Do not use materials and equipment removed from existing premises, except as specificallypermitted by the Contract Documents.B. Provide interchangeable components of the same manufacture, for existing componentsbeing replaced.1.4 COLOR SELECTIONA. Colors Selected During Construction:1. Products will be selected by the Architect from the standard colors of any of the listedor approved manufacturers, unless a specific color or color price range has beenidentified prior to bidding.1.5 TRANSPORTATION AND HANDLINGA. Transport and handle Products in accordance with manufacturer's instructions.B. Promptly inspect shipments to ensure that Products comply with requirements, quantities arecorrect, and Products are undamaged.C. Provide equipment and personnel to handle Products by methods to prevent soiling,disfigurement, or damage.1.6 STORAGE AND PROTECTIONA. Store and protect Products in accordance with manufacturers' instructions, with seals andlabels intact and legible.B. Store sensitive Products in weather tight, climate controlled enclosures.C. For exterior storage of fabricated Products, place on sloped supports, above ground.D. Cover Products subject to deterioration with impervious sheet covering. Provide ventilationto avoid condensation or potential degradation of Product.E. Store loose granular materials on solid flat surfaces in a well-drained area. Provide equipment and personnel to store Products by methods to prevent soiling,disfigurement, or damage.G. Arrange storage of Products to permit access for inspection. Periodically inspect to verifyProducts are undamaged and are maintained in acceptable condition.H. Each Contractor shall provide all temporary protection necessary to protect their work (inprogress and completed) from detrimental exposure, bad weather, other constructionoperations, and similar activities that may damage the installed materials until subsequentconstruction make the temporary protection unnecessary or Substantial Completionwhichever comes first.1.7 SUBSTITUTIONS PRIOR TO RECEIPT OF BIDA. Prior to Bidding: In order to be approved prior to bidding requests for Substitutions shall besubmitted during the bidding period and shall be received 10 days prior to receipt of bids.Comply with the requirements specified in this section. This does not limit the bidder fromproposing alternatives at the time of bid receipt in accordance with the SupplementaryInstructions to Bidders.B. Document each request with complete data substantiating compliance of proposedSubstitution with Contract Documents.C. A request constitutes a representation that the Prime Bidder:1. Has investigated proposed Product and determined that it meets or exceeds thequality level of the specified Product.2. Will provide the same warranty for the Substitution as for the specified Product.3. That the use of this product will not have an adverse effect on any other trade orPrime Contractor or the Construction Schedule.4. Will coordinate installation and make changes to other Work which may be requiredfor the Work to be complete with no additional cost to Owner.5. Waives claims for additional costs or time extension which may subsequently becomeapparent.D. Substitution Submittal Procedure:1. Submit request for Substitution for consideration. Limit each request to one proposedSubstitution. Identify specification section of Product being considered.2. Clearly delineate on Contract Document specification section applicable for Productwhich a proposed substitution is being submitted, differences between substitution andProduct specified.3. Submit shop drawings, product data, and certified test results attesting to theproposed Product equivalence. Burden of proof is on proposer.4. The Architect will notify all bidders in writing of decision to accept a request byaddendum.5. Each request shall include all information required to make a technical comparison ofthe product to be substituted with the specified product. This information shall includecolor and finish samples if the installed product will be visible after installation.E. Submit each request for substitution accompanied by a separate Substitution Request Forma copy of which is bound in these specifications.F. If a bidder decides to use substitutions not accepted by addendum the bidder shall submit aSubstitution Request Form with the bid as indicated in the Instructions to Bidders.PRODUCT REQUIREMENTS 016000-2


SOUTH BRANDYWINE MIDDLE SCHOOL REFURBISHING PROJECT - <strong>#1233</strong>1.8 SUBSTITUTIONS AFTER RECEIPT OF BIDS AND PRIOR TO EXECUTION OF THEAGREEMENTA. After the receipt of bids, substitutions will be considered only when submitted with the bid andidentified as indicated in the Instructions to Bidders. No negotiations are permitted betweenthe receipt of bids and the Execution of the Agreement.B. If alternatives are not identified at the time of the bid they will not be accepted after theExecution of the Agreement as substitute without an appropriate credit to the Owner.1.9 SUBSTITUTIONS AFTER EXECUTION OF THE AGREEMENTA. Substitution of Materials: No substitutions of materials will be considered after the Executionof the Contract without a Credit to the Owner, unless a Product becomes unavailable throughno fault of the Contractor.B. NO ACTION TO REVIEW THE PROPOSED SUBSTITUTION WILL BE TAKEN BY THEARCHITECT OR ENGINEER UNTIL THE CONTRACTOR HAS SUBMITTED THEFOLLOWING:1. A letter itemizing the proposed credit to Owner2. A copy of the warranty.3. A summary of the schedule impact.C. Substitutions will not be considered when they are indicated or implied on shop drawing orproduct data submittals, without separate written request as included above, or whenacceptance will require revision to the Contract Documents.D. In submitting a substitution request the Contractor acknowledges that:1. The Contractor shall coordinate installation of the substitution including modificationsto other Work.2. The use of this Substitution will not adversely affect the Project Schedule.3. If modifications to the work of this contract or another contract are required because ofthe substitution these modifications shall be made at no additional cost to Owner.4.
