The rules of cohabiting<br />

Unfortunately cohabiting couples may not be aware<br />

that they don’t have the same rights as married<br />

couples. If you are cohabiting you may believe you<br />

are protected by “common law”, but there is actually<br />

no such thing as “common law marriage”. This affects<br />

all cohabiting couples, even those who have been<br />

together for many years.<br />

As a cohabiting couple you are not even legally<br />

recognised as a couple if your relationship breaks<br />

down. This will affect your rights if you intend to bring<br />

a legal claim after separating. A further complication is<br />

posed for those who will have the care of the children<br />

following a separation.<br />

If you are already cohabiting or are planning to<br />

cohabit consider appointing a Solicitor to draw up a<br />

Cohabitation Agreement. A Cohabitation Agreement<br />

can set out your plans and intentions at the outset<br />

relating to financial outgoings, plans for any property<br />

and how your children will be provided for in the<br />

event of a separation.<br />
