PHOTO: SUPPLIED Indigenous biodiversity policy likely to bite By JAMIE MCFADDEN, chairman of the Rural Advocacy Network Just before Christmas,the Government releasedfor consultationanew policy that will have major cost implications for councils, ratepayers and landowners. The proposed National Policy Statement for Indigenous Biodiversity (NPSIB) introduces new requirements to be implemented by councils. For many landowners,particularly hill and high country farmers,this new policy will have afar greaterimpactthan the recent freshwater legislation. Consistent withthe Government’s approach to freshwater and climate change, the moreyou have done to be good environmental stewards, the more you will be penalised underthis new law. One of the more controversial partsof the NPSIB is therequirementfor all councils to undertake districtwide ecological significance surveys. Anyone who owns land can expect to be surveyed. Currently, thisisvoluntary for councils and many have notgone down this path because of the hugecost, the conflict it creates within their communities and the lack of benefittobiodiversity outcomes. New national significance criteriaunder the NPSIB are much broader, meaning most indigenous vegetation willbe captured as Significant Natural Areas (SNAs). Areas of exotic vegetation such as pine,willows, gorseand pasture are likely to be deemedSNA if it is habitat to an important nativespecies. Underthe NPSIB,most landowners will have SNAs on their land and manyface having most of their land designated SNA. Stricterrules will apply to areasmapped as SNAs,taonga or highly mobile species habitat.Propertyvalues willbeaffected for those withahigh proportionoftheir land mappedSNA, without compensation. For largedistricts by area, such as Hurunui, Waimakariri and Kaikoura, the obligations will be particularly onerous. During the recent 2016Hurunui District Plan review,extensive unchallenged evidence showed the mapping and regulating of SNAs on private landwas counterproductive, hadturnedbiodiversity into aliability and did not assist or achieve protection. Evidence showed that many SNAswould continue to deteriorate or be lost if active management was not carriedout. As aresult,the hearingcommissioners removed all SNA mapping from the District Plan and, with no appeals, the new plan (with no SNAs) became law. Underthe proposed NPSIB, all councils are required to survey their whole district for not only SNAs but alsotaonga(Maori treasures) and highly mobile species. If landowners refuse access, councils are required to desktop map and if need be force access using the Resource Management Act (RMA)powers of entry. Because of the lack of confidentiality and the misuse of private property information, many landowners have refused access for surveys. If the NPSIBas written is forced on to councils, it will bring major disruptiontocommunities. The RMA and NPSIBfail to recognise: That landownerattitudes towards the natural environment have changed; That the nativeforest clearance incentivised under previous government policies no longer occurs; Thereasonanimpressive 2.8 million hectaresofnative vegetation remains on sheep and beef farmsisbecause of sympatheticlandowners; That maintaining thatindigenous vegetation has, and continues to be, a considerable costtolandowners; and Forany biodiversitypoliciestobe effective, landownersupportiscritical. Biodiversity protection on private land reliesonthe goodwill of landownersand must be seenasanasset, not aliability. Landownersmustfeel confident that their positive environmental effortswill not resultinmore bureaucraticinterference. It must be removed from the regulatory punitive framework of the NPSIB and RMA. Our solution is to point to the success of the QEIITrustcovenantingsystem and the formerCatchment Boardapproach.A partnership basedontrust andgoodwill; tailormade plans and rulesagreed to by both parties;afocus on actions needed ratherthan bureaucratic surveys;funding towards and assistancewith management of areas; confidentiality of private property information and certainty for both parties.The RMA andproposed NPSIB provide none of these. Over the nextyear, the Rural Advocacy Network will be callingfor major changes to our fragmented and ineffective environmental laws.Wewant anational advisory systemwith avision of developing and nurturing the environmental ethosof stewardship or kaitiakitangaacross all landowners, ruraland urban, under one holistic integrated planning framework. Meantime, we are launching a nationwidecampaign to telllandowners about the NPSIB. We are calling for much stronger supportfrom our industrygroups in challenging the draconian,top down approach this government continues to take withenvironmentalpolicies. Submissions close on March 14 and we encourage landowners and those with an interest in biodiversitytosubmit.
