23p.-(1) Where a CO2 s<strong>to</strong>rage site has been closed pursuant <strong>to</strong> section 23k(2)(iii), transfer of<br />

responsibility shall be deemed <strong>to</strong> have taken place if <strong>and</strong> when all available evidence <strong>in</strong>dicates that<br />

the s<strong>to</strong>red CO2 will be completely <strong>and</strong> permanently conta<strong>in</strong>ed, <strong>and</strong> after the CO2 s<strong>to</strong>rage site has<br />

been sealed <strong>and</strong> the <strong>in</strong>jection facilities have been removed.<br />

(2) The M<strong>in</strong>ister for Climate <strong>and</strong> Energy may lay down more detailed rules <strong>and</strong> regulations<br />

regard<strong>in</strong>g the transfer of responsibility for CO2 s<strong>to</strong>rage sites pursuant <strong>to</strong> subsection (1) <strong>and</strong><br />

regard<strong>in</strong>g the documentation <strong>to</strong> be made available before the transfer of responsibility can be<br />

deemed <strong>to</strong> have taken place.<br />

23q.-(1) A holder of a licence for a CO2 s<strong>to</strong>rage site shall provide valid <strong>and</strong> effective f<strong>in</strong>ancial<br />

security or any other equivalent for the estimated costs of all obligations follow<strong>in</strong>g from the licence<br />

for CO2 s<strong>to</strong>rage. The f<strong>in</strong>ancial security or any other equivalent shall be periodically adjusted <strong>to</strong> take<br />

account of changes <strong>to</strong> the assessed risk of leakage <strong>and</strong> the estimated costs of all obligations aris<strong>in</strong>g<br />

under the licence for s<strong>to</strong>rage of CO2. The f<strong>in</strong>ancial security or any other equivalent shall be valid<br />

<strong>and</strong> effective before commencement of <strong>in</strong>jection <strong>in</strong><strong>to</strong> a CO2 s<strong>to</strong>rage site.<br />

(2) The f<strong>in</strong>ancial security or any other equivalent, see subsection (1), shall rema<strong>in</strong> valid <strong>and</strong><br />

effective:<br />

(i) after a CO2 s<strong>to</strong>rage site has been closed pursuant <strong>to</strong> section 23k(2)(i) <strong>and</strong> (ii) until the<br />

responsibility for the s<strong>to</strong>rage site is transferred <strong>to</strong> the M<strong>in</strong>ister for Climate <strong>and</strong> Energy, see<br />

section 23o; <strong>and</strong><br />

(ii) after the withdrawal of a CO2, s<strong>to</strong>rage licence, see section 23m or section 30(1);<br />

(a) until a new licence for s<strong>to</strong>rage of CO2 has been issued <strong>to</strong> another licensee; or<br />

(b) where the s<strong>to</strong>rage site is closed pursuant <strong>to</strong> section 23n(1) until the transfer of responsibility<br />

has taken place pursuant <strong>to</strong> section 23o, provided the payment stipulated <strong>in</strong> section 23r has<br />

been effected.<br />

(3) The M<strong>in</strong>ister for Climate <strong>and</strong> Energy may lay down more detailed rules <strong>and</strong> regulations<br />

regard<strong>in</strong>g the establishment, adjustment <strong>and</strong> ma<strong>in</strong>tenance of the f<strong>in</strong>ancial security or any other<br />

equivalent <strong>and</strong> regard<strong>in</strong>g the calculation of coverage of such security.<br />

23r.-(1) Before the transfer of responsibility pursuant <strong>to</strong> section 23o, the licensee shall pay an<br />

amount <strong>to</strong> the M<strong>in</strong>ister for Climate <strong>and</strong> Energy <strong>to</strong> cover the expected moni<strong>to</strong>r<strong>in</strong>g costs for a period<br />

of 30 years. No other costs may be imposed follow<strong>in</strong>g the transfer of responsibility, but see section<br />

23s.<br />

(2) The M<strong>in</strong>ister for Climate <strong>and</strong> Energy may lay down more detailed rules <strong>and</strong> regulations regard<strong>in</strong>g<br />

the calculation <strong>and</strong> payment of the costs referred <strong>to</strong> <strong>in</strong> subsection (1) above.<br />

23s. If, before or <strong>in</strong> connection with the transfer of responsibility, the holder of a licence for a CO2<br />

s<strong>to</strong>rage site is guilty of provid<strong>in</strong>g deficient data, has concealed relevant <strong>in</strong>formation, displayed<br />

negligence or deceit or has failed <strong>to</strong> exercise due diligence, the M<strong>in</strong>ister for Climate <strong>and</strong> Energy<br />

shall order the previous licensee <strong>to</strong> pay the costs <strong>in</strong>curred after the transfer of responsibility.<br />

23t.-(1) Potential users are entitled <strong>to</strong> use CO2 transport networks <strong>and</strong> CO2 s<strong>to</strong>rage sites aga<strong>in</strong>st<br />

payment, but see subsection (3).<br />

(2) The prices <strong>and</strong> conditions for transport <strong>in</strong> CO2 transport networks <strong>and</strong> s<strong>to</strong>rage at CO2 s<strong>to</strong>rage<br />

sites pursuant <strong>to</strong> subsection (1) shall be determ<strong>in</strong>ed by the CO2 transport network company <strong>and</strong> the<br />

s<strong>to</strong>rage company, respectively. The companies shall publish their tariffs <strong>and</strong> conditions for use of<br />

CO2 transport networks <strong>and</strong> CO2 s<strong>to</strong>rage sites.
