8 JOINT ACCOUNT HOLDERSWhere the Card Account(s) is/are in joint names, theJoint Account Holders shall be jointly and severally liablefor the Card Account(s) and shall remain so liable notwithstanding any cancellation of this Agreement ortermination of the mandate for the operation of suchJoint Account(s).9 AMENDMENT OF TERMS AND CONDITIONSWe reserve the right at all times to introduce new termsand conditions and/or to amend existing terms andconditions relating to the Cards. Unless we are permittedby law to give you shorter notice, we will notify you atleast two months in advance of any amendment to theseterms and conditions. We may notify the Cardholder ofthe amendment by publication in a national dailynewspaper, and/or by notice displayed prominently at ourbranches, and/or by notice in writing and/or through ourWebsite and/or by means of another durable medium, orby any other means required or permitted by law, andshall be binding on the Cardholder upon any subsequentuse by the Cardholder of the Card following such notice.In the alternative, the Cardholder shall be entitled, onreceiving such notice, to immediately terminate thisAgreement and shall forthwith discharge all/anyoutstanding liabilities to us and shall return the Card(duly cancelled by being cut in two pieces through themagnetic stripe) to us.10 THE AGREEMENTBThe Agreement will be treated as having been executedwithin the Dublin Metropolitan area at 56/59 StStephen’s Green, Dublin 2.CASH MACHINE TRANSACTIONS WHEREAUTHORISED BY THE BANK FOR THECARDHOLDERIn addition to the above terms and conditions, thefollowing terms and conditions apply to Cash MachineTransactions.11 CASH MACHINE TRANSACTIONS(a) WITHDRAWALSC(iii) Entries in the Card Account(s) of the Cardholderin respect of Cash Machine Transactions shall betreated as valid and will be binding on theCardholder (and any Joint Account Holders onthe Card Account) and us until proved incorrect.(iv) The amount of cash which may be withdrawnfrom an Cash Machine shall not exceed €700per day or such other limit as we may fix fromtime to time. The Cash Machine owner mayimpose lower limits.(b) LODGEMENTS(i)(ii)The Cardholder may lodge to the CardAccount(s) using the Card at permanent tsb onlywhere this facility is available. An ATMlodgement envelope should be used for alllodgements. Such lodgements should consist ofnotes (not coins) and/or cheques drawn infavour of the Customer of the Card Account orendorsed to order. The value of Bank notes inany such lodgements shall not exceed suchaggregate amount as we may notify from time totime by general notice to the Cardholders orotherwise.The provisions of Condition 12 of the GeneralConditions shall apply in respect of lodgementsusing the Card.CHEQUE GUARANTEE FACILITIES WHEREAUTHORISED BY THE BANK FOR THECARDHOLDERIn addition to the above Conditions, the followingConditions apply to cheque guarantee transactions.12 CHEQUE GUARANTEE TRANSACTIONS(a) The Cardholder shall not draw any cheques whichwould create any unauthorised overdraft or whichwould cause any authorised overdraft limit to beexceeded.(b) We guarantee payment of one cheque only notexceeding €130 for any single transaction withinIreland provided that:(i)We shall debit the Card Account(s) of theCardholder with the amounts of all cashwithdrawals within Ireland or Northern Ireland(where this facility is available) or in any othercountry where the Cirrus Facility is effected bymeans of the Card except for any disbursementsmade after the Cardholder has notified us of itsloss, theft, mislaying, copying, unauthorised orirregular use subject to and in accordance withinthe Conditions.(i)(ii)it is signed in the presence of the payee or thepayee’s representative and the signaturecorresponds with the specimen on the reverse ofthe Card and is that of the Cardholder named onthe Card;it is drawn before the expiry date of the Cardand that a permanent tsb cheque form bearingthe code number corresponding to the Card isused;(ii)A Cash Machine transaction updates a CardAccount immediately and it appears on the nextstatement issued to the Cardholder on the CardAccount.(iii) it has the Card number written on the reverse bythe payee or the payee’s representative and thatno apparent alteration has beenmade to theCard; andPAGE 27
D(iv) The Cardholder takes reasonable care incompleting the cheque form so as not tofacilitate unauthorised interference or alterationsand initials any alterations on the cheque form.(c) Cheques drawn in conjunction with the Card cannotbe stopped, post-dated or countermanded, but wemay debit the drawer’s Account with any chequeissued under the terms and conditions of the chequeguarantee scheme even though it may bear technicalirregularities.(d) Cheques must be kept separate from the Card andall reasonable care and precautions should be takenby the Cardholder against either being lost or stolen.(e) The amount of any cheque guarantee transactionshall be debited from the Card Account within thenormal clearing cycle (usually 5 Business Days).(f) If the cheque book is lost/stolen or mislaid, theCardholder shall immediately notify us in the mannerspecified in Condition (b) of the General Conditions.DEBIT CARD FACILITIES WHERE AUTHORISED BYTHE BANK FOR THE CARDHOLDERIn addition to the above Conditions, the followingConditions apply to Debit Card Transactions.13 PAYMENT CARD GUARANTEE – LASER/ MAESTRO(a) Subject to the limits set out in Condition 13(b) of theCard Conditions, we guarantee payment of LaserTransactions made by the Cardholder using the Cardwithin Ireland (i.e. using Laser) if:(i)(ii)the Card has not been deliberately altered ordefaced in any way;the Card is presented by the Cardholder to theRetailer, the Laser Transaction is effectedthrough a POS Terminal and the correct PIN isentered into the terminal; or the LaserTransaction is a Cardholder Not PresentTransaction; or a Laser transaction slip is signedin the presence of the Retailer, the signaturecorresponds with the specimen on the reverse ofthe Card and is that of the Cardholder named onthe Card;(iii) The Laser Transaction is completed before theexpiry date of the Card; and(iv) The Cardholder authorises, and does not revoke,the Laser Transaction in accordance with theseConditions.(b) The maximum value of any one Laser Transactionwhich may be effected by the Cardholder is €1500and an aggregate value of €2500 within a 24 hourperiod, or such lower limits as may be determined byus in our sole discretion and notified to you from timeto time, or as may be imposed by the Cash Machineowner. The amount of cash obtained (if any) inthecourse of any Laser Transaction islimited to €100.(c) Subject to the limits set out in Condition (d) of theCard Conditions, we guarantee payment of MaestroTransactions made by the Cardholder using the Cardoutside Ireland (i.e. using Maestro) if:(i) the Card has not been deliberately altered ordefaced in any way.(ii)the Card is presented by the Cardholder to theRetailer, the Maestro Transaction is effectedthrough a POS Terminal and the correct PIN isentered into the terminal; and/or a MaestroTransaction Slip is signed in the presence of theRetailer, the signature corresponds with thespecimen on the reverse of the Card and is thatof the Cardholder named on the Card.(iii) The Maestro Transaction is completed before theexpiry date of the Card.(iv) The Cardholder authorises, and does not revoke,the Maestro Transaction in accordance withthese Conditions.(d) The maximum value of any one Maestro Transactionwhich may be effected by the Cardholder is €1500and an aggregate value of €2500 within a 24 hourperiod, or such lower limits as may be determined byus in our sole discretion and notified to you from timeto time, or as may be imposed by the Cash Machineowner.(e) The amount of any transaction effected outside ofthe Eurozone will be converted to euro at the rate ofexchange applicable on the date the transaction isdebited to the Account. This rate may be set by us ormay be set in accordance with the procedures of thescheme. Where scheme procedures are followed, wewill have no control over the applicable exchange ratewhich is set and accordingly the date of conversionmay not be the date of the transaction. We have nocontrol over when the transaction will actually beprocessed by the scheme as this depends on whenthe merchant sends details of the transaction to thescheme. We can provide you with an indicative rateof exchange on the day of the transaction if youcontact us, but as outlined above, this may not be theactual rate that will be applied as exchange rates mayfluctuate between the date of a transaction and thedate on which the transaction amount is debited tothe Account. Our contact details are set out atCondition 30 of the General Conditions.(f) Entries in the Card Account in respect of all CardTransactions except Laser Transactions and MaestroTransactions that are effected by Chip enabledterminals will be prima facie evidence of such CardTransactions and will be binding on the Cardholder(s)(and any Joint Account Holders on the CardAccount) and us. In the case of Laser Transactionsand Maestro Transactions, it is our responsibility toprove that the instruction was accuratelyauthenticated, recorded, entered in the accounts andnot affected by a technical breakdown. It is notsufficient to rely solely on the fact that the CardTransaction was effected by Chip enabled terminals.If the Cardholder denies that his/her Card and ifapplicable his/her PIN or other Security Feature havebeen used to make a transaction or alleges it hasPAGE 28
