Division 6Certificates of test and the register of material <strong>handling</strong> <strong>equipment</strong>Section 31or replacement of material <strong>handling</strong> <strong>equipment</strong> to which this <strong>Order</strong> applies mustrecord particulars of the work in the applicable register of material <strong>handling</strong><strong>equipment</strong>.Penalty: 50 penalty units.30.3A An offence against subsection 30.1, 30.2 or 30.3 is a strict liability offence.30.3B A person is liable to a civil penalty if the person contravenes subsection 30.1,30.2 or 30.3.Civil penalty: 50 penalty units.30.4 A register of material <strong>handling</strong> <strong>equipment</strong> may be kept in any convenient formsubject to the following conditions:(a) the register must contain the information required by this order;(b) each entry must be clearly legible;(c) each entry must be authenticated by the competent or responsible personsupervising or carrying out the work mentioned in subsection 30.3.Note A form of register is available on the AMSA website at http://www.amsa.gov.au.31 Certificate requirements31.1 A certificate of test of material <strong>handling</strong> <strong>equipment</strong> manufactured in Australiamust be in the form specified for the <strong>equipment</strong> in Schedule 11.Note Forms of certificate are available on the AMSA website at http://www.amsa.gov.au.31.2 A certificate of test for material <strong>handling</strong> <strong>equipment</strong> manufactured in a countryother than Australia and tested or thoroughly examined in a country other thanAustralia by a competent person, will be acceptable as a certificate of test forthis <strong>Order</strong> if the certificate contains information substantially equivalent to thatrequired by the forms mentioned in Schedule 11.31.3 If an original certificate is not available, a certified copy is acceptable forsubsections 31.1 and 31.2.31.4 A requirement of subsection 31.1 or 31.2 to provide a certificate of test for wirerope or chain, if that <strong>equipment</strong> is a portion only of a greater manufacturedlength, may be met by producing a certified copy of the certificate issued by, orfor, the manufacturer of the greater length of wire, rope of chain.<strong>32</strong> Availability of certificates and register<strong>32</strong>.1 All certificates of test and inspection, that are:(a) current for <strong>equipment</strong> to which this <strong>Order</strong> applies; and(b) required by this <strong>Order</strong> to be kept, made available or given to a dutyinspector;must be kept with, or near at hand to, the register of material <strong>handling</strong><strong>equipment</strong>.<strong>32</strong>.2 The master of a vessel must make the register of material <strong>handling</strong> <strong>equipment</strong>and the certificates for <strong>equipment</strong> on board the vessel readily available forinspection by an inspector on request.Penalty: 50 penalty units.<strong>32</strong>.3 The owner of shore <strong>equipment</strong> being used for loading or unloading a ship mustmake the register of material <strong>handling</strong> <strong>equipment</strong> and any certificates issued by18 <strong>Marine</strong> <strong>Order</strong> <strong>32</strong> (<strong>Cargo</strong> <strong>handling</strong> <strong>equipment</strong>) 2011MO<strong>32</strong> modcomp-130604Z.docx
