such as the Internet as a result of Department of Defense<br />

funding to allow direct computer-to-computer communic<strong>at</strong>ion,<br />

or the 153 new FDA-approved drugs <strong>and</strong> vaccines discovered<br />

through N<strong>at</strong>ional Institutes of Health-funded research carried<br />

out over the past 40 years 1 .<br />

While the vast majority of the basic research conducted in<br />

our public research universities is communic<strong>at</strong>ed to the world<br />

through the science liter<strong>at</strong>ure, a small fraction of the research<br />

is seen to have direct commercial applic<strong>at</strong>ion. Since the passage<br />

of the Bayh-Dole legisl<strong>at</strong>ion in 1980, universities have become<br />

much more active in seeking to commercialize their inventions<br />

since this legisl<strong>at</strong>ion permits a university, small business, or<br />

nonprofit institution to take title to inventions made with the<br />

federal funding th<strong>at</strong> supports basic research. The authors of the<br />

bill believed th<strong>at</strong> the certainty of ownership of federally-funded<br />

inventions by universities would increase the commercializ<strong>at</strong>ion<br />

of inventions made with federal funding <strong>and</strong> would result in the<br />

development of new products <strong>and</strong> services for the general public.<br />

Prior to 1980, the government retained ownership of all<br />

inventions resulting from federally-funded research. Indeed,<br />

prior to the enactment of this Act, the U.S. government had<br />

accumul<strong>at</strong>ed 30,000 p<strong>at</strong>ents, <strong>and</strong> only approxim<strong>at</strong>ely 5% of<br />

those p<strong>at</strong>ents were commercially licensed. Today, th<strong>at</strong> situ<strong>at</strong>ion<br />

is transformed, with the University of California alone managing<br />

over 2,000 utility <strong>and</strong> plant licenses, <strong>and</strong> 3,800 currently<br />

active U.S. p<strong>at</strong>ents in FY10.<br />

Universities <strong>and</strong> the commercializ<strong>at</strong>ion of their inventions<br />

the current Obama administr<strong>at</strong>ion has identified key policies<br />

to improve America’s economic growth <strong>and</strong> competitiveness.<br />

Among these are the strengthening <strong>and</strong> broadening of American<br />

leadership in fundamental research 2 <strong>and</strong> the development<br />

of new <strong>and</strong> innov<strong>at</strong>ive approaches to enhance the commercializ<strong>at</strong>ion<br />

of university research 3 . This administr<strong>at</strong>ion sees th<strong>at</strong><br />

our public research universities th<strong>at</strong> conduct over 65% of all<br />

funded research in the U.S. today 4 are critical for America’s<br />

competitiveness <strong>and</strong> economic growth.<br />

Yet, <strong>at</strong> the very same time th<strong>at</strong> research universities are<br />

taking on this broader n<strong>at</strong>ional economic role, they are being<br />

accused of commercializ<strong>at</strong>ion <strong>and</strong> greed, <strong>and</strong> as Dr. Zvi Yaniv<br />

argues in a recent edition of Citrograph, “In the last ten years,<br />

universities have initi<strong>at</strong>ed aggressive p<strong>at</strong>ent licensing programs<br />

<strong>and</strong> are encouraging lead scientists to become entrepreneurial.<br />

All these activities do not have anything to do with the main<br />

purpose of universities – to teach <strong>and</strong> educ<strong>at</strong>e – but have to<br />

do with for-profit ventures” 5 .<br />

Such st<strong>at</strong>ements slight the hundreds of universities th<strong>at</strong><br />

have technology transfer offices <strong>and</strong> the thous<strong>and</strong>s of faculty<br />

engaged in the commercializ<strong>at</strong>ion of intellectual property<br />

n<strong>at</strong>ionwide. Indeed, the article makes numerous claims th<strong>at</strong><br />

are not based on facts but r<strong>at</strong><strong>her</strong> reflect the biased <strong>and</strong> unsubstanti<strong>at</strong>ed<br />

opinions of the author.<br />

The st<strong>at</strong>ements th<strong>at</strong> “the majority of the universities are<br />

very little else than business”, th<strong>at</strong> “professors have license to<br />

do as they choose thanks to the security of the tenure position”,<br />

<strong>and</strong> th<strong>at</strong> “commercializ<strong>at</strong>ion may destroy the found<strong>at</strong>ion of<br />

scientific progress” 4 , are not substanti<strong>at</strong>ed by any d<strong>at</strong>a or facts<br />

<strong>and</strong> represent a disrespect of the good name of the University<br />
