental issue rate plus usual departmental charges.The waste pieces <strong>of</strong> only reasonable size and quality will be accepted. Decision <strong>of</strong> theEng<strong>in</strong>eer-<strong>in</strong>-Charge about the reasonableness will be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g on thecontractor.Delay <strong>in</strong> Supply <strong>of</strong> Departmental Materials2.22.3. If the materials are not supplied <strong>in</strong> time, the contractor will not be allowed any claim<strong>for</strong> any loss which may be caused to him, but only extension <strong>of</strong> time will be given atthe discretion <strong>of</strong> the competent authority if applied <strong>for</strong> by the contractor be<strong>for</strong>e theexpiry <strong>of</strong> the contract.Lead and Lift <strong>for</strong> Water2.23 No lead and lift <strong>for</strong> cart<strong>in</strong>g <strong>of</strong> water will be paid.2.24. Application <strong>for</strong> percentage <strong>Tender</strong>s Form–A only.- Cart<strong>in</strong>g <strong>of</strong> materials will beallowed as per actual lead limited to the lead provided <strong>in</strong> the enclosed statement videAnnexure C. The Super<strong>in</strong>tend<strong>in</strong>g Eng<strong>in</strong>eer shall have power to change the quarriesand allow longer leads provided the extra cost <strong>for</strong> each k<strong>in</strong>d <strong>of</strong> materials does notexceed 20 per cent <strong>of</strong> the cost <strong>of</strong> lead.2.25. Applicable <strong>for</strong> item rate tenders – Form B only.- Materials to be used on workspecified <strong>in</strong> the contract will be only from the quarries specified <strong>in</strong> Annexure C. If thechanges <strong>of</strong> quarries, from those mentioned <strong>in</strong> Annexure C, are necessitated due to anyreason dur<strong>in</strong>g the execution <strong>of</strong> work, such changes will be made only with theapproval <strong>of</strong> the Super<strong>in</strong>tend<strong>in</strong>g Eng<strong>in</strong>eer given <strong>in</strong> writ<strong>in</strong>g. Any alterations <strong>of</strong> itemsaffected by change <strong>of</strong> such quarries will be governed by the clauses 4.3.13.1, 4.3.13.2& 4.3.13.3 <strong>of</strong> the Agreement <strong>in</strong> <strong>for</strong>m B.2.26. If <strong>in</strong> a quarry, material <strong>of</strong> more than one quality is found the material <strong>of</strong> the bestquality as approved by the Executive Eng<strong>in</strong>eer shall be used by the contractor.2.27. II ]160[ Appendix <strong>2.10</strong> AList <strong>of</strong> Works <strong>in</strong> Hand2.30. <strong>Tender</strong>s must be accompanied by a list <strong>of</strong> contracts already held by the tenderer at thetime <strong>of</strong> submitt<strong>in</strong>g the tenders <strong>in</strong> Chhattisgarh Water Resources Department andelsewhere as per Annexure – K.Removal <strong>of</strong> Unsuitable or Undesirable Employees <strong>of</strong> Contractor2.31. The contractor shall on receipt <strong>of</strong> the requisition from the Executive Eng<strong>in</strong>eer at onceremove any person employed by him on the work who <strong>in</strong> the op<strong>in</strong>ion <strong>of</strong> ExecutiveEng<strong>in</strong>eer is unsuitable or undesirable.Recovery <strong>of</strong> Amount due to Government from Contractor2.32. Any amount due to Government from the contractor on any account concern<strong>in</strong>g workmay be recovered from him as arrear <strong>of</strong> land revenue.Transport <strong>of</strong> Materials is Contractor’s Responsibility2.33. The contractor shall make his own arrangement <strong>for</strong> transport <strong>of</strong> all materials. TheGovernment is not bound to arrange <strong>for</strong> priorities <strong>for</strong> gett<strong>in</strong>g wagon or any othermaterials though all possible assistance by way <strong>of</strong> recommendation will be given, if itis found necessary <strong>in</strong> the op<strong>in</strong>ion <strong>of</strong> the Eng<strong>in</strong>eer-<strong>in</strong>-Charge. If it proves <strong>in</strong>effective,the contractor shall have no claim <strong>for</strong> any compensation on this account.Arrangements <strong>of</strong> Tools and Plants2.34.1. The contractor shall arrange at his own cost tools and plant required <strong>for</strong> properexecution <strong>of</strong> work. It should be carefully noted that the plant and mach<strong>in</strong>ery as listed(Annexure-E) may be supplied by the Government under the orders <strong>of</strong> Super<strong>in</strong>tend<strong>in</strong>gEng<strong>in</strong>eer/Eng<strong>in</strong>eer-<strong>in</strong>-Charge <strong>of</strong> the work, if available and considered necessary <strong>in</strong> the<strong>in</strong>terest <strong>of</strong> work on the conditions, terms and rates as specified <strong>in</strong> the annexure-E. Thecontractor will have to execute the agreement <strong>for</strong> hir<strong>in</strong>g the mach<strong>in</strong>e, if required to doso by the Eng<strong>in</strong>eer-<strong>in</strong>-Charge <strong>in</strong> the prescribed <strong>for</strong>m, Appended here<strong>in</strong>, videAnnexure F.2.34.2. Items, if any, other than those referred <strong>in</strong> Annexure E will also be supplied by theGovernment if available on conditions and payments as may be fixed by thedepartment at the time <strong>of</strong> loan<strong>in</strong>g the plant.Increase or Decrease <strong>of</strong> Items <strong>of</strong> Work2.35. The competent authority reserves the right to <strong>in</strong>crease or decrease any item <strong>of</strong> thework dur<strong>in</strong>g the currency <strong>of</strong> the contract and contractor will be bound to comply with

Canvass<strong>in</strong>g or support <strong>in</strong> any <strong>for</strong>m <strong>for</strong> the acceptance <strong>of</strong> any tender is strictlyprohibited. It will be the responsibility <strong>of</strong> the contractor to see that the build<strong>in</strong>g does not leakdur<strong>in</strong>g the period <strong>of</strong> first ra<strong>in</strong>y season <strong>of</strong> tiled and sheet ro<strong>of</strong> and two consecutivera<strong>in</strong>y seasons <strong>in</strong> respect <strong>of</strong> terraced ro<strong>of</strong> after its completion and he will make goodand replace all the defective work on this account.List <strong>of</strong> Persons Employed by Contractor2.39. The contractor shall not be permitted to tender <strong>for</strong> works <strong>in</strong> the……………………………. Division/Circle (responsible <strong>for</strong> award and execution <strong>of</strong>contracts) <strong>in</strong> which his near relative is posted as Divisional Accountant or as an<strong>of</strong>ficer <strong>in</strong> any capacity between the grades <strong>of</strong> Super<strong>in</strong>tend<strong>in</strong>g Eng<strong>in</strong>eer and AssistantEng<strong>in</strong>eer (both <strong>in</strong>clusive). Nocompensation will be payable to the contractor <strong>for</strong> any loss <strong>in</strong>curred by him due tothese reasons.2.44. Each tenderer shall supply the name, residence and place <strong>of</strong> bus<strong>in</strong>ess <strong>of</strong> the person orpersons giv<strong>in</strong>g the tender and shall be signed by the tenderer with his usual signature.When tender is given by partnerships the full names <strong>of</strong> all partners shall be furnished.An attested copy <strong>of</strong> the constitution <strong>of</strong> the firm and the registered number <strong>of</strong> the firm,shall be furnished. In such a case the tender must be signed separately by each partnerthere<strong>of</strong> or <strong>in</strong> the event <strong>of</strong> the absence <strong>of</strong> any partner it must be signed on his behalf bya person hold<strong>in</strong>g a power <strong>of</strong> attorney authoris<strong>in</strong>g him to do so. <strong>Tender</strong>s by acorporation shall be signed with legal name <strong>of</strong> the corporation followed by the name<strong>of</strong> the state <strong>of</strong> <strong>in</strong>--corporation and by signature and by designation <strong>of</strong> the president,secretary or other persons authorised to b<strong>in</strong>d it <strong>in</strong> the matter.

The tender shall be submitted with the declaration that the contractor has successfullycarried out large works <strong>of</strong> this nature and has adequate organisation, mach<strong>in</strong>ery andexperienced personnel to handle jobs <strong>of</strong> this type and magnitude.2.45.2. A brief description <strong>of</strong> large works previously executed by tenderer.- After thetender has been opened, any tenderer may be required to submit detailed particulars<strong>of</strong> such works along with the manner <strong>of</strong> their execution and other <strong>in</strong><strong>for</strong>mation thatwill satisfy the <strong>of</strong>ficer receiv<strong>in</strong>g the tender that the contractor has adequateorganisation, <strong>in</strong>clud<strong>in</strong>g experienced personnel to execute vigorously the work to becarried out as per these specification.2.45.3. (a) The contractor shall employ the follow<strong>in</strong>g tech<strong>nic</strong>al staff dur<strong>in</strong>g the execution <strong>of</strong>works:-1. One Graduate Eng<strong>in</strong>eer, when cost <strong>of</strong> the work to be executed is more than Rs. 1crore.2. One Diploma-holder Sub-Eng<strong>in</strong>eer, when the cost <strong>of</strong> the work to be executed isRs. 10 Lakh and more but not more than Rs. 1.00 Crore.(b) The tech<strong>nic</strong>al staff should be available at site whenever required by theEng<strong>in</strong>eer-<strong>in</strong>-Charge to take <strong>in</strong>structions.(c)(d)(e)In case the contractor fails to employ the tech<strong>nic</strong>al staff as a<strong>for</strong>esaid,Government shall have the right to take suitable remedial measures.The contractor should give names and other details <strong>of</strong> the Graduate Eng<strong>in</strong>eer,diploma holder Sub-Eng<strong>in</strong>eer whom he <strong>in</strong>tends to employ or if underemployment, on the work at the time he commences the work.The contractor should give a certificate to the effect that Eng<strong>in</strong>eer, DiplomaholderSub-Eng<strong>in</strong>eer is exclusively <strong>in</strong> his employment:Provided that,-(1) An eng<strong>in</strong>eer or sub-Eng<strong>in</strong>eer may look after more than one work <strong>in</strong> the samelocality but the total value <strong>of</strong> works under him should not exceed Rs. Rs.5.00 crore<strong>in</strong> case <strong>of</strong> an eng<strong>in</strong>eer and 1.00 crore <strong>in</strong> the case <strong>of</strong> a Sub-Eng<strong>in</strong>eer.(2) It is not necessary <strong>for</strong> a contractor (or partner) <strong>in</strong> case <strong>of</strong> firm/ company who ishimself an Eng<strong>in</strong>eer/Sub-Eng<strong>in</strong>eer to employ another Eng<strong>in</strong>eer/Sub-Eng<strong>in</strong>eer <strong>for</strong> thesupervision <strong>of</strong> the work so long as the contractor /partner does work similar to whatcould have been done by an employed Eng<strong>in</strong>eer/Sub-Eng<strong>in</strong>eer.(3) A retired Eng<strong>in</strong>eer/ Assistant Eng<strong>in</strong>eer who is hold<strong>in</strong>g diploma may be treated at parwith the graduate eng<strong>in</strong>eer <strong>for</strong> the operation <strong>of</strong> the above clause.

II ]166[ Appendix <strong>2.10</strong> AIn case the contractor fails to employ the tech<strong>nic</strong>al staff as a<strong>for</strong>esaid, he shallbe liable to pay to the Government a sum <strong>of</strong> Rs. 5,000 (Five thousand only) <strong>for</strong> eachmonth <strong>of</strong> default <strong>in</strong> the case <strong>of</strong> graduate eng<strong>in</strong>eer and Rs.2,500 (Two thousand fivehundred only) <strong>for</strong> each month <strong>of</strong> default <strong>in</strong> the case <strong>of</strong> Diploma-holder Sub-Eng<strong>in</strong>eer.2.46. The contractor should also give the follow<strong>in</strong>g <strong>in</strong><strong>for</strong>mation <strong>in</strong>variably on coverconta<strong>in</strong><strong>in</strong>g the tender:-(a) Name and address <strong>of</strong> the contractor.(b) Class <strong>in</strong> which he is registered.(c) Amount <strong>of</strong> earnest money deposited and No. and date <strong>of</strong> money receipt etc.2.47 <strong>Tender</strong> documents have to be completed and submitted with all the documentrequired <strong>in</strong> the tender notice. Follow<strong>in</strong>g is the summary <strong>of</strong> the documents required tobe submitted with the completed tender <strong>for</strong>m.(i) The name, residence and place <strong>of</strong> bus<strong>in</strong>ess etc. <strong>of</strong> the tenderer vide clause 2.43above.(ii) Details <strong>of</strong> contracts already held by the tenderer vide clause 2.29 above.(iii) Receipt <strong>of</strong> earnest money deposited vide clause 2.5.1. above or surety bond<strong>for</strong>m bank.(iv) Income –tax clearance Certificate vide clause 2.27 above.(v) A list <strong>of</strong> near relatives <strong>of</strong> the tenderer work<strong>in</strong>g <strong>in</strong>Chhattisgarh……….department vide clause 2.38 above see annexure J(vi) Attested copy <strong>of</strong> the constitution <strong>of</strong> firm (if required) and power <strong>of</strong> attorney, asrequired vide clause 2.43.(vii) A declaration that there has been no conviction / imprisonment <strong>for</strong> an <strong>of</strong>fence<strong>in</strong>volv<strong>in</strong>g moral turpitude.(viii) Declaration and description as required vide clause 2.44.1 and 2.44.22.48. The contractor shall obta<strong>in</strong> a valid license under the contract (regulation andAbolition). Act <strong>in</strong> <strong>for</strong>ce and rules made there under by competent authority <strong>for</strong>m timeto time be<strong>for</strong>e commencement <strong>of</strong> work and cont<strong>in</strong>ue to have a valid license until thecompletion <strong>of</strong> the work.PART IIISPECIAL CONDITIONS3.1. General.- The special conditions are supplementary <strong>in</strong>structions to the tenders andwould from part <strong>of</strong> the contract.3.2. Draw<strong>in</strong>gs given, listed and <strong>in</strong>dexed <strong>in</strong> part ……….. will <strong>for</strong>m part <strong>of</strong> the contract.The above draw<strong>in</strong>gs show the work to be done as def<strong>in</strong>itely and <strong>in</strong> such details as ispossible, at the present stage <strong>of</strong> development <strong>of</strong> <strong>in</strong>vestigation and the design. Theattached draw<strong>in</strong>gs will be supplemented or superseded by such additional and detailed

Such additionalgeneral and detailed draw<strong>in</strong>gs will show dimensions and details necessary <strong>for</strong>construction purposes more completely than are shown on the attached draw<strong>in</strong>gs, <strong>for</strong>all features <strong>of</strong> the work. The contractor shall be required to per<strong>for</strong>m the work on thesefeatures and <strong>in</strong> accordance with additional general and detailed draw<strong>in</strong>gs mentionedabove at the applicable unit prices tendered <strong>in</strong> the schedule <strong>for</strong> work or work <strong>of</strong>similar nature as determ<strong>in</strong>ed by the Eng<strong>in</strong>eer-<strong>in</strong>-Charge. The contractor shall check alldraw<strong>in</strong>gs carefully and advise the Eng<strong>in</strong>eer-<strong>in</strong>-Charge <strong>of</strong> any errors or omissionsdiscovered. The contractor shall not take advantage <strong>of</strong> errors or omissions as full<strong>in</strong>structions will be furnished to the contractor, should any errors or omissions bediscovered.The draw<strong>in</strong>gs and specifications are to be considered as complementary toeach other and should any th<strong>in</strong>g appear <strong>in</strong> one that is not described <strong>in</strong> the other noadvantage shall be taken <strong>of</strong> such omission. In case <strong>of</strong> disagreement betweenspecifications and draw<strong>in</strong>gs the conditions <strong>of</strong> the specifications shall govern thecontract. Should any discrepancies, however appear or should any misunderstand<strong>in</strong>garise as to the mean<strong>in</strong>g and <strong>in</strong>terpretations <strong>of</strong> the said specifications or draw<strong>in</strong>gs or asto the dimension or the quality <strong>of</strong> the materials <strong>for</strong> the proper execution <strong>of</strong> the work oras to the measurements or quality and valuation <strong>of</strong> work executed under this contractor extra thereupon, the same shall be expla<strong>in</strong>ed by the Eng<strong>in</strong>eer-<strong>in</strong>-Charge.Figures <strong>in</strong> dimensioned draw<strong>in</strong>gs shall supersede measurements by scale anddraw<strong>in</strong>gs to a large scale shall take precedence over those on a small scale. Specialdirections <strong>in</strong>corporated on the draw<strong>in</strong>gs shall be complied with strictly.Once copy <strong>of</strong> the draw<strong>in</strong>gs and contract documents shall be kept at all times atthe site <strong>of</strong> the works by the contractor.3.3. Data to be furnished by the contractor.- The contractor shall submit the follow<strong>in</strong>g<strong>in</strong><strong>for</strong>mation to the Eng<strong>in</strong>eer-<strong>in</strong>-Charge;(a) Proposed construction programme and time schedule show<strong>in</strong>g sequence <strong>of</strong>operations with<strong>in</strong> two weeks <strong>of</strong> receipts <strong>of</strong> notice to proceed with the work <strong>in</strong>pursuance <strong>of</strong> the conditions <strong>of</strong> contract. Along with the above he will also submitprogramme <strong>of</strong> br<strong>in</strong>g<strong>in</strong>g requisite tools and plant, mach<strong>in</strong>ery to be engaged by himto the site <strong>of</strong> work.(b) Approximate monthly requirement <strong>of</strong> cement and M.S. re<strong>in</strong><strong>for</strong>cement bars <strong>for</strong> theentire construction period with<strong>in</strong> 4 weeks <strong>of</strong> date <strong>of</strong> the receipt <strong>of</strong> notice toproceed with the work <strong>in</strong> pursuance <strong>of</strong> condition <strong>of</strong> contract.3.4. Programme <strong>for</strong> construction:- The department will <strong>in</strong>itially prepare a constructionprogramme <strong>in</strong>lcud<strong>in</strong>g requirements <strong>of</strong> materials and <strong>in</strong>clude it is as a part <strong>of</strong> the tenderdocuments. After receipt <strong>of</strong> the work order, the contractor if desires to submit hisrevised construction programme shall do so with<strong>in</strong> a period <strong>of</strong> 30 days from the date<strong>of</strong> the issue <strong>of</strong> work order and will got it approved <strong>for</strong>m the department. In case he

II ]168[ Appendix <strong>2.10</strong> Afails to submit such programme, then the construction programme appended with thetender shall be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g on the contractor. This programme my be reviewedand revised every year at the beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong> the work<strong>in</strong>g season.3.5. Action when the Progress <strong>of</strong> any crucial Item <strong>of</strong> work is unsatisfactory.- If theprogress <strong>of</strong> a crucial item <strong>of</strong> work, which is important <strong>for</strong> timely completion <strong>of</strong> work,is unsatisfactory, the Eng<strong>in</strong>eer <strong>in</strong> charge shall, notwithstand<strong>in</strong>g that the generalprogress <strong>of</strong> work is satisfactory, <strong>in</strong> accordance with clause 4.3.2 be entitled to takeaction under clause 4.3.3 after giv<strong>in</strong>g the contractor 10 days notice <strong>in</strong> writ<strong>in</strong>g and thecontractor will have no claim <strong>for</strong> compensation <strong>for</strong> any loss susta<strong>in</strong>ed by him ow<strong>in</strong>gto such action3.6. Inspection and Tests. - Except as otherwise provided <strong>in</strong> here<strong>of</strong> material andworkmanship, if not otherwise designated by the specification, shall be subject to<strong>in</strong>spection, exam<strong>in</strong>ation and test by the Eng<strong>in</strong>eer-<strong>in</strong>-Charge at any and all timesdur<strong>in</strong>g manufacture or constructions are carried on. The Eng<strong>in</strong>eer-<strong>in</strong>-charge shall havethe right to reject the defective material and workmanship or require its correction.Rejected workmanship shall be satisfactorily replaced with proper material withoutcharge there<strong>of</strong> and the contractor shall properly segregate and remove rejectedmaterial from the premises. If the contractor fails to proceed at once with thereplacement <strong>of</strong> the rejected material and/ or the construction <strong>of</strong> defectiveworkmanship the Eng<strong>in</strong>eer-<strong>in</strong>-Charge may replace such material and/ or correct suchworkmanship and charge the cost there<strong>of</strong> to the contractor.The contractor shall be liable <strong>for</strong> replacement <strong>of</strong> defective work up to the time<strong>in</strong> accordance with clause 4.3.16 <strong>of</strong> the conditions <strong>of</strong> contract <strong>of</strong> all work to be doneunder the contract.The contractor shall furnish promptly without additional charge all facilities,labour and material necessary <strong>for</strong> the safe and convenient <strong>in</strong>spection and tests thatmay be required by the Eng<strong>in</strong>eer-<strong>in</strong>-Charge. All <strong>in</strong>spections and tests by thedepartment shall be per<strong>for</strong>med <strong>in</strong> such a manner as not to unnecessarily delay thework. Special full size and per<strong>for</strong>mance test shall be charged with any additional cost<strong>of</strong> <strong>in</strong>spection when materials and workmanship are not ready by the contractor at thetime <strong>of</strong> <strong>in</strong>spection .3.7. Removal <strong>of</strong> temporary work, plant and Surplus material.- Prior to f<strong>in</strong>alacceptance <strong>of</strong> the completed work but except<strong>in</strong>g as otherwise expressly directed orpermitted <strong>in</strong> writ<strong>in</strong>g, the contractor shall, at his own expenses remove from the siteand dispose <strong>of</strong> all the temporary structures <strong>in</strong>clud<strong>in</strong>g build<strong>in</strong>gs, pile work, crib work,all plant and surplus material, and all rubbish and debris <strong>for</strong> which he is responsibleto the satisfaction <strong>of</strong> Eng<strong>in</strong>eer-<strong>in</strong>-Charge.3.8. Possession Prior to Completion. – The Eng<strong>in</strong>eer-<strong>in</strong> Charge shall have the right totake possession <strong>of</strong> or use any completed part <strong>of</strong> the work. Such possession or use shall

Damage to works.- The works whether fully completed or <strong>in</strong>complete, all thematerials, mach<strong>in</strong>ery, plants, tools, temporary build<strong>in</strong>g and other th<strong>in</strong>gs connectedthere with shall rema<strong>in</strong> at the risk and <strong>in</strong> the sole charge <strong>of</strong> the contractor until thecompleted work has been delivered to the Eng<strong>in</strong>eer-<strong>in</strong>-Charge and till completioncertificate has been obta<strong>in</strong>ed <strong>for</strong>m the Eng<strong>in</strong>eer-<strong>in</strong>-Charge . Until such delivery <strong>of</strong> thecompleted work the contractor shall at his own cost take all precautions reasonably tokeep all the a<strong>for</strong>esaid works, materials, mach<strong>in</strong>ery, plants, temporary build<strong>in</strong>gs andother th<strong>in</strong>gs connected there with free from any loss damages and <strong>in</strong> the event <strong>of</strong> thesame or any part there<strong>of</strong> be<strong>in</strong>g lost or damaged, he shall <strong>for</strong>thwith re<strong>in</strong>state and makegood such loss or damage at his own cost.3.10. Departmental Supply <strong>of</strong> Material.- Departmental supply <strong>of</strong> materials will beord<strong>in</strong>arily conf<strong>in</strong>ed only to those, specifically mentioned <strong>in</strong> the tender notice attachedand the cost <strong>of</strong> such material issued will be recovered <strong>for</strong>m the contractor’s bill at therates specified <strong>in</strong> said schedule.The materials will be issued <strong>for</strong>m the departmental stores and the contractorwill have to make his arrangements <strong>for</strong> the transport <strong>of</strong> the materials from the sitestores or wagons to the works at his own cost. Materials to be supplied by thedepartment will be supplied <strong>in</strong> standard lengths and quantities or as available, unlessspecifically mentioned otherwise and cost recovered <strong>for</strong>m the contractor <strong>for</strong> thequantities issued.The contractor shall further at all times satisfy the Eng<strong>in</strong>eer-<strong>in</strong>-Charge ondemand, if any, by the production <strong>of</strong> records or books or submission <strong>of</strong> return and<strong>for</strong>mats as directed that the materials supplied are be<strong>in</strong>g used <strong>for</strong> the purpose <strong>for</strong>which they are supplied and the contractor shall at all times keep the records up todate to enable the Eng<strong>in</strong>eer-<strong>in</strong>-Charge to apply such checks he may desire to impose.The contractor shall not without the written permission <strong>of</strong> the Eng<strong>in</strong>eer-<strong>in</strong>-Chargeutilise or dispose <strong>of</strong> the materials <strong>for</strong> any purpose other than that <strong>in</strong>tended <strong>in</strong> thecontract.Cement will be supplied to the contractor at the rates specified <strong>in</strong> the tendernotice at the departmental stores. The contractor shall make his own arrangements <strong>for</strong>the storage <strong>of</strong> cement at the work site. Handl<strong>in</strong>g and storage facilities shall be soarranged that no cement will be kept <strong>in</strong> storage <strong>for</strong> more than 120 days. If any cementis kept as long as 120 days it will be tested be<strong>for</strong>e use and if found defective <strong>in</strong> anyway it shall be condemned <strong>for</strong>m use. Steel as required <strong>in</strong> the construction, shall besupplied by the department and shall be transported to the site at contractor’s owncost. The contractor shall make his own arrangements <strong>for</strong> keep<strong>in</strong>g steel at the site. Thecost <strong>of</strong> the materials supplied to the contractor shall be treated as an advance paymentto the contractor and shall be recoverable <strong>for</strong>m him.

II ]170[ Appendix <strong>2.10</strong> AThe contractor will be responsible <strong>for</strong> the safe custody <strong>of</strong> all departmentalmaterials issued to the satisfaction <strong>of</strong> the Eng<strong>in</strong>eer-<strong>in</strong>-charges and will be required torender proper account to the allocation and disposal <strong>of</strong> these materials show<strong>in</strong>g wherethey were issued on works. The contractor shall return <strong>in</strong> sound condition all suchmaterials which are not used on the works. In case he is unable to account <strong>for</strong> fullamount <strong>of</strong> the materials issued to him recoveries will be affected <strong>for</strong>m him at “IssueRates” or “Market Value” which ever is higher plus 16 per cent to cover thedepartmental supervision charges.The department will not be responsible <strong>for</strong> any delays <strong>in</strong> supply <strong>of</strong> controlledmaterials such as steel sections, M.S. Re<strong>in</strong><strong>for</strong>cement bars and cement. While it willendeavour to see that no delay occurs <strong>in</strong> this account the delay due to late supply willhowever be given due consideration <strong>in</strong> grant<strong>in</strong>g extension <strong>of</strong> time <strong>for</strong> the completion<strong>of</strong> the work if found necessary. No compensation <strong>of</strong> claim <strong>for</strong> damages on idle timewill be enterta<strong>in</strong> able on this score.If the contractor requests the Eng<strong>in</strong>eer-<strong>in</strong>-charge <strong>for</strong> issue <strong>of</strong> such materials asis available <strong>in</strong> the stores <strong>of</strong> the Eng<strong>in</strong>eer-<strong>in</strong>-Charge the materials may be supplied tothe contractor from the stores <strong>for</strong> execution <strong>of</strong> this work. If the Eng<strong>in</strong>eer-<strong>in</strong>-Chargeconsiders it expedient, the contractor shall pay <strong>for</strong> such material and store issued tohim at the rates fixed by Eng<strong>in</strong>eer-<strong>in</strong>-Charge. Other materials which may be available<strong>in</strong> the stores may be issued on loan if the Eng<strong>in</strong>eer-<strong>in</strong>-Charge considers it necessary <strong>in</strong>the <strong>in</strong>terest <strong>of</strong> work, but <strong>for</strong> such material hire charges should be recovered monthlyas per rules and the contractor shall be responsible to return the material <strong>in</strong> orig<strong>in</strong>alcondition <strong>in</strong> which they were issued.All the materials required <strong>for</strong> the work, other than those that are specificallymentioned <strong>in</strong> the said tender notice, shall be supplied by the contractor.Recommendations to authorities, where required, may be made by the department butthe responsibility <strong>for</strong> the supply <strong>of</strong> the materials shall be that <strong>of</strong> the contractor and noexcuse on this account <strong>for</strong> delay <strong>in</strong> the work shall be accepted.All unused materials, either supplied directly by the Department or obta<strong>in</strong>edby the recommendations <strong>of</strong> the department, which <strong>in</strong> the op<strong>in</strong>ion <strong>of</strong> the Eng<strong>in</strong>eer-<strong>in</strong>-Charge are likely to be useful to the department shall be returned <strong>in</strong> good condition atthe orig<strong>in</strong>al cost paid <strong>for</strong> if so decided by the department.3.11. * The quoted rates <strong>of</strong> the contractor shall be <strong>in</strong>clusive <strong>of</strong> the leads and lifts and <strong>in</strong> nocase separate payment <strong>for</strong> leads or lifts <strong>of</strong> any materials <strong>in</strong>clud<strong>in</strong>g water shall bepayable. Similarly no leads or lifts <strong>for</strong> the materials issued by the department asprescribed <strong>in</strong> the tender documents shall be payable. The contractor shall br<strong>in</strong>gapproved quality <strong>of</strong> materials. Different quarries are shown <strong>in</strong> Annexure C. Thedetails shown <strong>in</strong> the Annexure C are only as a guide to the contractor but thecontractor be<strong>for</strong>e tender<strong>in</strong>g should satisfy himself regard<strong>in</strong>g the quality and quantityavailable and all other details <strong>of</strong> Annexure C and provide <strong>for</strong> any variation <strong>in</strong> respect<strong>of</strong> leads, lifts, place and methods <strong>of</strong> quarry<strong>in</strong>g, type <strong>of</strong> rocks to be quarried and all

II ]171[ Appendix <strong>2.10</strong> Asuch other aspects and should there<strong>for</strong>e provide <strong>for</strong> any variation by him/his tenderedrate, as later on no claim whatsoever shall be enterta<strong>in</strong>ed except where any quarry ischanged <strong>for</strong> circumstances beyond the control <strong>of</strong> contractor under the written orders<strong>of</strong> Super<strong>in</strong>tend<strong>in</strong>g Eng<strong>in</strong>eer-<strong>in</strong>-Charge <strong>of</strong> work.* Cart<strong>in</strong>g <strong>of</strong> materials will be allowed as per actual lead limited to the lead provided<strong>in</strong> the Statement vide Annexure C. The Eng<strong>in</strong>eer-<strong>in</strong>-Charge shall have the power tochange the quarries and allow longer leads provided the extra cost <strong>for</strong> each k<strong>in</strong>d <strong>of</strong>material does not exceed 20% <strong>of</strong> the cost <strong>of</strong> lead vide clause 2.25.3.12. Exam<strong>in</strong>ation and Tests on completions.- On the completion <strong>of</strong> the work and notlater than three months thereafter, the Eng<strong>in</strong>eer-<strong>in</strong>-Charge shall make suchexam<strong>in</strong>ation and tests <strong>of</strong> the work as may then seem to him be possible, necessary ordesirable, and the contractor shall furnish free <strong>of</strong> cost any materials and labour whichmay be necessary there<strong>for</strong>, and shall facilitate <strong>in</strong> every way all operations required bythe Eng<strong>in</strong>eer-<strong>in</strong>-Charge, <strong>in</strong> mak<strong>in</strong>g exam<strong>in</strong>ation and tests.3.13. Climatic Conditions.- The Executive Eng<strong>in</strong>eer, may order the contractor to suspendany work that may be subject to the damage by climatic conditions and no claim <strong>of</strong>the contractor will be enterta<strong>in</strong>ed by the department on this account.*The para. “ Cart<strong>in</strong>g <strong>of</strong> materials ……………. clause 2.25” is applicable to percentage ratetenders only.3.14. Safety Regulations.- While carry<strong>in</strong>g out this work, the contractor will ensurecompliance <strong>of</strong> all safety regulations as provided <strong>in</strong> the Safety Code (Annexure ‘H’).3.15. Haulroads.- A fair weather road <strong>of</strong> the standard <strong>of</strong> a village cart truck is ord<strong>in</strong>arilyma<strong>in</strong>ta<strong>in</strong>ed by the department along the Canal alignment which is motor able fromNovember to end <strong>of</strong> May, but contractor shall not have any claim on this account ifone is not provided or ma<strong>in</strong>ta<strong>in</strong>ed. Necessary haulroads to work spot, borrow areasand water sources shall be satisfactorily constructed and ma<strong>in</strong>ta<strong>in</strong>ed by the contractorat his own cost. The contractor has to construct and ma<strong>in</strong>ta<strong>in</strong> his own approach roadsfrom the ma<strong>in</strong> haul roads provided by the department. Any new haul roads will havealso to be constructed and ma<strong>in</strong>ta<strong>in</strong>ed by the contractor at his cost.3.16. The contractor will make his own arrangement <strong>for</strong> supply <strong>of</strong> water, light and power<strong>for</strong> his works and labour camps etc. The department will only supply bulk electricityif needed by the contractor <strong>for</strong> light<strong>in</strong>g and power requirements <strong>of</strong> the contractor atthe trans<strong>for</strong>mer po<strong>in</strong>t as may be provided by the department at rates fixed by thedepartment, vide Annexure F. The contractor will have to make his own arrangement<strong>for</strong> further extension and connection <strong>of</strong> supply po<strong>in</strong>t to the work site and labour campsetc. and all other places at his own cost. The department will not enterta<strong>in</strong> any claimwhatsoever <strong>for</strong> any failure or break down etc. <strong>in</strong> supply <strong>of</strong> electricity to the contractor.The contractor will supply and fix his own tested meter <strong>of</strong> the approved make but themeter will be kept <strong>in</strong> the custody <strong>of</strong> the department.


Chap. II ]172[ Appendix <strong>2.10</strong> A3.17. The contractor must not <strong>in</strong>terfere with other contactors who may be employedsimultaneously or otherwise to/by the department. He will at no time engagedepartmental labour or that <strong>of</strong> other contractors without the written permission <strong>of</strong> theEng<strong>in</strong>eer-<strong>in</strong>-Charge.3.18. Regulations and Bye-laws.- The contractor shall con<strong>for</strong>m to the regulations, byelawsany other statutory rules made by any local authorities or by the Government andshall protect and <strong>in</strong>demnify Government aga<strong>in</strong>st any claim or liability aris<strong>in</strong>g from orbased on the violation <strong>of</strong> any such laws, ord<strong>in</strong>ance, regulation orders, decrees etc.3.19. Order Book.- An order book shall be kept <strong>in</strong> the departmental <strong>of</strong>fice on the site <strong>of</strong> thework. As far as possible all orders regard<strong>in</strong>g the works are to be entered <strong>in</strong> this book.All entries there<strong>in</strong> shall be signed by the departmental <strong>of</strong>ficers <strong>in</strong> direct charge <strong>of</strong> thework and the contractor or his representative <strong>in</strong> the important cases the ExecutiveEng<strong>in</strong>eer or the Super<strong>in</strong>tend<strong>in</strong>g Eng<strong>in</strong>eer will countersign the entries which have beenmade. The order book shall not be removed from the work site except with the writtenpermission <strong>of</strong> the Super<strong>in</strong>tend<strong>in</strong>g Eng<strong>in</strong>eer/Chief Eng<strong>in</strong>eer where S.E. is not postedand the contractor or his representative shall be bound to take note <strong>of</strong> all <strong>in</strong>structionsmeant <strong>for</strong> the contractor as entered <strong>in</strong> the order book without hav<strong>in</strong>g to be called orseparately to note them. The Eng<strong>in</strong>eer-<strong>in</strong>-Charge shall submit periodically copies <strong>of</strong>the remarks <strong>of</strong> the Order Book to the Super<strong>in</strong>tend<strong>in</strong>g Eng<strong>in</strong>eer and Chief Eng<strong>in</strong>eer <strong>for</strong>record and to the contractor <strong>for</strong> compliance and report.3.20. Conversion <strong>of</strong> units.- Whenever <strong>in</strong> the contract agreement dimensions and units have beenexpressed <strong>in</strong> F.P.S. system, the same will be converted <strong>in</strong>to metric system units by apply<strong>in</strong>gthe standard conversion table <strong>of</strong> Indian Standard Institution so as to derive the correspond<strong>in</strong>gfigure arithmetically and the contractor will have to accept the figures so derived without anyclaim or compensation whatsoever.3.21 Right <strong>of</strong> other contractor and persons:- If, dur<strong>in</strong>g progress <strong>of</strong> the work covered by thiscontract, it is necessary <strong>for</strong> other contractor or persons to do work <strong>in</strong> or about the work, thecontractor shall af<strong>for</strong>d such facilities, as the Eng<strong>in</strong>eer-<strong>in</strong>-Charge may require.3.22 Employment <strong>of</strong> Tech<strong>nic</strong>al Persons.-(a) The contractor shall employ the follow<strong>in</strong>g Tech<strong>nic</strong>al Staff dur<strong>in</strong>g the Execution <strong>of</strong> Work:-(i) One Graduate Eng<strong>in</strong>eer when the work to be executed is more than Rs. 1.00 Crore.(ii) One Diploma Holder, Eng<strong>in</strong>eer when the cost <strong>of</strong> work to be executed is <strong>for</strong>m Rs. 10Lakhs or more but not more than Rs. 1.00 Crore.(b) The Tech<strong>nic</strong>al Staff should be available at site whenever required by the Eng<strong>in</strong>eer-<strong>in</strong>-Charge to take <strong>in</strong>structions.(c) In case the contractor fails to employ the tech<strong>nic</strong>al staff as a<strong>for</strong>esaid, the E.E. shall havethe right to take suitable remedial measures.(d)The contractor should give the names and other details <strong>of</strong> the Graduate Eng<strong>in</strong>eer/DiplomaHolder, Eng<strong>in</strong>eer whom he <strong>in</strong>tends to employ or who is under employment on the work atthe time he commences work.(e) The contractor should give a certificate to the effect that the Eng<strong>in</strong>eer/Diploma Holder,Eng<strong>in</strong>eer is exclusively <strong>in</strong> his employment.

II ]173[ Appendix <strong>2.10</strong> AProvided that:-(I) An Eng<strong>in</strong>eer or Sub-Eng<strong>in</strong>eer may look after more than one work <strong>in</strong> the same locality but thetotal value <strong>of</strong> such work under him should not exceed Rs. 5.00 Crore <strong>in</strong> the case <strong>of</strong> anEng<strong>in</strong>eer and Rs. 1.00 Crore <strong>in</strong> the case <strong>of</strong> a Sub-Eng<strong>in</strong>eer.It is not necessary <strong>for</strong> the contractor’s partner <strong>in</strong> case <strong>of</strong> firm /company, who ishimself an Eng<strong>in</strong>eer. Sub Eng<strong>in</strong>eer to employ another Eng<strong>in</strong>eer, Sub-Eng<strong>in</strong>eer <strong>for</strong> thesupervision <strong>of</strong> work.The Retired Assistant Eng<strong>in</strong>eer who is hold<strong>in</strong>g a diploma may be treated at par with aGraduate <strong>for</strong> operation <strong>of</strong> the above clause.In case the contractor fails to employ the tech<strong>nic</strong>al staff as <strong>for</strong>esaid he shall be liableto pay Executive Eng<strong>in</strong>eer a sum <strong>of</strong> Rs. 5,000 (Five Thousand) only <strong>for</strong> each month <strong>of</strong> default<strong>in</strong> the case <strong>of</strong> Graduate Eng<strong>in</strong>eer and Rs. 2500 (Two Thousand Five Hundred) only <strong>for</strong> eachmonth <strong>of</strong> default <strong>in</strong> the case <strong>of</strong> Diploma Holder.3.23 Deleted.3.24 Deleted.3.25 Deleted.3.26 Use <strong>of</strong> Fly Ash / Fly Products :- Construction materials <strong>in</strong> structure viz. Build<strong>in</strong>gs,Roads, Road embankments, the fly ash / fly ash products like fly ash bricks, fly ashcement concrete, fly ash mortar, fly ash clay bricks & tiles etc. shall be usedcompulsorily by the contractor <strong>in</strong> accordance with the notification dated 05.11.2002issued by the Govt. <strong>of</strong> India, unless and otherwise it is specifically mentioned <strong>in</strong> theNIT <strong>in</strong> Canal structures like falls, VRB's also use <strong>of</strong> the fly ash cement mortar and flyash concrete shall be ensured after approval from Eng<strong>in</strong>eer-<strong>in</strong>-Charge.

II ]174[ Appendix <strong>2.10</strong> AANNEXURE-AMODEL RULES RELETING TO LABOUR, WATER SUPPLY AND SANITATIONIN LABOUR CAMPSNOTE- These modal rules are <strong>in</strong>tended primarily <strong>for</strong> labour camps which are not <strong>of</strong> apermanent nature. They lay down the m<strong>in</strong>imum desirable standard which should beadhered to, standard <strong>in</strong> permanent or semi- permanent labour camps should notobviously be lower then these <strong>for</strong> temporary camps.(1) Location- The camps should be located <strong>in</strong> elevated and well dra<strong>in</strong>ed <strong>in</strong> the locality(2) Layout – Labour huts to be constructed <strong>for</strong> one family 5 persons each. The layout tobe shown <strong>in</strong> the prescribed sketch.(3) Hutt<strong>in</strong>g- The huts to be built <strong>of</strong> local materials. Each hut should provide atleast 20 sq.meter <strong>of</strong> liv<strong>in</strong>g space.(4) Sanitary Facilities-There shall be provided latr<strong>in</strong>e and ur<strong>in</strong>als at least 16 meter awayfrom the nearest quarter separately <strong>for</strong> men and women specially so marked on thefollow<strong>in</strong>g scale.(5) Latr<strong>in</strong>es- Pit privies at the rates <strong>of</strong> 10 users or two families per seat. Separate ur<strong>in</strong>alsare not required as the privy can also be used <strong>for</strong> this purpose.(6) Dr<strong>in</strong>k<strong>in</strong>g Water- Adequate arrangements shall be made <strong>for</strong> the supply <strong>of</strong> dr<strong>in</strong>k<strong>in</strong>gwater. If practicable, filtered and chlor<strong>in</strong>ated supply shall be arranged where supply isfrom <strong>in</strong>termittent sources, a covered storage tank shall be provided with capacity <strong>for</strong>five liters per person per day.Where the supply is to be made from a well it shallconfirm to the sanitary standard laid down <strong>in</strong> the report <strong>of</strong> the Rural SanitationCommittee. The well should be at lest 30metres away from any latr<strong>in</strong>e or othersources <strong>of</strong> pollution. If possible a hand pump should be <strong>in</strong>stalled <strong>for</strong> draw<strong>in</strong>g thewater from well. The well should be effectively dis<strong>in</strong>fected once every month andquality <strong>of</strong> water should be got tested at Public Health Institution between each work<strong>of</strong> dis<strong>in</strong>fection.Wash<strong>in</strong>g and bath<strong>in</strong>g should be strictly prohibited at place where water supplyis from a river. The daily supply must be dis<strong>in</strong>fected <strong>in</strong> the storage reservoir and givenat least 3 m<strong>in</strong>utes contact with the dis<strong>in</strong>fectant be<strong>for</strong>e it is drawn <strong>for</strong> use(7) Bath<strong>in</strong>g and wash<strong>in</strong>g- Separate bath<strong>in</strong>g and wash<strong>in</strong>g place shall be provided <strong>for</strong> menand women <strong>for</strong> every 25 persons <strong>in</strong> the camp. There shall be a gap and space <strong>of</strong> 2 sq.meters <strong>for</strong> the water should be provided.

II ]175[ Appendix <strong>2.10</strong> A(8) Waste Disposal– Dust-b<strong>in</strong>s shall be provided at suitable place <strong>in</strong> camp and theresidents shall be directed throw all rubbish <strong>in</strong>to these dust-b<strong>in</strong>s. The dust-b<strong>in</strong>s shallbe provided with covers. The contents shall be removed every day and disposed <strong>of</strong>f bytrench<strong>in</strong>g.(9) Medical facilities- (a) Every camp where 1000 or more persons reside be providedwith whole time doctor and dispensary. If there are women <strong>in</strong> the camp a whole timenurse shall be employed.(b)(c)Every camp where less than 1000 but more then 250 persons reside shall be providedwith a dispensary and a part time nurse/midwife, shall also be employed.If there are less then 250 persons <strong>in</strong> any camp a standard first aid out kit shall bema<strong>in</strong>ta<strong>in</strong>ed <strong>in</strong> charge <strong>of</strong> the whole time persons, tra<strong>in</strong>ed <strong>in</strong> first aid.All the medical facilities mentioned above shall be <strong>for</strong> all residents <strong>in</strong> the camp, <strong>in</strong>clud<strong>in</strong>g thedependents <strong>of</strong> the workers, if any, free <strong>of</strong> cost.For each labour camp there should be qualified sanitary <strong>in</strong>spector and sweepers, should beprovided <strong>in</strong> the follow<strong>in</strong>g scale:-(1) For camps with strengthover 200 but notexceed<strong>in</strong>g 500 persons(2) For camps withstrength over500 personsOne sweeper <strong>for</strong> every 75 persons above thefirst 200 <strong>for</strong> which three sweepers should beprovidedOne sweeper <strong>for</strong> every 100 persons abovethe first 500 <strong>for</strong> which six sweepers shouldbe provided.

II ]182[ Appendix <strong>2.10</strong> A(iv)(v)(vi)The contractor shall dur<strong>in</strong>g the mach<strong>in</strong>es are employed by department and work<strong>in</strong>g onhis works be responsible to make good to the department any loss or damage causedto said unit <strong>of</strong> mach<strong>in</strong>ery and men work<strong>in</strong>g on the mach<strong>in</strong>e due to circumstancecaused on account <strong>of</strong> any contractor lapses, like prevent<strong>in</strong>g the <strong>of</strong>ficers to attend toregular ma<strong>in</strong>tenance and timely repairs, and his failure <strong>in</strong> respect <strong>of</strong> non-ma<strong>in</strong>tenance<strong>of</strong> haul roads, both <strong>in</strong> respect <strong>of</strong> grade and proper water<strong>in</strong>g or any other cause etc. asmay, be provided <strong>in</strong> the contract.The Eng<strong>in</strong>eer-<strong>in</strong>-Charge shall be the f<strong>in</strong>al authority to determ<strong>in</strong>e the extent <strong>of</strong>damages and amount recoverable under such conditions.A sum due from the contractor under this agreement shall be recoverable as arrears <strong>of</strong>land revenue.(a) Basic hourly rate <strong>for</strong> purpose <strong>of</strong> determ<strong>in</strong><strong>in</strong>g ultimate charges to be recovered fromthe contractor <strong>for</strong> the issue <strong>of</strong> the said unit <strong>of</strong> mach<strong>in</strong>e <strong>for</strong> the work……. shall be asgiven <strong>in</strong> Annexure “E” <strong>of</strong> this contract. Scaffold<strong>in</strong>g –(i) Suitable scaffolds should be provided <strong>for</strong> workman <strong>for</strong> allworks that cannot safely be done from the grounds or from solid constructionexcept such short period work as can be done safely from ladders. When aladder is used an extra mazdoor shall be engaged <strong>for</strong> hold<strong>in</strong>g the ladder <strong>for</strong>carry<strong>in</strong>g materials as well as suitable foot holds and hand holds shall beprovided on the ladder and the ladder shall be given an <strong>in</strong>cl<strong>in</strong>ation not steeperthan 1/4:1 (1/4 Horizontal and 1 Vertical).(ii)Scaffold<strong>in</strong>g or stag<strong>in</strong>g more than 3.50m, above the ground floor, swung orsuspended from an overhead support or erected with stationery support shallhave a guard rail properly attached, bolted, braced or otherwise secured atleast 1 metre high above the floor plat<strong>for</strong>ms <strong>of</strong> such scaffold<strong>in</strong>g or stag<strong>in</strong>g andextend<strong>in</strong>g along the entire length <strong>of</strong> the outside the ends there<strong>of</strong> with onlysuch open<strong>in</strong>g as may be necessary <strong>for</strong> the delivery <strong>of</strong> the materials. Suchscaffold<strong>in</strong>g or stag<strong>in</strong>g shall be fastened as to prevent it from sway<strong>in</strong>g from thebuild<strong>in</strong>g <strong>of</strong> structure.(iii)Work<strong>in</strong>g plat<strong>for</strong>m gangways and stairways should be so constructed that theyshould not sway unduly or unequally and if the height <strong>of</strong> the plat<strong>for</strong>m <strong>of</strong> thegangway or the stairway is more than 3.54 metre above ground level and orfloor level they should be closely boarded ,should have adequate width andshould be suitably fenced as described (ii) above.(iv)Every open<strong>in</strong>g <strong>in</strong> the floor <strong>of</strong> a build<strong>in</strong>g or <strong>in</strong> a work<strong>in</strong>g plat<strong>for</strong>m be providedwith suitable means to prevent the fall<strong>in</strong>g <strong>of</strong> persons or materials by provid<strong>in</strong>gsuitable fenc<strong>in</strong>g or rail<strong>in</strong>g whose m<strong>in</strong>imum height shall be 1 metre.(v)Safe means <strong>of</strong> access shall be provided to all work<strong>in</strong>g plat<strong>for</strong>ms and otherwork<strong>in</strong>g places. Every ladder shall be securely fixed . No portable ladder shallbe over 9 metre <strong>in</strong> length while the width between side rails <strong>in</strong> r<strong>in</strong>g laddershall be <strong>in</strong> no case be less than 0.3 metre <strong>for</strong> ladder up to and <strong>in</strong>clud<strong>in</strong>g 3meters length. For longer ladders this width should be <strong>in</strong>creased at least 2 cm.<strong>for</strong> each additional metre <strong>of</strong> length. Uni<strong>for</strong>m step spac<strong>in</strong>g shall not exceed0.3mt. Adequate precaution shall be taken to prevent danger from electricalequipment. No material on any <strong>of</strong> the work site shall be so stacked or placedas to cause danger or <strong>in</strong>convenience to any person or the public. Thecontractor shall also provide all necessary fenc<strong>in</strong>g and lights to protect thepublic from accident and shall be bound to bear the expenses <strong>of</strong> defense <strong>of</strong>every suit action or other precautions <strong>of</strong> law that may be brought by anyperson <strong>for</strong> <strong>in</strong>jury susta<strong>in</strong>ed ow<strong>in</strong>g to neglect <strong>of</strong> the above and to pay any

Excavation and Trench<strong>in</strong>g.– All trenches 1.2 metre or more <strong>in</strong> depth, shall at all timebe supplied with at least one ladder <strong>for</strong> each 30 meter <strong>in</strong> length <strong>of</strong> fraction there<strong>of</strong>ladder shall be extended from bottom <strong>of</strong> the trench to at least 1 metre above the surface<strong>of</strong> the ground. The side <strong>of</strong> the trenches which are 1.5 metre or more <strong>in</strong> depth shall bestopped back to give suitable slopes or securely held by timber brac<strong>in</strong>g so as to avoidthe danger <strong>of</strong> sides to collapse. The excavated materials shall not be placed with<strong>in</strong> 1.5metre <strong>of</strong> the edge <strong>of</strong> the trench or half <strong>of</strong> the depth <strong>of</strong> the trench whichever is morecutt<strong>in</strong>g shall be done from top to bottom. Under no circumstances under m<strong>in</strong><strong>in</strong>g orundercutt<strong>in</strong>g shall be done.3. Demolition- Be<strong>for</strong>e any demolition work is commenced and also dur<strong>in</strong>g the process<strong>of</strong> the works: :-(a)(b)(c)All roads and open areas adjacent to the work site shall either be closed orsuitably protected.No electric cable or apparatus which is liable to be a source <strong>of</strong> danger over acable or apparatus used by the operator shall rema<strong>in</strong> electrically charged.All precautionary steps shall be taken to prevent danger to persons employedfrom risk <strong>of</strong> fire or explosion <strong>of</strong> floor<strong>in</strong>g. No floor ro<strong>of</strong> or other part <strong>of</strong> thebuild<strong>in</strong>g shall be so overloaded with debris or materials as to render it unsafe .4. Pa<strong>in</strong>t<strong>in</strong>g- All necessary personal safety equipment as considered adequate by theEng<strong>in</strong>eer-<strong>in</strong>-charge should be kept available <strong>for</strong> the use <strong>of</strong> person employed on the siteand ma<strong>in</strong>ta<strong>in</strong>ed <strong>in</strong> a condition suitable <strong>for</strong> immediate use, and the contractor shouldtake adequate steps to ensure proper use <strong>of</strong> equipment by those concerned.(a)(b)(c)(d)(e)Workers employed on mix<strong>in</strong>g asphaltic mate- rials, cement ,lime mortars shallbe provided with protective footwear and protective goggles.Stone breakers shall be provided with protective goggles and protectivecloth<strong>in</strong>gs, and seated at sufficiently safe <strong>in</strong>tervals.Those engaged <strong>in</strong> weld<strong>in</strong>g works shall be provided with welder's protect.When workers are employed <strong>in</strong> sewers and manholes which are <strong>in</strong> use, thecontractors shall ensure that the manhole covers are open and are ventilated atleast <strong>for</strong> an hour be<strong>for</strong>e the work shall be coronded <strong>of</strong> with suitable rail<strong>in</strong>g andprovided with warn<strong>in</strong>g signals or boards to prevent accident to the public.The contractor shall not employ man below the age <strong>of</strong> 18 and woman on thework <strong>of</strong> pa<strong>in</strong>t<strong>in</strong>g with products conta<strong>in</strong><strong>in</strong>g lead <strong>in</strong> any <strong>for</strong>m whenever manabove the age <strong>of</strong> 18 are employed on the work <strong>of</strong> lead pa<strong>in</strong>t<strong>in</strong>g the follow<strong>in</strong>gprecautions should be taken :-(i) No pa<strong>in</strong>t conta<strong>in</strong><strong>in</strong>g lead or lead shall be used except <strong>in</strong> the <strong>for</strong>m <strong>of</strong> pasteor ready made pa<strong>in</strong>t.

II ]191[ Appendix <strong>2.10</strong> A(ii) Able face masks should be supplied <strong>for</strong> use by the workers when pa<strong>in</strong>tapplied <strong>in</strong> the <strong>for</strong>m <strong>of</strong> spray or a surface hav<strong>in</strong>g lead pa<strong>in</strong>t dry and rubbleand scrapped.(iii)Overhauls shall be supplied by the contractor to the workmen andadequate facilities shall be provided to enable the work<strong>in</strong>g pa<strong>in</strong>ters towash dur<strong>in</strong>g the cessations <strong>of</strong> work.5. Drown<strong>in</strong>g-When the work is done near any place where there is risk <strong>of</strong> drown<strong>in</strong>g allnecessary equipments should be provided and kept ready <strong>for</strong> use and all necessary stepstaken <strong>for</strong> prompt rescue <strong>of</strong> any person <strong>in</strong> danger and adequate provision should bemade <strong>for</strong> prompt first aid treatment <strong>for</strong> all <strong>in</strong>juries likely to be susta<strong>in</strong>ed dur<strong>in</strong>g thecourse <strong>of</strong> the work.6. Mach<strong>in</strong>es- Use <strong>of</strong> hoist<strong>in</strong>g mach<strong>in</strong>es and tackle <strong>in</strong>clud<strong>in</strong>g their attachments anchorageand support shall con<strong>for</strong>m to use the follow<strong>in</strong>g standard or condition.(a)(b)(c)(d)(e)These shall be <strong>of</strong> good mecha<strong>nic</strong>al construction, sound material and adequatestrength and free from patent defect and shall be kept <strong>in</strong> good repair and <strong>in</strong> goodwork<strong>in</strong>g order.Every rope used <strong>in</strong> hoist<strong>in</strong>g or lower<strong>in</strong>g materials or as a means <strong>of</strong>suspension shall be <strong>of</strong> durable quality and adequate strength and free from patentdefects.Every crane driver or hoist<strong>in</strong>g appliances operator shall be properly qualified andno persons under an age <strong>of</strong> 21 years should <strong>in</strong>charge <strong>of</strong> any hoist<strong>in</strong>g mach<strong>in</strong>e<strong>in</strong>clud<strong>in</strong>g any scaffold which or give signals to operator.In case <strong>of</strong> every hoist<strong>in</strong>g mach<strong>in</strong>e and every cha<strong>in</strong> r<strong>in</strong>g lower<strong>in</strong>g or as means <strong>of</strong>suspensions, the safe work<strong>in</strong>g load shall be ascerta<strong>in</strong>ed by adequate means. Everyhoist<strong>in</strong>g mach<strong>in</strong>e and gear referred to above shall be pla<strong>in</strong>ly marked with the safework<strong>in</strong>g load. In case <strong>of</strong> a hoist<strong>in</strong>g mach<strong>in</strong>e hav<strong>in</strong>g a variable safe work<strong>in</strong>g loadeach safe work<strong>in</strong>g load <strong>of</strong> the conditions under which it is applicable shall beclearly <strong>in</strong>dicated. No part <strong>of</strong> any mach<strong>in</strong>e or <strong>of</strong> any gear referred to above <strong>in</strong> thisparagraph shall be loaded beyond the safe work<strong>in</strong>g load except <strong>for</strong> load purpose<strong>of</strong> test<strong>in</strong>g.In case <strong>of</strong> departmental mach<strong>in</strong>e the safe work<strong>in</strong>g and load shall be notified by theelectrical eng<strong>in</strong>eer–<strong>in</strong>– charge. As regards contractor mach<strong>in</strong>e the contractor shallnotify the safe work<strong>in</strong>g load <strong>of</strong> the mach<strong>in</strong>e to the Eng<strong>in</strong>eer-<strong>in</strong>-Charge, wheneverhe br<strong>in</strong>gs any mach<strong>in</strong>ery to site <strong>of</strong> work and get verified by the electrical eng<strong>in</strong>eerconcerned.Motors gear<strong>in</strong>g transmission, electric wir<strong>in</strong>g and other dangerous parts <strong>of</strong> thehoist<strong>in</strong>g appliance should be provided with efficient safe guards and with meansas will reduced the m<strong>in</strong>imum <strong>of</strong> the risk <strong>of</strong> the accidental descent <strong>of</strong> the loadadequate precautions should be taken to reduce to the m<strong>in</strong>imum the risk <strong>of</strong> anypart <strong>of</strong> a suspended load be com<strong>in</strong>g accidentally displaced. When workersemployed electrical <strong>in</strong>stallations which are already unregistered, <strong>in</strong>sulat<strong>in</strong>g mats,wear<strong>in</strong>g apparel such as gloves sleeves and boots as may necessary should be

All scaffolds, ladders and their safety device mentioned or described here<strong>in</strong> shall bema<strong>in</strong>ta<strong>in</strong>ed <strong>in</strong> safe condition and no scaffold ladder or equipment shall be altered orremoved while it is <strong>in</strong> use. Adequate wash<strong>in</strong>g facilities shall be provided at or nearplaces <strong>of</strong> work.8. These safety provisions should be brought to the notice <strong>of</strong> all concerned by display on a<strong>Notice</strong> Board at prom<strong>in</strong>ent places at the work spot. The persons responsible <strong>for</strong>compliance <strong>of</strong> the safety code shall be named there<strong>in</strong> by the contractor.9. To ensure effective en<strong>for</strong>cement <strong>of</strong> the rules and regulations relat<strong>in</strong>g to safetyprecautions the arrangement made by the contractor shall be open to <strong>in</strong>spection by theLabour <strong>of</strong>ficer, Eng<strong>in</strong>eer-<strong>in</strong> -Charge, or the Department or their representatives.10. Notwithstand<strong>in</strong>g the above clause (1) to (9) there is noth<strong>in</strong>g <strong>in</strong> these to exempt thecontractors to exclude the operations <strong>of</strong> any other act or rule <strong>in</strong> <strong>for</strong>ce <strong>in</strong> the Republic <strong>of</strong>India.
