consulted stakeholders and their signatures, drawings and termsof references are put in the appendix.Steps 7: Review of <strong>Environmental</strong> Impact Statement(i)(ii)(iii)NEMC reviews the <strong>Environmental</strong> Impact Statement adhering tothe review criteria and any guidelines that may be issued underthese Regulations;NEMC may call for a public hearing and public review of the<strong>Environmental</strong> Impact Statement in accordance with conditionsand procedures stipulated under these Regulations; andNEMC shall submit review report to the Minister with itsrecommendations and all documents used in the review forapproval or disapproval.Steps 8: <strong>Environmental</strong> Monitoring and AuditingThe NEMC shall conduct environmental monitoring in order to evaluate theperformance of the mitigation measures following the prepared <strong>Environmental</strong> and<strong>Social</strong> <strong>Management</strong> Plan as well as Monitoring Plan, thus:(i) monitoring include the verification of impacts, adherence toapprove plans, environmental standards and general complianceof terms and conditions set out in the <strong>Environmental</strong> ImpactAssessment certificate;(ii) developer can also undertake monitoring of the implementation ofthe project to ensure if mitigation measures are effective;(iii) both the developer and the Council collects data that can beused in future projects and for environmental management;(iv) NEMC and the developer undertakes environmental audits forthe project;(v) mechanisms for stakeholder participation during the monitoringand auditing process must be defined and followed through;(vi) the auditing exercise may focus in the following areas:(a) implementation/enforcement audit, which takes placewhen the NEMC verifies if the mitigation measures andlevels of pollution are within limits(b) performance/regulatory audit that entails identification ofcompliance to relevant legislation or safety standards(c) impact prediction audits checks the accuracy and efficacyof the impact prediction by comparing them with monitoredimpacts.(d) NEMC collects and compiles information arising fromauditing for future use; and(e) developer collects data from the auditing and compilesinformation for project management and also forsubmission to the NEMCSteps 9: DecommissioningThis is the end of the project life.
