The importance of land and waters<br />

Connection to land and waters is very important<br />

to Indigenous Australians and is at the core of<br />

Indigenous culture. This connection is the basis of<br />

relationships, identities, and cultural practices. The<br />

recognition of Indigenous rights in land and waters by<br />

the Australian legal, political and economic systems<br />

is a key foundation to the process of reconciliation.<br />

The legal processes of recognising Indigenous<br />

Australians’ connection to land and waters have<br />

been underway for over 40 years. The passing<br />

of the Aboriginal Land Rights (Northern Territory)<br />

Act 1976 (Cth), the High Court’s decision in Mabo<br />

v Queensland, and subsequent enactment of the<br />

Native Title Act 1993 (the Native Title Act) are historic<br />

moments for Australia. The Mabo case established<br />

that Aboriginal and Torres Strait Islander rights in<br />

land existed then and may continue to exist.<br />

The Native Title Act establishes a framework for the<br />

protection and recognition of native title. Native title<br />

claimants must prove they have an uninterrupted<br />

connection to the area being claimed, and they have<br />

continued to practice their traditional laws and customs.<br />

Historic Kenbi land handback, NT<br />

Prime Minister Malcolm Turnbull attends the ceremony<br />

at the handback of land to the Larrakia people following<br />

the successful Kenbi Land Claim in June 2016. The Prime<br />

Minister handed the title deeds for around 52,000 hectares<br />

of land on the Cox Peninsula near Darwin to the Larrakia<br />

people. This was the result of a 37 year land claim.<br />

The Prime Minister congratulated the Traditional Owners on their<br />

persistence, their resilience and their determination over 37 years.<br />
