It is open to the contractor or the Sub-Contractor as the case may be to make anapplication to the Income Tax Officer concerned and obtain from him a Certificateauthorizing the payer to deduct tax at such lower rate or deduct no tax as may beappropriate to his case. Such certificate will be valid for the period specified thereinunless it is cancelled by the Income Tax Officer earlier.Model Rules for Water Supply, Sanitation in Labour Camps2.18. The contractor will be bound to follow the Madhya Pradesh Model Rules relating tolay out of water supply and sanitation in labour camps ( vide Annexure A).Fair Wages to Labourers2.19 The contractor shall pay not less than fair wages to labourers engaged by him on thework ( copy of rules enclosed vide Annexure B.)Right to Take up Work Departmentally or to Award on Contract2.20. If the waste pieces exceed 3 percent that excess will becharged to the contractor at departmental issue rate plus usual departmental charges.The waste pieces of only reasonable size and quality will be accepted. Decision of theEngineer-in-Charge about the reasonableness will be final and binding on thecontractor.Delay in Supply of Departmental Materials2.22.3. If the materials are not supplied in time, the contractor will not be allowed any claimfor any loss which may be caused to him, but only extension of time will be given atthe discretion of the competent authority if applied for by the contractor before theexpiry of the contract.Lead and Lift for Water2.23 No lead and lift for carting of water will be paid.2.24. Application for percentage Tenders Form–A only.- Carting of materials will beallowed as per actual lead limited to the lead provided in the enclosed statement videAnnexure C. The Superintending Engineer shall have power to change the quarriesand allow longer leads provided the extra cost for each kind of materials does notexceed 20 per cent of the cost of lead.2.25. Applicable for item rate tenders – Form B only.- Materials to be used on workspecified in the contract will be only from the quarries specified in Annexure C. If thechanges of quarries, from those mentioned in Annexure C, are necessitated due to anyreason during the execution of work, such changes will be made only with theapproval of the Superintending Engineer given in writing. Any alterations of itemsaffected by change of such quarries will be governed by the clauses 4.3.13.1, 4.3.13.2& 4.3.13.3 of the Agreement in form B.2.26. If in a quarry, material of more than one quality is found the material of the bestquality as approved by the Executive Engineer shall be used by the contractor.2.27. Deleted.2.28.
