EMD / Security Deposit etc. if any,will be forfeited. The Contracting Agency in such cases shall make good to VSPany loss or damage resulting from such termination. Contracts in operationanywhere in RINL/VSP will also be terminated with attendant fall outs likeforfeiture of EMD / Security Deposit, if any, and recovery of risk and cost chargesetc. Decision of RINL/VSP Management will be final and binding.75 The Company requires that bidders / contractors under this contract, observe thehighest standard of ethics during the execution of this contract. In pursuance ofthis policy, the Company defines, for purpose of these provisions, the terms setforth below as follows. “Corrupt practice” means the offering, giving, receiving orsoliciting of any thing of value to influence the action of a Public official in contractexecution and “fraudulent practice” means a misrepresentation of facts in order toinfluence the execution of a contract to the detriment of the Employer andincludes collusive practice among Bidders (prior to or after bid submission)designed to establish bid prices at artificial non-competitive levels and to deprivethe Company of the benefits of free and open competition. The Company willreject a proposal for award of work if it determines that the bidder recommendedfor award had engaged in corrupt or fraudulent practices in competing for thetender in question. The Company will declare a bidder ineligible, eitherindefinitely or for a stated period of time, to be awarded contract / contracts if itany time determines that the bidder has engaged in corrupt or fraudulentpractices in competing for, or in executing, the contract.76 Amendment to EOI Terms and conditions:The PURCHASER may, for any reason, modify the EOI terms and conditions byway of an amendment.Such amendments will be notified on RINL’s website www.vizagsteel.com and will bebinding on the Parties.
