(2) Licensees shall submit all <strong>in</strong>formation regard<strong>in</strong>g protection of the environment <strong>and</strong> natural resources<br />

that is required for the M<strong>in</strong>ister of Transport <strong>and</strong> Energy’s supervision of the activities covered<br />

by this Act. In this connection, the M<strong>in</strong>ister may order a licensee <strong>to</strong> submit <strong>in</strong>formation about<br />

or make <strong>in</strong>vestigations <strong>in</strong><strong>to</strong> specific matters regard<strong>in</strong>g the protection of natural resources.<br />

(3) The M<strong>in</strong>ister for Climate <strong>and</strong> Energy may not order a licensee <strong>to</strong> submit <strong>in</strong>formation on its actual<br />

or <strong>in</strong>tended suppliers, except where this is done with a view <strong>to</strong> meet<strong>in</strong>g the objectives set out <strong>in</strong><br />

Article 30 of the EU Treaty.<br />

(4) Any <strong>in</strong>formation received by the supervisory authority under subsection (1) above shall be<br />

subject <strong>to</strong> confidentiality; see sections 152, section 152a, the first sentence, <strong>and</strong> section 152c of the<br />

Danish Crim<strong>in</strong>al Code.<br />

27.-(1) Where an imm<strong>in</strong>ent risk of <strong>in</strong>appropriate use or exploitation of the subsoil is deemed <strong>to</strong><br />

exist, the staff of the supervisory authority shall have access, without a prior court order, <strong>to</strong> all parts<br />

of the licensee's bus<strong>in</strong>ess aga<strong>in</strong>st duly show<strong>in</strong>g proof of their identity.<br />

(2) A licence granted <strong>in</strong> pursuance of section 5 above may provide that a representative of the supervisory<br />

authority shall be entitled <strong>to</strong> attend meet<strong>in</strong>gs held by the licensees’ decision-mak<strong>in</strong>g bodies.<br />

Other Provisions<br />

28. Any works <strong>to</strong> be carried out <strong>in</strong> connection with activities covered by this Act, <strong>in</strong>clud<strong>in</strong>g drill<strong>in</strong>g<br />

wells, s<strong>in</strong>k<strong>in</strong>g shafts, <strong>and</strong> driv<strong>in</strong>g adits <strong>and</strong> drifts, may not be <strong>in</strong>itiated until the approval of the<br />

M<strong>in</strong>ister for Climate <strong>and</strong> Energy has been obta<strong>in</strong>ed for equipment, work<strong>in</strong>g programme <strong>and</strong> work<strong>in</strong>g<br />

methods <strong>in</strong> each <strong>in</strong>dividual case.<br />

28a.-(1) <strong>Licences</strong> <strong>and</strong> approvals for offshore projects under this Act that are assumed <strong>to</strong> have a<br />

major impact on the environment may only be granted follow<strong>in</strong>g an assessment of the effects on the<br />

environment <strong>and</strong> after the members of the public, authorities <strong>and</strong> organizations that are affected<br />

have been given an opportunity <strong>to</strong> express their op<strong>in</strong>ion. If the project, either alone or <strong>in</strong> conjunction<br />

with other projects or plans, is assumed <strong>to</strong> have a major impact on designated <strong>in</strong>ternational nature<br />

protection areas, the licence or approval may only be granted follow<strong>in</strong>g an assessment of the<br />

impact of the project on the site, with due consideration paid <strong>to</strong> the objectives for conservation of<br />

the site. If deemed necessary by the M<strong>in</strong>ister for Climate <strong>and</strong> Energy, an assessment of the impact<br />

on the site shall be <strong>in</strong>cluded <strong>in</strong> the material that has been submitted <strong>to</strong> the general public, authorities<br />

<strong>and</strong> organizations for consultation.<br />

(2) When submitt<strong>in</strong>g applications <strong>and</strong> assessments pursuant <strong>to</strong> subsection (1) above, the applicant<br />

shall <strong>in</strong>clude all <strong>in</strong>formation necessary for the consideration of the relevant application or assessment.<br />

For use <strong>in</strong> consider<strong>in</strong>g the application or assessment, the M<strong>in</strong>ister for Climate <strong>and</strong> Energy<br />

may order the applicant <strong>to</strong> submit <strong>in</strong>formation about or make <strong>in</strong>vestigations <strong>in</strong><strong>to</strong> specific matters.<br />

(3) <strong>Licences</strong> or approvals may only be granted pursuant <strong>to</strong> this Act if<br />

(i) the project does not adversely affect the <strong>in</strong>tegrity of an <strong>in</strong>ternational nature protection<br />

area; or<br />

(ii) weighty societal considerations, <strong>in</strong>clud<strong>in</strong>g of a social or economic nature, make it imperative<br />

<strong>to</strong> implement the project because no alternative solutions exist; but see subsection<br />

(4) below.<br />

(4) In case of <strong>in</strong>ternational nature protection areas with a priority natural habitat type or a priority<br />

species, a licence or approval for a project covered by subsection (3)(ii) may only be granted if
