The concept <strong>of</strong> basic amount <strong>of</strong> the f<strong>in</strong>e is not common to all jurisdictions as it implies the application <strong>of</strong> a<br />

structured methodology <strong>for</strong> the application <strong>of</strong> f<strong>in</strong>es. Especially <strong>in</strong> jurisdictions where the f<strong>in</strong>al determ<strong>in</strong>ation<br />

<strong>of</strong> the f<strong>in</strong>e is left <strong>for</strong> the courts – see, <strong>for</strong> example, Austria, Ireland and Canada – but also jurisdictions where<br />

f<strong>in</strong>es are set by the Competition Authority – see <strong>for</strong> example Norway, there does not appear to exist any specific<br />

f<strong>in</strong><strong>in</strong>g-sett<strong>in</strong>g methodology; f<strong>in</strong>es are thus determ<strong>in</strong>ed on the basis <strong>of</strong> certa<strong>in</strong> relevant factors which are<br />

considered <strong>in</strong> no specific order, however some <strong>of</strong> them may play a bigger role (such as volume <strong>of</strong> commerce<br />

<strong>in</strong> Canada or turnover <strong>in</strong> Ireland).<br />

Yet, most jurisdictions are acqua<strong>in</strong>ted with the concept <strong>of</strong> basic amount, at least <strong>in</strong> respect <strong>of</strong> penalties which<br />

are applied to companies 35 .<br />

By and large, all respond<strong>in</strong>g authorities recognise that the amount <strong>of</strong> the f<strong>in</strong>e depends on the gravity (16<br />

replies) <strong>of</strong> the <strong>in</strong>fr<strong>in</strong>gement. There seems to be consensus that hard-core cartels represent, by their very<br />

nature, the most serious <strong>for</strong>ms <strong>of</strong> anti-competitive behaviours. More specific factors can however come <strong>in</strong>to<br />

play (generally imp<strong>in</strong>g<strong>in</strong>g on the determ<strong>in</strong>ation <strong>of</strong> the gravity/seriousness <strong>of</strong> the <strong>in</strong>fr<strong>in</strong>gement). For example, <strong>in</strong><br />

Turkey, the market power <strong>of</strong> the undertak<strong>in</strong>gs is also taken <strong>in</strong>to account <strong>in</strong> the determ<strong>in</strong>ation <strong>of</strong> the f<strong>in</strong>e. Mexico<br />

values the degree <strong>of</strong> premeditation. In Hungary the characteristics <strong>of</strong> the market (e.g. whether it is contestable<br />

or not) as well <strong>of</strong> the characteristics <strong>of</strong> the product or the consumers (whether the product is essential<br />

<strong>for</strong> the consumer, whether some especially vulnerable consumer group is affected, if there is a spill-over effect<br />

on other markets) are also taken <strong>in</strong>to account. In the EC, <strong>in</strong> assess<strong>in</strong>g the basic amount <strong>of</strong> the f<strong>in</strong>e, various<br />

factors are taken <strong>in</strong>to account such as the nature <strong>of</strong> the <strong>in</strong>fr<strong>in</strong>gement, the comb<strong>in</strong>ed market share <strong>of</strong> all undertak<strong>in</strong>gs<br />

concerned by the cartel, the geographic scope <strong>of</strong> the <strong>in</strong>fr<strong>in</strong>gement and whether or not the <strong>in</strong>fr<strong>in</strong>gement<br />

has been rigorously implemented.<br />

5.1 Basis <strong>for</strong> calculation<br />

(Percentage <strong>of</strong> turnover/volume <strong>of</strong> commerce/market shares/illicit ga<strong>in</strong>)<br />

It can be observed that a great majority <strong>of</strong> the authorities refer to the turnover/volume <strong>of</strong> affected commerce <strong>of</strong><br />

the undertak<strong>in</strong>g as the basis <strong>for</strong> the calculation <strong>of</strong> the f<strong>in</strong>e, the general view be<strong>in</strong>g that this concept provides a<br />

good proxy <strong>for</strong> assess<strong>in</strong>g the gravity <strong>of</strong> the behaviour, both <strong>in</strong> terms <strong>of</strong> (presumed) damage to consumers and<br />

illicit ga<strong>in</strong>. Furthermore, such data is relatively easy to obta<strong>in</strong>.<br />

However authorities do not always refer to the same amount or concept <strong>of</strong> turnover (<strong>in</strong> this respect see chapter<br />

4) 36 . In some jurisdictions (13 out <strong>of</strong> 22), the turnover used as basis <strong>for</strong> the calculation <strong>of</strong> the sanction is the<br />

value <strong>of</strong> sales <strong>of</strong> the products/services concerned by the <strong>in</strong>fr<strong>in</strong>gement. In such jurisdictions the identification<br />

<strong>of</strong> volume <strong>of</strong> commerce concerned will be <strong>of</strong> high importance, as it impacts on the level <strong>of</strong> the f<strong>in</strong>e imposed.<br />

Other jurisdictions consider global turnover or national turnover. In Serbia, <strong>for</strong> <strong>in</strong>stance, the global turnover <strong>of</strong><br />

the undertak<strong>in</strong>g is taken <strong>in</strong>to account whereas <strong>in</strong> Brazil, the Brazilian turnover is taken <strong>in</strong> consideration. In<br />

Brazil the f<strong>in</strong>e must by no means be lower than the advantage obta<strong>in</strong>ed from the underly<strong>in</strong>g violation, if the<br />

advantage is measurable. In Turkey, recent amendments <strong>in</strong> the Competition Act replaced fixed amounts <strong>of</strong><br />

procedural f<strong>in</strong>es with f<strong>in</strong>es calculations based on annual gross revenue provided that they are no less than<br />

10000 Turkish liras.<br />

The benefit result<strong>in</strong>g from the violation <strong>of</strong> the competition law is <strong>in</strong> fact considered by 9 competition authorities.<br />

Accord<strong>in</strong>g to the Hungarian guidel<strong>in</strong>es any f<strong>in</strong>e calculation is superseded if the ga<strong>in</strong>s derived from the <strong>in</strong>fr<strong>in</strong>gement<br />

may be quantified. In these situations – <strong>in</strong> order to ensure the “sufficiently deterrent effect”, the amount<br />
