to become law enforcement<br />

He said police officers<br />

have to develop multiple<br />

skills to deal with the complexity<br />

of the issues they<br />

encounter on a daily basis<br />

Cuban Ambassador condemns US<br />

of the United Nations,<br />

Cuban Ambassador to Antigua<br />

and Barbuda is reminding<br />

residents that despite<br />

improved relations over the<br />

last 18-months, the United<br />

States’ economic blockade<br />

of the Spanish-speaking island<br />

continues.<br />

In a CT exclusive, Ambassador<br />

Gustavo Veliz<br />

Olivares, said his country<br />

is on a mission to sensitise<br />

the people of the <strong>Caribbean</strong><br />

of the continued imposition<br />

of the economic, commercial<br />

and financial embargo<br />

against Cuba in spite several<br />

UN resolutions calling for<br />

the lifting of the sanctions.<br />

“I must bring to the attention<br />

of the people of Antigua<br />

and Barbuda, and indeed the<br />

entire CARICOM region,<br />

that Resolution 70/5 of the<br />

United Nations General Assembly<br />

makes the case for<br />

surrounding a possible drowning incident,<br />

which took place at Dickenson Bay<br />

late Saturday evening into early Sunday<br />

morning.<br />

It is alleged that a US medical student<br />

and his fiancé went to Dickenson Bay late<br />

Saturday evening for a swim. It is further alleged<br />

that the man went into the water, while<br />

his female companion remained ashore.<br />

Reports are that within a short space<br />

of time the man disappeared in the water,<br />

prompting his fiancé to call the police. Divers<br />

Ambassador Olivares<br />

in favour of lifting the U.S<br />

blockade of Cuba.<br />

“The economic damage<br />

caused to the Cuban people,<br />

based on very conservative<br />

estimates and taking into<br />

account the depreciation of<br />

the US dollar against gold<br />

in the international market,<br />

amounts to $735 billion.<br />

Between March 2015 and<br />

March <strong>2016</strong>, the cost of the<br />

sanctions to Cuba amounted<br />

$4 billion in today’s prices,”<br />

he explained.<br />

According to the Ambassador<br />

many people in<br />

Antigua who have been<br />

following the news would<br />

know that the US and Cuba<br />

have reestablished diplomatic<br />

relations and that there<br />

have been more contacts<br />

between both countries in<br />

recent times. However, he<br />

said while President Obama<br />

has repeatedly asked the US<br />

Congress to vote to lift the<br />

sanctions, this has not been<br />

done. “The embargo constitutes<br />

a basic obstacle to the<br />

process aimed at normalizing<br />

of relations between<br />

the two countries,” a Cuban<br />

government statement said.<br />

It said Washington continues<br />

to ban exports to Cuba<br />

of products and equipment<br />

important to key sectors of<br />

the economy. Additionally,<br />

Cuba is barred from exporting<br />

products and services to<br />

the US and it is not allowed<br />

to have direct banking relations<br />

with the US or, except<br />

for telecommunications, allowed<br />

to receive US investments<br />

in other sectors of the<br />

economy.<br />

Police probe possible drowning<br />

were called in to assist the police in their<br />

search, however because of the poor lighting<br />

conditions the search had to be called off.<br />

Early Sunday morning the Police and<br />

the Coast Guard resumed their search, and<br />

around 5:40 am, his lifeless body was found<br />

washed ashore on Dickenson Bay, in the<br />

vicinity of Grande Sandals Resort Antigua.<br />

The police said that there is nothing to suggest<br />

foul play; however further investigations<br />

are currently ongoing into the matter.<br />

He was a student of the American University<br />

of Antigua (AUA), and last resided at Hodges<br />

Bay.<br />

have resumed between the<br />

two countries only twelve<br />

categories of US citizens<br />

are allowed to travel to the<br />

the country’s delegation to<br />

the general assembly and he<br />

is expected to re-affirm unequivocal<br />

support for lifting<br />

of the US embargo against<br />

Cuba.<br />

Public Safety Minister, Steadroy<br />

Benjamin, said government is to allocate<br />

more resources to the police force<br />

to strengthen its crime fighting capabilities.<br />

Minister Benjamin was at the time<br />

speaking at the Officers’ Mess Dinner<br />

held at the Jolly Beach Hotel Friday<br />

night as part of activities to mark Police<br />

Week <strong>2016</strong>.<br />

He recalled that when the ABLP Administration<br />

took office back in 2014<br />

there was much criminal activity taking<br />

place, but that there have been brought<br />

under control through sustained efforts<br />

of the police with much assistance from<br />

the government.<br />

“When we took over, morale in the<br />

police was low, interest was low and<br />

police officers were walking around<br />

seemingly just waiting for the next payday,”<br />

he noted. He said a careful look at<br />

the problem revealed that among other<br />

thing, there was very little promotions<br />

taking place in the force. This, he said,<br />

was corrected immediately.<br />

Additionally, he said the police were<br />

presented with the tools to do their job,<br />

including several motor vehicles to enable<br />

them to properly patrol the country<br />

at night. Secondly, the minister noted,<br />

officers were also exposed to more<br />

training.<br />

“Today, don’t we have a safe society?”<br />

he asked, “Between January and<br />

<strong>September</strong> this year we have only had<br />

3 serious crimes (murder). Compared<br />

with other <strong>Caribbean</strong> territories, you<br />

are beginning in the 20’s. Something is<br />

happening right, in this country. Congrats<br />

to the Commissioner and his men<br />

for the fine job they are doing.”<br />

Benjamin said the government will<br />

present twelve additional vehicles to<br />

the police this week and the government<br />

has agreed to spend more money<br />

training officers to enable them to<br />

be better able to combat cyber-crimes.<br />

“We know that this is a new area of<br />

criminal activity and we want to be<br />

sure that our officers have the skills to<br />

fight these criminals who seek to hack<br />

credit cards and the like,” he explained.<br />

in place to keep crime in check over the<br />

next year.<br />

Robinson also used the opportunity<br />

to hand out Meritorious awards to the<br />

four officers – led by Inspector Ray<br />

John – were engaged the three criminals<br />

in the deadly shoot out last year.<br />

The incident followed armed robberies<br />

at APUA and Tri-Star travel agent on<br />

the Old Parham Road. At the end of<br />

the exchanges, all three suspects were<br />

killed. None of the officers suffered injuries.<br />

street, told police that<br />

she arrived at the store at<br />

about 8:00 a.m. on <strong>Monday</strong>,<br />

<strong>September</strong> 5th, <strong>2016</strong> to<br />

discover that the wooden cage<br />

housing the drink crates was<br />

open. The padlock was still<br />

A 43-year old woman has been<br />

deemed unfit to provide parental authority<br />

and supervise her teenage daughter.<br />

The 13-year old girl will be removed<br />

from her mother’s home in Codrington<br />

Village Barbuda and be placed in a<br />

more controlled environment in Antigua.<br />

The teen was brought before the court<br />

in June of this year after she orchestrated<br />

a series of home break-ins in Barbuda<br />

between March 1st, <strong>2016</strong> and April<br />

21st, <strong>2016</strong>; she along with her mother<br />

and another 14-year old boy were jointly<br />

charged with three counts of house<br />

break-In and larceny, and one count of<br />

malicious damage; the girl also faced another<br />

separate charge of house break-in<br />

and Larceny. A fourth individual, an 18<br />

year-old male, was also charged for ‘receiving’<br />

stolen items in the same matter.<br />

Over $30,000.00EC worth of cash,<br />

electronic devices and other personal<br />

items were reported stolen from four<br />

homes, to include that of Barbuda’s representative<br />

politician Arthur Nibbs. Mr.<br />

Nibbs left his home secured on April<br />

13th, <strong>2016</strong> and found his house ransacked<br />

upon his return on April 15th; it<br />

is reported that the defendants gained<br />

entry by removing a bathroom window<br />

gauze. Reported stolen were $300.00 in<br />

coins, one laptop and two cellular phones<br />

among other things, all to the value of<br />

$3,900.00EC.<br />

The Juveniles were arrested following<br />

the last report made on April 21st at<br />

6:45 p.m. by Frederigue Marie, a French<br />

National residing in Barbuda. She reported<br />

stolen $14,000.00EC in cash, an iPad<br />

and a wallet among other things, all valued<br />

at $18,800.00EC<br />

The girl’s mother was also arrested<br />

and jointly charged after several<br />

of the stolen items were found in her<br />

home, however during investigations police<br />

determined that the woman had no<br />

involvement, as such the charges were<br />

dismissed against her.<br />

Further investigations revealed that<br />

a large portion of the monies stolen was<br />

Last Thursday at the St. John’s Magistrates<br />

Court, Owen Williams of Cassada<br />

Gardens pleaded guilty to unlawful possession<br />

of cocaine.<br />

Williams was nabbed with 4.3 grams of<br />

the illicit substance following a search warrant<br />

executed at his premises last week on<br />

<strong>September</strong> 13th. While searching a ledge<br />

in the defendant’s kitchen, police found a<br />

plastic bag with several individually wrapped<br />

secured but one side of the<br />

structure was knocked out and<br />

two crates missing.<br />

Joseph was arrested on<br />

<strong>September</strong> 14th and admitted<br />

to the offence. He pleaded<br />

guilty to larceny, and<br />

malicious damage when he<br />

appeared before Magistrate<br />

Clarke at the District ‘A’ Court<br />

used to purchase food items and cellular<br />

phones. $4,528.30 cash along with a<br />

small portion of stolen items were recovered.<br />

The juveniles were given restitution<br />

orders when they first appeared before<br />

Magistrate Wason in the District ‘C’<br />

Courtroom in June; they were further<br />

prescribed probation and sentencing was<br />

postponed to await a probation report.<br />

All parties appeared before Magistrate<br />

Wason at the District ‘C’ Magistrate<br />

Court last week <strong>September</strong> 15th where<br />

an oral probation investigation report<br />

was heard. Probation officers says the<br />

girl’s home is not conducive to her development<br />

and learning. The mother too has<br />

agreed that the child be placed in a better<br />

learning environment where she can<br />

receive supervision. It has been recommended<br />

that she be placed at the Princess<br />

Margaret Secondary School where<br />

it is expected that she will excel, was the<br />

court’s ruling.<br />

Though the court heard that the girl is<br />

currently being investigated in yet another<br />

house break-in reported just recently.<br />

Bolans man jailed for stealing<br />

last Thursday.<br />

He was convicted and sentenced<br />

to four months in prison<br />

on each charge, sentences<br />

will run concurrently.<br />

Man pays for drug offence<br />

foil containing crack cocaine. The defendant<br />

told the lawmen that his girlfriend, who was<br />

present during the search, is not involved<br />

in anyway reportedly stating “Officer is my<br />

stuff, she don’t know anything about them”.<br />

The substance carries an estimated street<br />

value of $200.00EC.<br />

The defendant pleaded guilty before<br />

Magistrate Clarke and was ordered to pay<br />

a fine of $1,000.00 forthwith or serve four<br />

months at Her Majesty’s Prison.

Generation Y (the Youth arm of<br />

a donation of clothing to the Antigua<br />

& Barbuda Red Cross Society’s Thrift<br />

Shop.<br />

During the brief handover, President<br />

of Halo Generation Y, Brent Scotland,<br />

commended the Red Cross on the<br />

exceptional work being done to assist<br />

those in need. He noted that the Thrift<br />

Shop is indeed an economical way for<br />

people to source both gently used and<br />

new items.<br />

“What is even more impressive” he<br />

continued, “is that Red Cross is headed<br />

here in Antigua by a young and dynamic<br />

so lacking that it results in<br />

some embarrassing situations<br />

Bumper cruise season ahead<br />

The upcoming winter<br />

cruise season is shaping up to<br />

be one of the best that Antigua<br />

and Barbuda will enjoy<br />

in recent years.<br />

President of the Cruise<br />

Tourism Association, Nathan<br />

Dundas, said six new cruise<br />

ships are scheduled to call at<br />

Antigua during the <strong>2016</strong>-17<br />

bring more visitors to the island<br />

than during the 2015-16<br />

season.<br />

“We anticipate that there<br />

will be an estimated 10 percent<br />

increase in passengers<br />

arriving in Antigua even<br />

though the number of calls<br />

may decrease. That’s because<br />

bigger ships carrying more<br />

passengers will arrive at the<br />

port,” he disclosed.<br />

Dundas said this is one<br />

of the ways the industry uses<br />

to judge whether or not there<br />

will be a good season.<br />

“With six new vehicles<br />

coming in with the major one<br />

being the Anthem of the Seas<br />

from Royal <strong>Caribbean</strong>.<br />

“It will be the first quantum<br />

class vessel that will be<br />

calling at Antigua. A vessel<br />

that will bring over five thousand<br />

passengers into our port.<br />

Already, we are seeing the<br />

enhancement taking place<br />

at the Heritage Quay pier in<br />

preparation for the vessel,” he<br />

noted.<br />

According to Dundas a<br />

commitment was given to<br />

Royal <strong>Caribbean</strong> that the port<br />

will be ready to accommodate<br />

the Anthem of the Seas<br />

by its date of arrival, December<br />

2.<br />

The improvements include<br />

extending the pier by<br />

600 feet as well as dredging<br />

of the harbor as part of what<br />

he termed ‘major work’ to<br />

be done to accommodate the<br />

vessel.<br />

The cruise official said<br />

much is riding on the country’s<br />

ability to deliver on time<br />

as it will have an impact on<br />

whether more of the quantum<br />

or oasis class of vessels call at<br />

Antigua.<br />

Dundas indicated that both<br />

the St John’s Development<br />

Corporation and the Antigua<br />

Pier Group both of which are<br />

overseeing the work, are on<br />

record stating that the work<br />

will be completed.<br />

He noted that it is important<br />

to have a successful<br />

launch as it will also positively<br />

impact the summer season<br />

as well.<br />

Minister to explore<br />

new housing prospects<br />

The twin island state will be represented at the 5th China-Eurasia<br />

Expo that will open from <strong>September</strong> 20th to 25th,<br />

<strong>2016</strong> in Urumqi, Xinjiang, China.<br />

The forum is designed as a platform for cooperation and<br />

communication for developing states like Antigua and Barbuda.<br />

While attending the China-Eurasia Expo, Minister of Works<br />

and Housing, the Hon. Eustace Lake, will hold meetings with<br />

officials from TBEA Co., LTD, the organizers of the China Eurasia<br />

Expo Scientific and Technology Cooperation forum.<br />

TBEA is a world leader in the equipment manufacturing<br />

industry that provides high value added products and services<br />

that focuses on green technology, and environmentally friendly<br />

products for China and the world.<br />

The works and Housing Minister said: “The Republic of<br />

China has made significant strides with the development of<br />

modern industrial systems that Antigua and Barbuda can benefit<br />

from.<br />

“During the Expo I will be holding meetings with various<br />

business groups to explore avenues of housing and infrastructural<br />

development for Antigua and Barbuda.<br />

“I believe that meetings such as these will seek to advance<br />

win-win cooperation between Antigua and Barbuda and the<br />

Republic of China. My focus will be on advancing efforts to<br />

improve the country’s housing stock,” the Minister stated.

Tourism Minister, the Hon.<br />

Asot Michael has indicated<br />

that government is investing<br />

significantly to improve<br />

the country’s cruise product<br />

ahead of the start of the <strong>2016</strong>-<br />

2017 Cruise Tourism Winter<br />

Season.<br />

He emphasized that plans<br />

are well in motion for the development<br />

of the St John’s<br />

Harbour to include the extensions<br />

of the piers, which will<br />

accommodate larger vessels,<br />

along with the construction<br />

of an additional pier. This will<br />

make provisions for up to six<br />

ships to be berthed simultaneously.<br />

The Tourism Minister asserted<br />

that the new the quayside<br />

will have the added benefits<br />

of new high-end shopping<br />

and facilities to include: a<br />

cruise passenger terminal to<br />

re-position the destination to<br />

advantage of home porting<br />

opportunities.<br />

He also expressed his<br />

happiness with the recent announcement<br />

that the vessel<br />

Zenith from the Pullmantur<br />

cruise lines will be facilitating<br />

embarkation at Heritage Quay<br />

beginning in December.<br />

“We are actively pursuing<br />

opportunities to be a homeport<br />

with several European<br />

based cruise lines in an effort<br />

to diversify our cruise ship offering.<br />

I am pleased to report<br />

that the Pullmantur will make<br />

19 calls this season and will<br />

be offering home porting services<br />

from Antigua and Barbuda<br />

for the first time”, said<br />

Minister Michael.<br />

The Government is also<br />

investing in the Fort James<br />

Development project to leverage<br />

the strength of one of the<br />

country’s best beaches by including<br />

authentic local restaurants,<br />

boutiques, tours and<br />

attractions, an outdoor amphitheatre,<br />

world class Water<br />

Park and a museum detailing<br />

the history of the Fort.<br />

He emphasized that all of<br />

the destination’s products, investments<br />

and enhancements<br />

ultimately add value and improve<br />

customers’ experience.<br />

“We must continue to improve<br />

our amenities in the area<br />

of fine dining, exciting tours<br />

and excursions, first class entertainment,<br />

and International<br />

standard of duty free shopping.<br />

These enhancements are<br />

all priority areas of consideration<br />

for the Government. It<br />

is imperative that Antigua and<br />

Barbuda offers a memorable<br />

and unique visitor experience,<br />

not as a one-off outcome, but<br />

as an all the time phenomenon”,<br />

he pointed out.<br />

Local police officers head to St Kitts<br />

A contingent from the Royal Police<br />

Force of Antigua and Barbuda is in St<br />

Kitts to help with crime fighting activities<br />

on that <strong>Caribbean</strong> island.<br />

Police Commissioner Wendel Robinson<br />

announced that six officers from<br />

the Rapid Response Unit and two from<br />

the Antigua and Barbuda Defense<br />

Force traveled to Basseterre Saturday<br />

night to be part of a regional force assisting<br />

with combating serious crimes<br />

in St Kitts.<br />

He said the St Kitts-Nevis government<br />

made a request for assistance<br />

through the Regional Security System<br />

(RSS) which embraces all of the OECS<br />

territories and Barbados. The RSS was<br />

set up to assist crime fighting and drug<br />

interdiction throughout the sub-region.<br />

The Antigua and Barbuda contingent<br />

is joining other soldiers and police<br />

officers from the RSS territories on this<br />

special assignment in St Kitts.<br />

Robinson said the men will be in<br />

buildings are of major concern<br />

to the residents in some<br />

sections of Sutherlands.<br />

One stretch of road that<br />

sits between Toy Box and<br />

Alkran Hardware is of particular<br />

concern. The bush at<br />

various points on this road is<br />

uncomfortably thick.<br />

At this time, it is not merely<br />

about mosquito breeding,<br />

but more so safety issues.<br />

Several people have reported<br />

seeing suspicious activities<br />

taking place on this<br />

St Kitts for three weeks in the first instance,<br />

but it is likely that their time<br />

may be extended.<br />

Serious crimes in St Kitts has been<br />

spiraling out of control for the past several<br />

years.<br />

Thick bush, abandoned<br />

buildings concern residents<br />

said road.<br />

One woman reported seeing<br />

a man running into the<br />

bush with a yellow shirt and<br />

coming back out with a white<br />

one. Further up the road there<br />

has been several sightings of<br />

men either lurking in the dark<br />

or hiding in the bush.<br />

“I drove home from the<br />

supermarket one night a few<br />

weeks ago and I could see<br />

from where I had parked that<br />

someone was hiding in the<br />

bush, “ a female in that area<br />

said.<br />

She added that after immediately<br />

shining her light in that<br />

direction a fair skin man carrying<br />

a knapsack walked pass<br />

her vehicle staring intently<br />

inside.<br />

One of her neighbour’s<br />

apartment incidentally had<br />

just been broken into, and she<br />

theorizes that the bush may<br />

have played a role in that.<br />

It is understood that a businessman<br />

who resides in that<br />

area also had to call the police<br />

on a few occasions, due to<br />

suspicious movements.<br />

Further, reports are that<br />

the said condition existed on<br />

Ray John will be traveling to<br />

Belize next month to undergo a sixweek<br />

training in jungle warfare. That<br />

training programme is also organized<br />

by the RSS.<br />

which will allow 50 teachers to pursue<br />

studies in the area of Special Needs Education.<br />

This will be the first group of educators<br />

to attend the university as a result<br />

of the agreement.<br />

Education Minister, the Hon. Michael<br />

Browne while speaking during the short<br />

ceremony held at the Ministry’s headquarters,<br />

expressed his profound gratitude<br />

to the USC for assisting the government<br />

and making the studies possible.<br />

“We want to thank USC for rising to<br />

the challenge and not only meeting the<br />

needs that we presented to them but going<br />

beyond the extra mile in anticipating<br />

some of the areas that we had not even<br />

yet presented. We celebrate this partnership<br />

that we are about to embark on”, he<br />

“This will be the first type of degree<br />

of this sort in the region.<br />

“The additional two years for the<br />

students who would have already gotten<br />

wide range of special needs courses”, he<br />

CCJ: Ten years in<br />

‘The case for a <strong>Caribbean</strong> Court of<br />

Appeal would ultimately come to rest<br />

on the most profound argument from<br />

sovereignty: our right of self-definition.<br />

And this could never come from<br />

the great imperial court of the British<br />

Empire but, rather, from an institution<br />

of our own making.’ -Professor Simeon<br />

McIntosh (2002)<br />

Over 100 years ago, a Jamaican editorial<br />

first mooted the concept of a final<br />

appellate court comprising Commonwealth<br />

<strong>Caribbean</strong> jurists who would<br />

hear appeals from across the Anglophone<br />

<strong>Caribbean</strong>. This editorial also<br />

expounded on arguments against the<br />

Judicial Committee of the Privy Council<br />

(hereinafter JCPC) as the region’s<br />

final appellate court which would ultimately<br />

become central to debates on<br />

the possible creation of a <strong>Caribbean</strong><br />

supreme court. These included the delays<br />

experienced when making a case<br />

to the JCPC; the disregard for some of<br />

the regions’ customs and culture by the<br />

JCPC; the inconvenient procedures in<br />

connection with the JCPC; the expenses<br />

incurred to make an appeal to the<br />

JCPC and; the approach used by the<br />

JCPC when delivering judgments.<br />

After this editorial, there followed<br />

sporadic deliberations, discussions<br />

and debates on this notion amongst the<br />

region’s academics, lawyers, judges,<br />

governments and citizens.<br />

PART I: Introduction<br />

However, it was only in 2001 during<br />

the increased levels of regional integration<br />

within the <strong>Caribbean</strong> Community<br />

(hereinafter CARICOM) resulting from<br />

the Revised Treaty of Chaguaramas,<br />

and the inception of the CARICOM<br />

Single Market and Economy [hereinafter<br />

CSME]), that ten (10) CARICOM<br />

Member States materialized this idea<br />

of a regional final appellate court by<br />

way of the Agreement Establishing the<br />

<strong>Caribbean</strong> Court of Justice (hereinafter<br />

the Agreement). And in 2005, this<br />

court was formally inaugurated in Port<br />

of Spain, Trinidad.<br />

This court was named the <strong>Caribbean</strong><br />

Court of Justice (hereinafter CCJ<br />

or the Court). The CCJ has two types<br />

of jurisdictions as outlined in Article<br />

III of the Agreement which are both<br />

final in nature. Its original jurisdiction<br />

is exercised in matters needing the interpretation<br />

and application of the laws<br />

of CARICOM specifically the Revised<br />

Treaty of Chaguaramas. This original<br />

jurisdiction is a compulsory one on all<br />

Member States which needs no further<br />

agreement by a Member State.<br />

The CCJ’s second jurisdiction is<br />

an appellate one. This jurisdiction is<br />

where the Court acts as a court of last<br />

resort for any Member State or any<br />

other <strong>Caribbean</strong> country invited by<br />

CARICOM. Its appellate jurisdiction is<br />

not compulsory. Therefore, any ‘Contracting<br />

Party’ desirous of acceding to<br />

CCJ’s appellate jurisdiction must do so<br />

in accordance with its domestic laws.<br />

To date, there are only four (4) Members<br />

States which have acceded to the<br />

CCJ’s appellate jurisdiction, namely<br />

Barbados, Belize, Dominica, and Guyana.<br />

The Agreement also provides for<br />

the CCJ’s composition, specifying that<br />

there be a President and a maximum<br />

of nine (9) additional Judges. The current<br />

composition of the CCJ is seven<br />

(7) Judges including its President. Additionally,<br />

the funding of the CCJ is<br />

completely insulated from the political<br />

interference of the Governments of the<br />

Member States as it is funded by a US<br />

$100 million Trust Fund which aids in<br />

its endeavours to be judicially independent.<br />

This monetary framework of the<br />

CCJ makes it quite distinctive as it is<br />

the only integration court with such an<br />

arrangement.<br />

This dissertation will focus on the<br />

The aims of this dissertation will be to:<br />

provide brief historical steps leading up<br />

to the establishment of the CCJ; outline<br />

in detail the historical arguments for<br />

and against the CCJ; analyse the constitutional<br />

constraints that Members<br />

States face in their attempts to accede<br />

to the CCJ’s appellate jurisdiction; and<br />

critically evaluate whether or not, after<br />

ten (10) years, certain historical arguments<br />

for the CCJ have been or are<br />

being realised (such as a greater access<br />

to justice under the CCJ [relative to access<br />

under the JCPC], and the extent to<br />

which there is now a unique <strong>Caribbean</strong><br />

jurisprudence).

Holder told to perform or risk removed as Captain.<br />

The warning came just days after Phil Simmons was sacked<br />

as head coach of the West Indies team on the eve of their departure<br />

to the United Arab Emirates where they will take on<br />

Pakistan in an ODI and test series.<br />

According to reliable sources, Chairman of selectors Barbadian<br />

Born Courtney Browne was given a serious talk or dressing<br />

down about his performances in the longer version of the<br />

game, stating that he risked been removed if his performance<br />

does not improve in the upcoming series.<br />

The West Indies captain and Barbados all-rounder performance<br />

since been appointed as captain is nothing to write home<br />

about. He replaced the Trinidadian wicketkeeper batsman Denesh<br />

Ramdin a year ago to become the second youngest test<br />

captain in West Indies test history and the 15th youngest of all<br />

time in test cricket history.<br />

However, Holder is yet to lead the <strong>Caribbean</strong> side in a winning<br />

series after three series, his record shows he lost two nil to<br />

Sri Lanka, two nil to Australia and also two nil to India in a rain<br />

affected series.<br />

The 24-year old Holder has so captained the West Indies in<br />

nine test matches losing six and drawing three. However, it was<br />

revealed that chairman of selectors Browne and the selection<br />

panel is not fully convinced that he should be removed as the<br />

team leader.<br />

The West Indies start their tour against Pakistan with a warm<br />

up match against an Emirates Cricket Board X1 next Tuesday.<br />

Russell in West Indies T20 squad<br />

Fast bowler Kesrick Williams has<br />

been called into the West Indies T20<br />

squad for the three-match series against<br />

Pakistan beginning on <strong>September</strong> 23 in<br />

Dubai as a replacement for allrounder<br />

Andre Russell. According to a release<br />

sent out by the West Indies Cricket<br />

Board, Russell “asked to withdraw<br />

from the series to attend to a personal<br />

matter”.<br />

Despite playing just nine first-class<br />

games and six List A matches in his<br />

career, the last of which came in 2014,<br />

Williams emerged as a consistent<br />

threat in this year’s <strong>Caribbean</strong> Premier<br />

League, playing for the champions Jamaica<br />

Tallawahs.<br />

Williams, 26, was a bargain after<br />

being drafted in the 13th round for a<br />

price of just $5000 before going on<br />

to finish third overall with 17 wickets<br />

in the competition behind only Sohail<br />

Tanvir and Dwayne Bravo.<br />

Sussex batsman Toby Radford<br />

has been hired by the<br />

WICB as the batting coach<br />

for the UAE tour. Radford<br />

will join the West Indies<br />

squad, which has already<br />

reached the UAE, where<br />

they will play three T20Is,<br />

three ODIs, and three Test<br />

matches against Pakistan<br />

from <strong>September</strong> 23.<br />

“He has been contracted<br />

just for this series,” WICB<br />

CEO Michael Muirhead<br />

said. “He knows the youngsters<br />

well and had done well<br />

especially with them”. Asked<br />

whether Radford could retain<br />

is coming in, has the ability<br />

“We are just looking<br />

to start the series well. It<br />

is important that we start<br />

well,” said Holder, after an<br />

intense net session at the<br />

ICC academy on Friday.<br />

“We are coming off a<br />

very good win against India<br />

in the T20 series. We<br />

are coming in with a bit of<br />

confidence and hopefully,<br />

we can carry it in the heat<br />

here in Dubai”.<br />

One major factor the<br />

<strong>Caribbean</strong> side would have<br />

to contend with is the climate<br />

in Dubai.<br />

The 24 year old Barbadian,<br />

who celebrates his next<br />

birthday in November, says<br />

his teammates would need<br />

to become familiar with local<br />

conditions quickly.<br />

“I just think it’s a situation<br />

where we understand<br />

these conditions as best as<br />

we can and as quickly as<br />

we can and get acclimatized<br />

to the conditions here.<br />

The heat is not something<br />

we are accustomed to,”<br />

said Holder.<br />

“We come from the <strong>Caribbean</strong><br />

which is quite hot<br />

…at times it can get hot,<br />

but the humidity in the <strong>Caribbean</strong><br />

is not in the same<br />

comparison as it is here.<br />

It is just important to acclimatize<br />

ourselves to the<br />

conditions here as quickly<br />

as possible, and play the<br />

cricket we are accustomed<br />

to”.<br />
