David A. Shimkin focuses his litigation practice on<br />
representing clients in the hospitality, construction,<br />
and transportation fields, including trucking<br />
companies involved in interstate and intrastate<br />
claims. He is experienced in the defense of cases<br />
involving alleged food contamination, and has<br />
extensive experience in class actions and handling<br />
toxic exposure and contamination cases involving<br />
both property damage and bodily injury claims. David<br />
has also handled fire damage cases. He has also<br />
defended errors and omissions and professional<br />
liability claims brought against officers of closely<br />
held and public companies, accountants, and other<br />
professionals. He has also defended intellectual<br />
property and trade secret claims. David was an<br />
adjunct professor at New York Law School and sits<br />
on the board of a major nonprofit organization.<br />
Julia extensively collaborates and partners<br />
with companies to solve complex employment<br />
issues. She has represented employers across<br />
wide-ranging industries in class, collective,<br />
representative and hybrid actions brought under<br />
the Fair Labor Standards Act and state wage and<br />
hour laws. Her wage and hour experience includes<br />
litigation involving claims of misclassification, offthe-clock<br />
work and unpaid overtime, and meal and<br />
rest period violations. She has successfully limited<br />
class size and defeated class certification.<br />
Julia also provides advice to clients concerning<br />
compliance and assists clients in litigation<br />
avoidance by conducting audits and assisting<br />
in the implementation of new practices focused<br />
on compliance with state and federal wage and<br />
hour requirements. Julia has a significant amount<br />
of experience in defending claims of wrongful<br />
discharge and employment discrimination. Her<br />
extensive experience has resulted in obtaining<br />
defense verdicts at jury trials and arbitration<br />
hearings and favorable summary judgment rulings.<br />
