Tenders must be accompanied by a list of contracts already held by the tenderer at thetime of submitting the tenders in Chhattisgarh Water Resources Department andelsewhere as per Annexure – K.Removal of Unsuitable or Undesirable Employees of Contractor2.31. The contractor shall on receipt of the requisition from the Executive Engineer at onceremove any person employed by him on the work who in the opinion of ExecutiveEngineer is unsuitable or undesirable.Recovery of Amount due to Government from Contractor2.32. Any amount due to Government from the contractor on any account concerning workmay be recovered from him as arrear of land revenue.Transport of Materials is Contractor’s Responsibility2.33. The contractor shall make his own arrangement for transport of all materials. TheGovernment is not bound to arrange for priorities for getting wagon or any othermaterials though all possible assistance by way of recommendation will be given, if itis found necessary in the opinion of the Engineer-in-Charge. If it proves ineffective,the contractor shall have no claim for any compensation on this account.Arrangements of Tools and Plants2.34.1. The contractor shall arrange at his own cost tools and plant required for properexecution of work. It should be carefully noted that the plant and machinery as listed(Annexure-E) may be supplied by the Government under the orders of SuperintendingEngineer/Engineer-in-Charge of the work, if available and considered necessary in theinterest of work on the conditions, terms and rates as specified in the annexure-E. Thecontractor will have to execute the agreement for hiring the machine, if required to doso by the Engineer-in-Charge in the prescribed form, Appended herein, videAnnexure F.2.34.2. Items, if any, other than those referred in Annexure E will also be supplied by theGovernment if available on conditions and payments as may be fixed by thedepartment at the time of loaning the plant.Increase or Decrease of Items of Work2.35. The competent authority reserves the right to increase or decrease any item of thework during the currency of the contract and contractor will be bound to comply with

II ]161[ Appendix 2.10 Athe order of the competent authority in the manner described in clause 4.3.13.1,4.3.13.2, and 4.3.13.3 of agreement without any claim for compensation.Execution of Work according to Time Schedule2.36 The work shall be done by the contractor according to the time schedule fixed bycompetent authority.Canvassing or Support for Acceptance of tender2.37. Canvassing or support in any form for the acceptance of any tender is strictlyprohibited. Any tenderer doing so will render himself liable to penalties which mayinclude removal of his name from the register of approved contractors.Responsibilities for Leaking of Building during Rainy Season2.38. It will be the responsibility of the contractor to see that the building does not leakduring the period of first rainy season of tiled and sheet roof and two consecutiverainy seasons in respect of terraced roof after its completion and he will make goodand replace all the defective work on this account.List of Persons Employed by Contractor2.39. The contractor shall not be permitted to tender for works in the……………………………. Division/Circle (responsible for award and execution ofcontracts) in which his near relative is posted as Divisional Accountant or as anofficer in any capacity between the grades of Superintending Engineer and AssistantEngineer (both inclusive). A list showing the names of the persons who are workingwith the contractor and are near relatives to any gazetted officer in the………………….. Department including Secretariat should also be appended to thetender. He should also intimate to the E.E. the names of subsequently employedpersons who are near relatives to any gazetted officer in …………………..Department or Divisional Accountant in …………………. Division. Any breach ofthis condition by the contractor would render him liable to be removed from theapproved list of contractors of this Department.Note.- By the term near relative is meant son, grand-son, father, mother, spouse, brother,sister, brother-in-law, father-in-law, and mother-in-law.
