1.1081 APPENDIXMedical facilities for retired Judges.23C. Every retired Judge shall, with effect from the date on which the Supreme CourtJudges (Conditions of Service) Amendment <strong>Act</strong>, 1976 (36 of 1976), receives theassent of the President, be entitled, for himself and his family, to the same facilities asrespects medical treatment and on the same conditions as retired officer of the CentralCivil Services, Class I and his family, are entitled under any rules and orders of the CentralGovernment for the time being in force.Exemption from liability to pay income-tax on certain perquisites received by a Judge.23D. Notwithstanding anything contained in the <strong>Income</strong>-tax <strong>Act</strong>, 1961 (43 of 1961),—(a) the value of rent-free official residence provided to a Judge under sub-section (1)of section 23 or the allowance paid to him under sub-section (1A) of that section;(b) the value of the conveyance facilities provided to a Judge under section 23A;(c) the summary allowance provided to a Judge under section 23B;(d) the value of leave travel concession provided to a Judge and members of hisfamily,shall not be included in the computation of his income chargeable under the head “Salaries”under section 15 of the <strong>Income</strong>-tax <strong>Act</strong>, 1961.Definitions.SECTION 2(e) OF TRADE UNIONS ACT, 19262. ** ** **(e) “registered Trade Union” means a Trade Union registered under this <strong>Act</strong>;Part performance.SECTION 53A OF TRANSFER OF PROPERTY ACT, 188253A. Where any person contracts to transfer for consideration any immovable propertyby writing signed by him or on his behalf from which the terms necessary toconstitute the transfer can be ascertained with reasonable certainty,and the transferee has, in part performance of the contract, taken possession of theproperty or any part thereof, or the transferee, being already in possession, continues inpossession in part performance of the contract and has done some act in furtherance ofthe contract,and the transferee has performed or is willing to perform his part of the contract,then notwithstanding that where there is an instrument of transfer, that the transfer hasnot been completed in the manner prescribed therefor by the law for the time being inforce, the transferor or any person claiming under him shall be debarred from enforcingagainst the transferee and persons claiming under him any right in respect of the propertyof which the transferee has taken or continued in possession, other than a right expresslyprovided by the terms of the contract :Provided that nothing in this section shall affect the rights of a transferee for considerationwho has no notice of the contract or of the part performance thereof.
