THE ACCRA High Court, General
Jurisdiction 6, presided over
by Justice Kweku Ackaah Boafo
has adjourned a suit against the
Interior Minister, Mr Ambrose
Dery and the Director of Immigration,
Mr Kwame Takyi to tomorrow, Tuesday
July 25.
In court on Friday, the Attorney Generals
(AG) Department represented by Jacklin Appiah
said the State needed time to file its statement
of defense and that they could not do so
due to some challenges.
The court, after listening to the parties, ordered
the AG to file its statement of defense
today and report to court tomorrow.
The suit was filed by Lawyer Garry Nimako
Marfo for an Indian national who was arrested
and deported in June, 2017 for fraud and other
offenses. He has subsequently sued the Interior
Minister, and the Director of Immigration,
Mr Kwame Takyi.
The deportee, Ashok Kumar Sivaram insists
his deportation was illegal, unfair and an
abuse of office by the officers in charge of the
deportation and demands a return.
The victim consequently filed a suit
through his lawyer, Gary Nimako to request
the court to annul the deportation order and
for the two respondents to facilitate his return
to Ghana.
Background
Ashok Sivaram was involved in a legal battle
with a business partner, Sachin Nambeear,
who was a director with 50% share in Jai Mai
Communications Limited.
Nambeear, filed a suit on January 24, 2017,
at the High Court, Commercial Division 7,
against Sivaram and accused him of breaking
his fiduciary duties to the company and demanded
damages for same.
On May 5, 2017, the High Court, Commercial
Division, appointed Messrs Ernst and
