fine to avoid b<strong>on</strong>d forfeiture, he or she must pay in pers<strong>on</strong> and provide photo identificati<strong>on</strong>. Yet,<br />

where <strong>the</strong> underlying fine is less than <strong>the</strong> b<strong>on</strong>d amount—a comm<strong>on</strong> occurrence—<strong>the</strong> City does<br />

not immediately refund <strong>the</strong> difference to <strong>the</strong> individual. Ra<strong>the</strong>r, pursuant to a directive issued by<br />

<strong>the</strong> current City Finance Director approximately four years ago, b<strong>on</strong>d refunds cannot be made in<br />

pers<strong>on</strong>, and instead must be sent via mail. According to Fergus<strong>on</strong>’s Court Clerk, it is not entirely<br />

uncomm<strong>on</strong> for <strong>the</strong>se refund checks to be returned as undeliverable and become “unclaimed<br />

property.”<br />

C. Fergus<strong>on</strong> Law Enforcement Practices Disproporti<strong>on</strong>ately Harm Fergus<strong>on</strong>’s<br />

African-American Residents and Are Driven in Part by Racial Bias<br />

Fergus<strong>on</strong>’s police and municipal court practices disproporti<strong>on</strong>ately harm African<br />

Americans. Fur<strong>the</strong>r, our investigati<strong>on</strong> found substantial evidence that this harm stems in part<br />

from intenti<strong>on</strong>al discriminati<strong>on</strong> in violati<strong>on</strong> of <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>.<br />

African Americans experience disparate impact in nearly every aspect of Fergus<strong>on</strong>’s law<br />

enforcement system. Despite making up 67% of <strong>the</strong> populati<strong>on</strong>, African Americans accounted<br />

for 85% of FPD’s traffic stops, 90% of FPD’s citati<strong>on</strong>s, and 93% of FPD’s arrests from 2012 to<br />

2014. O<strong>the</strong>r statistical disparities, set forth in detail below, show that in Fergus<strong>on</strong>:<br />

African Americans are 2.07 times more likely to be searched during a vehicular<br />

stop but are 26% less likely to have c<strong>on</strong>traband found <strong>on</strong> <strong>the</strong>m during a search.<br />

They are 2.00 times more likely to receive a citati<strong>on</strong> and 2.37 times more likely to<br />

be arrested following a vehicular stop.<br />

African Americans have force used against <strong>the</strong>m at disproporti<strong>on</strong>ately high rates,<br />

accounting for 88% of all cases from 2010 to August 2014 in which an FPD<br />

officer reported using force. In all 14 uses of force involving a canine bite for<br />

which we have informati<strong>on</strong> about <strong>the</strong> race of <strong>the</strong> pers<strong>on</strong> bitten, <strong>the</strong> pers<strong>on</strong> was<br />

African American.<br />

African Americans are more likely to receive multiple citati<strong>on</strong>s during a single<br />

incident, receiving four or more citati<strong>on</strong>s <strong>on</strong> 73 occasi<strong>on</strong>s between October 2012<br />

and July 2014, whereas n<strong>on</strong>-African Americans received four or more citati<strong>on</strong>s<br />

<strong>on</strong>ly twice during that period.<br />

African Americans account for 95% of Manner of Walking charges; 94% of all<br />

Fail to Comply charges; 92% of all Resisting Arrest charges; 92% of all Peace<br />

Disturbance charges; and 89% of all Failure to Obey charges. 38<br />

African Americans are 68% less likely than o<strong>the</strong>rs to have <strong>the</strong>ir cases dismissed<br />

by <strong>the</strong> Municipal Judge, and in 2013 African Americans accounted for 92% of<br />

cases in which an arrest warrant was issued.<br />
