existence. The law should embody in its enactment<br />
not only the technical skill and more<br />
profound insight of the trained legislator but<br />
it should embody as nearly as may be the practical<br />
information of the railroad owner and the<br />
laborer, of the banker and the farmer, the merchant<br />
and the lawyer, and the countless thousands<br />
upon whose integrity and industry rests<br />
the whole vast fabric of modern business and<br />
out of whose experience must come also our<br />
humane and beneficent policies.<br />
But after the law is written the man who construes<br />
it, and <strong>by</strong> its terms measures out to each<br />
citizen his duty or his obligation, should consider<br />
nothing but the terms of the law as written.<br />
He has nothing to do with its leniency or<br />
its harshness, its wisdom or its unwisdom. He<br />
is not to consider the effect of its enforcement<br />
unless it be when there is doubt as to its terms.<br />
He can not consider his own interest, he can<br />
not seek the advice of friends, and he can serve<br />
the people in no other way than <strong>by</strong> faithfully<br />
construing the law which the people, through<br />
the law-making department, have written.<br />
Though the public welfare, the public interest,<br />
and public sentiment seem to be on one side<br />
and only the legal rights of an humble, obscure<br />
citizen upon the other, his duty is still the same.
