THE CITY OF PITT MEADOWS<strong>HIGHWAY</strong> and <strong>TRAFFIC</strong> <strong>BYLAW</strong> No. 2260Consolidated VersionPage 3013. IMPOUNDING REGULATIONS13.1. Any vehicle, chattel or obstruction unlawfully occupying any portion of ahighway or public place that is in violation of this Bylaw, and/or isapparently abandoned on or near any highway, and/or is without properor valid license plates, and/or in a position that causes the vehicle, chattelor obstruction to interfere with the removal of snow from any highway bya person authorized by the Director to remove snow, may, upon the orderof the Bylaw Enforcement Officer, Peace Officer, or by any personacting under their direction, or by a contractor engaged by theCorporation for removal or impoundment services, be removed to andimpounded in such place as is directed by the Bylaw EnforcementOfficer or Peace Officer and such vehicle, chattel or obstruction will notbe released to its owner until the costs of its removal and impounding arepaid to the City. If such impounded vehicle, chattel or obstruction is notclaimed by the owner within fourteen (14) days of the giving of notice ofthe impounding of the vehicle, chattel or obstruction, such vehicle, chattelor obstruction may be sold at Public Auction by the City. Notice shall begiven to the owner of every vehicle, chattel or obstruction impoundedunder Section 13 of the intention to sell such vehicle, chattel or obstructionon the date set out in the notice by mailing the notice by registered mail tothe owner:a. in the case of a vehicle, at the address for such owner as shown onthe records of the Superintendent of Motor Vehicles at the date ofimpoundment,b. in the case of any other chattel or obstruction, at any address of theowner which is known to the City.13.2. The Director of Finance & IT may commence action in court of thecompetent jurisdiction to recover unpaid costs in lieu of an action or forany costs in excess of public auction proceeds.13.3. Any proceeds received on the sale of the impounded vehicle, chattel, orobstruction shall be applied firstly to the costs of the sale or court action,secondly to the costs of the removal and impoundment, and thirdly thesurplus if any shall be paid to the owner of the vehicle, chattel orobstruction.13.4. No person shall cause a vehicle to be towed from a private parking lotunless, at the time such vehicle is towed, a directional sign or signscomplying with the requirements of Section 13 of this Bylaw arepermanently installed and displayed in the parking lot.#55701v3
