8. INTERACTIONS WITH DIRECT SETTLEMENTS 41<br />

When consider<strong>in</strong>g the option <strong>of</strong> <strong>in</strong>troduc<strong>in</strong>g settlement procedures, it is necessary to balance their possible<br />

drawbacks <strong>in</strong> terms <strong>of</strong> moral justice and deterrence, s<strong>in</strong>ce settl<strong>in</strong>g cartelists may be seen by the public as<br />

escap<strong>in</strong>g the appropriate punishment, with the expected benefits which can be ga<strong>in</strong>ed through settlements.<br />

Although the experience that <strong>ICN</strong> jurisdictions have developed so far <strong>in</strong> the field <strong>of</strong> settlements is still limited<br />

to a handful <strong>of</strong> jurisdictions, the <strong>ICN</strong> members with a settlement system <strong>in</strong> place that participated <strong>in</strong> the <strong>ICN</strong><br />

Cartel settlement paper agree nevertheless that the benefits ga<strong>in</strong>ed from settlements outweigh the additional<br />

charges or penalties that might have been obta<strong>in</strong>ed <strong>in</strong> the absence <strong>of</strong> a settlement system. Transparency and<br />

predictability <strong>in</strong> settlement policy and process appear to be critical to dispell<strong>in</strong>g this public concern. In particular,<br />

penalties and sanctions imposed <strong>in</strong> settlement should cont<strong>in</strong>ue to adequately reflect the seriousness <strong>of</strong> the<br />

settl<strong>in</strong>g party’s conduct. The prosecut<strong>in</strong>g agency should be allowed to use the key evidence provided by the settl<strong>in</strong>g<br />

cartel participants aga<strong>in</strong>st those who do not settle. Another option would be to significantly <strong>in</strong>crease the<br />

penalties <strong>for</strong> repeat<strong>in</strong>g the conduct <strong>in</strong> the future. F<strong>in</strong>ally, it should be recalled that, as already mentioned above,<br />

one <strong>of</strong> the advantages <strong>of</strong> settlement procedures is also to save human and f<strong>in</strong>ancial resources that would have<br />

been <strong>in</strong>vested by the prosecut<strong>in</strong>g agency to detect, f<strong>in</strong>d and, if competent to do so, f<strong>in</strong>e all cartel participants.<br />

These resources are freed to deal with other cartel <strong>in</strong>vestigations, further <strong>in</strong>creas<strong>in</strong>g deterrence.<br />
