3. ADDRESSEES OF SANCTIONS AND TRANSPARENCY 13<br />

<strong>for</strong> the determ<strong>in</strong>ation <strong>of</strong> f<strong>in</strong>es; however, no f<strong>in</strong>es have so far been imposed on cartels <strong>in</strong> those jurisdictions.<br />

In the US, f<strong>in</strong>es are imposed by courts and the U.S. Sentenc<strong>in</strong>g Guidel<strong>in</strong>es set out advisory sentenc<strong>in</strong>g guidance<br />

<strong>for</strong> the sentenc<strong>in</strong>g <strong>of</strong> convicted defendants <strong>in</strong> the US federal court system, <strong>in</strong>clud<strong>in</strong>g those convicted <strong>of</strong><br />

antitrust <strong>of</strong>fences. In Hungary, certa<strong>in</strong> criteria which must be taken <strong>in</strong>to account when impos<strong>in</strong>g f<strong>in</strong>es are mentioned<br />

<strong>in</strong> the Competition Act. The same applies <strong>in</strong> the Netherlands, which also has a published F<strong>in</strong><strong>in</strong>g Code.<br />

In Japan the criteria <strong>for</strong> the determ<strong>in</strong>ation <strong>of</strong> f<strong>in</strong>es are all stipulated <strong>in</strong> the Antimonopoly Act and Cab<strong>in</strong>et Order<br />

which are accessible to the public, and guidel<strong>in</strong>es are there<strong>for</strong>e considered unnecessary. In Mexico the Federal<br />

Law <strong>of</strong> Economic Competition sets out the elements that shall be considered when impos<strong>in</strong>g the f<strong>in</strong>e and there<br />

are no guidel<strong>in</strong>es or methodology available. In Switzerland the penalty framework is comprised <strong>in</strong> the Federal<br />

Act on <strong>Cartels</strong> and Other Restra<strong>in</strong>ts on Competition (ACart). The ACart Ord<strong>in</strong>ance on sanctions comprises the<br />

methodology and general criteria to consider <strong>in</strong> impos<strong>in</strong>g f<strong>in</strong>es and the Remarks on the ord<strong>in</strong>ance on f<strong>in</strong>es (set<br />

out by the competition authority) further expands on this methodology and criteria.<br />

In some countries, such as France, the ma<strong>in</strong> f<strong>in</strong><strong>in</strong>g criteria are set out by the law (commercial code), but the<br />

French Competition Council has also published a document <strong>in</strong> its 2005 annual report which expla<strong>in</strong>s <strong>in</strong> further<br />

detail how these criteria are implemented.<br />

<strong>Jurisdictions</strong> <strong>in</strong> which the law itself does not set the methodology or pr<strong>in</strong>ciples <strong>for</strong> the determ<strong>in</strong>ation <strong>of</strong> the f<strong>in</strong>e,<br />

but the agency has made guidel<strong>in</strong>es available publicly are: EU, Czech Republic, Jordan and Korea.<br />

In the EU, the European Commission has published guidel<strong>in</strong>es on the determ<strong>in</strong>ation <strong>of</strong> f<strong>in</strong>es concern<strong>in</strong>g<br />

anticompetitive conducts s<strong>in</strong>ce 1998 20 . These guidel<strong>in</strong>es were amended <strong>in</strong> 2006 21 . The rationale <strong>for</strong> the<br />

1998 Guidel<strong>in</strong>es also mentioned <strong>in</strong> the 2006 Guidel<strong>in</strong>es is to ensure the transparency and impartiality <strong>of</strong> the<br />

Commission’s decisions 22 . This must be comb<strong>in</strong>ed with the objective <strong>of</strong> reach<strong>in</strong>g a sufficiently deterrent effect,<br />

not only <strong>in</strong> order to sanction the undertak<strong>in</strong>gs concerned (specific deterrence) but also <strong>in</strong> order to deter other<br />

undertak<strong>in</strong>gs from engag<strong>in</strong>g <strong>in</strong>, or cont<strong>in</strong>u<strong>in</strong>g, behaviour that is contrary to Articles 81 and 82 <strong>of</strong> the EC Treaty<br />

(general deterrence).<br />

The guidel<strong>in</strong>es aim at limit<strong>in</strong>g the Commission’s discretion, which otherwise would only be bound by the statutory<br />

maximum <strong>of</strong> 10% <strong>of</strong> the annual world-wide turnover <strong>of</strong> an undertak<strong>in</strong>g. Accord<strong>in</strong>g to the case-law <strong>of</strong> the<br />

European Court <strong>of</strong> justice, “the Guidel<strong>in</strong>es are an <strong>in</strong>strument <strong>in</strong>tended to def<strong>in</strong>e, while comply<strong>in</strong>g with higherrank<strong>in</strong>g<br />

law, the criteria which the Commission proposes to apply <strong>in</strong> the exercise <strong>of</strong> its discretion when determ<strong>in</strong><strong>in</strong>g<br />

f<strong>in</strong>es, the Commission must <strong>in</strong> fact take account <strong>of</strong> the Guidel<strong>in</strong>es when determ<strong>in</strong><strong>in</strong>g f<strong>in</strong>es, <strong>in</strong> particular<br />

the elements which are mandatory under the Guidel<strong>in</strong>es” 23 .<br />

Although the Hungarian Competition Act conta<strong>in</strong>s some pr<strong>in</strong>ciples about f<strong>in</strong>e calculation, based on these there<br />

is a more detailed guidel<strong>in</strong>e (notice) elaborated and published by the competition agency concern<strong>in</strong>g its f<strong>in</strong>esett<strong>in</strong>g<br />

methodology.<br />

3.2.2 Transparency regard<strong>in</strong>g <strong>in</strong>dividual cases<br />

Concern<strong>in</strong>g specific cartel cases the questionnaire asked whether the actual reason<strong>in</strong>g that leads to the f<strong>in</strong>al<br />

amount <strong>of</strong> a f<strong>in</strong>e is expla<strong>in</strong>ed or published <strong>in</strong> their jurisdictions. The publication <strong>of</strong> the decision impos<strong>in</strong>g pecuniary<br />

sanctions on the undertak<strong>in</strong>gs <strong>in</strong>fr<strong>in</strong>g<strong>in</strong>g substantive antitrust provisions contributes to deter any other<br />

potential <strong>of</strong>fenders from the commitment <strong>of</strong> similar anti-competitive conduct.<br />
