II ]176ANNEXURE-B[ Appendix 2.10 AThe contractor shall pay not less then Fair Wage to labour engaged by him on the work.Explanation-(a)(b)(c)(d)(e)(f)“Fair wage” means wage whether for time or piece work as notified at the time ofinviting tenders for the work and where such wages have not been so notified thewages prescribed by the ……………………. Department for the division in whichthe work is done.The contractor shall, notwithstanding the provisions of any contract to the contrary,cause to be paid a fair wage to labourers indirectly engaged on the work including anylabour engaged by his subcontractors had been immediately employed by him.In respect of all labour directly or indirectly employed on the work for theperformance of the contractor’s part of this agreement , the contractor shall complywith or cause to be complied with the Labour Act in force.The Executive Engineer/ Sub-Divisional Officer shall have the right to deduct fromthe moneys due to the contractor, any sum required for making good the loss sufferedby a worker or workers by reason of non- fulfillment of the condition of the contractorfor the benefit of the workers, non-payment of wages, or of deductions made from histheir wages, which are not justified by the terms of the contractor or non-observanceof the regulations.The contractor shall be primarily liable for all payments to be made under and for theobservance of the regulations aforesaid without prejudice to his right to claimindemnity from his sub- contractors.The regulations aforesaid shall be deemed to be a part of his contractor.
