Delivery and payment conditions
General information
This catalogue replaces all previous
price lists, catalogues and offers.
Prices are non-binding and subject
to change.
Prices and delivery and payment
terms
All prices are given in euros (€) and
exclude statutory VAT. Subject to
price changes. Errors and omissions
excepted. Orders of a net
value of €150.00 or more are delivered
free of charge to addresses in
Germany and Austria.
Risk is transferred to the purchaser
as soon as the goods are handed
over to the party responsible for
transport or leave the seller's factory
for delivery. At the request of
the purchaser, deliveries can be
insured on behalf of the purchaser
at the purchaser's cost. Payment
by direct debit: 3% discount;
payment within 8 days of receipt
of the invoice: 2% discount; payment
within 30 days: no discount.
Bank charges for chargebacks in
the event of disputed/refused
payments or an insufficient credit
balance shall be borne by the
purchaser.
Natural disasters, poor harvests
and changes on the global market
cannot be foreseen; the prices for
oils and herbs are therefore nonbinding.
Ordering
Orders can be placed by telephone,
fax or e-mail. Orders are binding
and governed exclusively by our
delivery and payment terms. A
written order confirmation shall
only be provided if explicitly requested
by the customer. The purchaser
is responsible for ensuring
that orders are correct and lawful.
We do not examine the correctness
or lawfulness of orders.
Inspection of goods received
The good must be checked in the
presence of the party delivering to
ensure that they are complete and
undamaged before the delivery
documents are signed, i.e. before
you accept the goods. For insurance
reasons, complaints at a
later stage cannot be accepted. By
signing, you confirm that you have
received a complete and undamaged
delivery.
Returns and replacements
Returns and replacements are
only possible following written
agreement. We reserve the right
to return, at the customer's cost,
items that have been returned
to us without our agreement. We
reserve the right to charge an administrative
fee (based on cost) for
handling returns.
Retention of title
Deliveries are made under full
retention of title. The seller shall
retain title until payment is made
in full, even upon resale by the
purchaser.
Applicable law, competent courts
and severability
(1) These general terms and conditions
and all business between the
seller and purchasers based in Germany
or abroad shall be governed
by the law of the Federal Republic
of Germany with the exception of
business with purchasers
based in Austria, which shall be
governed by the law of the Republic
of Austria.
(2) If the purchaser is a merchant
entered in the commercial register
[Vollkaufmann] as defined in the
Commercial Code [Handelsgesetzbuch],
a legal person under public
law or a public-law special fund, in
Germany the courts of Traunstein
and in Austria the courts of Salzburg
shall have sole jurisdiction
for all disputes arising from or in
connection with the contract.
(3) In the event that one of more
provisions of these general terms
and conditions or any provision
of any another agreement be or
become invalid, this shall not affect
the validity of the remaining provisions.
Closing provisions
In the event that any part or passage
of these terms and conditions
become invalid as a result of
changes in the law of obligations
or in any other statutory provisions,
the legally effective provision
pursuant to the Commercial Code
[HGB] that most closely corresponds
to the actual meaning and
business purpose of the invalid
part or passage shall apply. The
same shall apply in the event of
any omissions.
Prices subject to change. Printing
errors excepted. All prices are
given in euros (€) and exclude
statutory VAT. Our above delivery
and payment terms shall apply
exclusively. Product images may
differ from the actual products
delivered.
