Message
Phil Davis
JLL
Like you, BOMA Houston is closely following the COVID-19
pandemic and want you to know that you can count on us
during periods of uncertainty. We are committed to providing
fresh research and resources on a regular basis to help you
navigate this evolving situation.
With the rapid spread of COVID-19 across the globe,
local/state government, medical professionals, scientists,
local communities and businesses are joining forces to contain
the pandemic. We are facing a global situation that is rapidly
changing, and we realize health and safety, as well as uncertainty
around economic and business impacts are top of mind.
In response to the growing COVID-19 pandemic, the U.S.
Congress passed the Coronavirus Aid, Relief and Economic
Security (CARES) Act on March 27, 2020. This historic bill, the
third legislative response to COVID-19, provides more than $2
trillion for economic relief to businesses and individuals, as well
as much-needed resources to state and local governments.
While the bill has sweeping measures for many industries,
BOMA will continue to be
your industry’s voice and
advocate for ensuring critical
infrastructure and essential personnel have access to
buildings should there be a quarantine edict.
the BOMA Houston staff has focused their efforts on those
measures that may affect your businesses, your employees
and your tenants.
BOMA Houston will continue to provide assistance such
as: COVID-19 resources and tools to use, tenant and building
communication templates, free webinars and membership calls
with continued government advocacy. You can find everything
at houstonboma.org/coronavirus but the most recent resources
are shown below for reference:
• Membership Call Recording on State and Local Policy with
Robert Miller, Texas BOMA’s Lead Lobbyist
• Texas Governor Greg Abbott Issues New Executive Orders
• American Red Cross Seeking Blood Drive Sites
• Rent Collections and Evictions Information
• The CARES Act and What It Means for CRE
As the COVID-19 situation evolves, we want
you to know that we’re adjusting our operations
in accordance with guidance from the CDC
and local jurisdictions. Each staff member is
continuing to ensure we can deliver critical
information to our Members. BOMA will continue
to be your industry’s voice and advocate
for ensuring critical infrastructure and essential
personnel have access to buildings should there
be a quarantine edict.
To that end, as we work to contain and
mitigate the COVID-19 outbreak, here are 10
key considerations for property managers and
landlords as provided by the Pillsbury law firm
that are beneficial:
1. Stay Informed
2. Assess Your Risk
3. Prepare to Implement Response Plans
4. Maintain Clear and Frequent
Communication with Tenants
5. Confer with Building Vendors
6. Keep Common Areas Clean
7. Identify and Implement Employee
Safety Measures
8. Adhere to Privacy Requirements
9. Cybersecurity Considerations
10. Review Insurance and Leases Language
Regarding Liability Management
We are committed to the health and safety of
our staff, our communities and our members. Our
staff is still working hard for you and are ready
and available should you have any questions. We
appreciate the trust you’ve placed in BOMA to
diligently monitor the situation and we will continue
to bring you updates as more information
becomes available.
STAY SAFE and HEALTHY for BRIGHTER
DAYS AHEAD!
and enter to win real prizes. Each week, members used clues to find hidden words
on our sponsors’ websites, which had to be unscrambled to form a famous movie
quote. Everyone who submitted the correct answers were eligible to win, and we
gave out $100 in prizes every week. Thank you to participants and partners, and
We Have Now Entered the
Twilight Zone
The immense changes we’ve been forced to adapt to at the speed of light have us looking forward to a
return to normalcy. With that return will come even more change that we’d do well to think about now. Here
are a few food-for-thought items to consider:
Feature
By Tammy K. Betancourt, CAE
Chief Executive Officer and Executive Vice President
• Employee return to the workplace, expectations, and communications
• Tenant return to the workplace, expectations, and communications
“It’s all very strange, isn’t it?” In reaching out to friends and family over the past few weeks: an understatement
to help us handle a pretty scary situation. The situation at hand is reminiscent of an episode of The
Twilight Zone. Those of you old enough will remember the classic opening line of every show (which was in
black and white), “There is a fifth dimension beyond that which is known to man. It is a dimension as vast as
space and as timeless as infinity. It is the middle ground between light and shadow, between science and
superstition, and it lies between the pit of man’s fears and the summit of his knowledge. This is the dimension
of imagination. It is an area which we call the Twilight Zone.” In other words, a new and unimaginable world.
I think it’s safe to say we have arrived.
Barely weeks ago, many of us working
in the Houston commercial real estate
industry were still kidding ourselves that
Now, our reality is determining the
overall impact of the crisis and how to
return to “normal.”
the situation was mostly ‘business as
usual.’ How wrong that turned out to be.
The spread and evolving impact of the
coronavirus was happening faster than we
could mentally process. No sooner had we
adopted one position and taken steps to
change; we had to shift again and accept
another new reality.
The timeline escalated like nothing any of us have ever seen, in any lifetime. It’s not ‘just a pandemic,’ and
it’s not ‘just an economic crisis’. In just one quarter, coronavirus has challenged the very foundation of modern
life — the way we all work and play — and it’s proving a challenge to accept and deal with in human terms.
In January, we were distant observers of the virus, as news of its emergence in China reached us. At the
start of March — just eight weeks ago, but my goodness, it seems like another lifetime already — most
calendars were still full of in-person meetings, lunches and events.
Now, our reality is determining the overall impact of the crisis and how to return to “normal.” With
best-guessing all we have right now, our focus has been on the day-to-day: the practical and technological
solutions to working remotely and continuing to keep our employees and buildings safe, operational
and functioning.
With all of life’s present distractions, focusing on the job is hard. We’re concerned about our members,
customers, and clients, but we’re also concerned about the elderly parents we can’t look after. We’re working
alone in unfamiliar environments. And for the parents of young children, being a working parent was hard
enough with childcare and an office to escape to. They’re now wondering how they can simultaneously be
good parents of children who need home-schooling, let alone morph overnight into untrained teachers.
• Tenant financial health and remedies
• New cleaning standards (deep cleaning, public space cleaning)
• New government mandates and requirements
• Financial implications of the new environment
As we fight our way out of the Twilight Zone, we as Houstonians, will adapt to the new normal and come
up with great new ideas, new ways of working, and new ways of supporting our customers and we’ll come
back stronger than ever.
Hang in there and see you on the other side. n
Our Comprehensive List of Resources to Help You
Navigate a Pandemic
Feature
Houston BOMA has been publishing information at an astounding rate. Just a few months ago, we had one handbook
on a hypothetical pandemic. Now, we have an entire Coronavirus Resource Center with nine individual pages of
information. And more developments, documents, webinars, and more arrive daily! It’s hard to keep up. That’s why
we’ve identified your biggest questions here, with the answers and where you can learn more in our resource center
located at houstonboma.org/coronavirus. Stay well!
Guidance & Tools for Property Managers
How do I communicate with tenants about the pandemic and its impact on building operations?
The CDC’s Crisis Emergency Risk Communications (CERC) resource offers helpful guidance for appropriate and effective
messaging, including a checklist of messaging components, like expressing empathy and establishing credibility, that industry
professionals can refer to before pressing “send.”
BOMA International’s Tenant FAQs: How to Answer Tough Tenant Questions document contains industry best practices,
as well as sample language that might be helpful to use when communicating with building occupants. Building teams can
modify this language to reflect their particular property, the conditions in their area and other factors.
In addition, we have a ton of promotional materials for your building on our Promotional & Tenant Materials for
Coronavirus page here.
How do I establish a channel of communication to stay informed about any transmissions of COVID-19?
The Tenant-Staff Advisory of Infection Letter Template is based on examples harvested from BOMA members. It can be
used for any tenant-staff communication regarding infections, but may change based on suspected, proximal or confirmed
cases. It is strongly recommended that official crisis communications should be shared with legal counsel.
State and Local Policy
What’s the latest on re-opening businesses?
In a press conference on April 27, Governor Greg Abbott announced that Phase 1 of re-opening businesses would begin
Friday, May 1. During this phase, restaurants, retail stores, malls, and movie theaters will be allowed to re-open and operate
at 25% capacity with social distancing procedures in place. In addition, outdoor sports that implement social distancing (such
as golf) may resume; museums and libraries can re-open (excluding interactive exhibits); and churches can expand capacity.
For now, bars, gyms, and salons will remain closed. Phase 2 is scheduled to begin Monday, May 18. Houston BOMA will be
monitoring the status of recovery in Texas and will post updates on our website here.
Residents are encouraged to continue social distancing and wear a face covering when in public when possible.
Do I qualify for a Payroll Protection Program (PPP) loan?
Houston BOMA has obtained a legal opinion regarding the eligibility for the loans for owners utilizing third party
management companies. The opinion states, “As a general matter, yes, a building owner can use employees from a
management company for purposes of applying for a PPP loan,” but notes that “some property owners cannot make
[the necessary] certifications in a PPP application or otherwise meet the PPP standards, especially where the property
owners do not have their own employees.” Read the full legal opinion here.
Working Remotely
How do I manage a remote property management team?
Check out our webinars, which include topics such as managing and leading remote employees, effective leadership in a
crisis, and the decision-making process when facing long-term uncertainty.
What can I expect upon re-entry? What can I do to protect my workplace?
The U.S. Chamber of Commerce Foundation has developed a resource page that includes a Guidance for Employers
document addressing things like how to prevent the spread of COVID-19 at work, and a Resilience in a Box toolkit that
covers basic best practices for business resilience.
Some businesses may recommend screening employees up re-entry. A template for screening employees can be
found here.
What can I do to help?
#GivingTuesdayNow is a new global day of giving and unity that will take place on May 5, 2020 – in addition to the
regularly scheduled Dec 1, 2020 #GivingTuesday – as an emergency response to the unprecedented need caused by
COVID-19. Houston BOMA is participating by identifying the need in our community and partnering with these organizations
to give them support for #GivingTuesdayNow.
• The Houston Fire Department is seeking donations to the Fire Fighters Foundation of Houston, who are working to
provide protection kits for all 4,000 firefighters in Houston. Any donations will go towards securing much-needed
continues to rise and clients are experiencing a challenging job market similar to 2008. Your contribution gives those
who have given so much the opportunity to find their next career. Donate at https://donorbox.org/nextop_2020mm.
• The Houston Police Department is seeking donations for mounted patrol through the Houston Police Foundation.
Preparing for Resuming Operations in a New Normal:
Things to Consider for Building Re-Entry
When it comes to COVID-19 and tenant re-entry, any mitigation actions you can take now will be money and time well spent,
according to experts participating in BOMA’s recent COVID-19 webinars. There are several things you can do right now to facilitate
tenant re-entry and the return to business. View BOMA International’s guide here for more information.
Know your documents.
If you haven’t done so already, review existing leases, contracts and insurance policies for risks, protections and notice requirements.
Consult with your legal team on potential issues, including force majeure, rent abatement, and other lease-related
concerns, so you can be prepared should they arise.
If you’re not sure where to
start planning, build a
reverse timeline.
Anticipate shortages in supply.
Ordinary things like toilet paper, soap and sanitizer have become hot
commodities. You may be well-stocked now, but what happens if supply
chain disruptions are long-term? Get in touch with your vendors, suppliers
and contractors to ask how they plan to be available to you during recovery.
When planning on restocking supply, anticipate bottlenecks and possible
shortages or delays.
Serving your
community for
all restoration
and disaster
planning needs.
Create an employee re-entry plan.
As the spread of the virus slows and state governments begin allowing employees to go back to work, each company’s leadership
will need to determine how to proceed with re-entry. To ensure a smooth transition back to the office, communicate with
your employees about what they can expect. Will there be new workspace configurations, social distancing practices, employee
screening, or scheduling changes? Then, help minimize disruption for your employees by consulting your IT provider about what
you need to do to get everyone reconnected to your network. Finally, consider your office’s shared resources and common areas.
Did anyone empty the refrigerator?
Outline and communicate a tenant re-occupancy plan.
Keep in mind it’s much easier for tenants to leave your office building than to return. Communication with your tenants is key.
You’ll want to ensure their individual systems are being properly maintained, and they will need to know what kind of environment
and procedures to expect in your building. Are your common areas limited or closed? Do you plan to allow fewer people to
utilize an elevator at one time, and how will you deal with lines to use the elevator? All of the equipment that left your building
now has to come back in. Do you have a plan to accommodate all the people and equipment coming back into the building?
Consider what you need to do to get your building physically ready before tenants arrive. Have you ensured the water supply
is safe for tenant use? You may want to flush building water systems before re-opening. Disinfection of premise plumbing may
be needed, and water testing (for potability) may also be necessary to either validate efficacy of remedial processes or determine
if remediation is needed to restore building water system conditions. You may also think about implementing new operational
changes, like maximizing outdoor air supply of HVAC system where possible and extending operational periods up to 24/7, with
building purges at night.
If you’re not sure where to start planning, build a reverse timeline. Start with your re-entry date, and work backwards to
determine what must be done when.
These are just a few of things you’ll need to think about when planning for re-entry. Ask, “What must go right?” and “What
could go wrong?” to help guide your decision-making process and mitigate risk. With the right precautions, we’ll soon be able
to return to our buildings and find a new normal. n
Event Recap: Foundation
Fundraiser Casino Night
We had a blast at our 4th Annual Casino Night
benefiting the Houston BOMA Foundation! We
had a packed house of over 100 attendees who
enjoyed charcuterie snacks, beer and wine,
networking, and of course, gambling. With the
help of our attendees, we raised $28,000 for the
Foundation, selling every one of our fabulous
20+ silent auction items and all of the wines
in our wine pull. Thank you to everyone who
attended, sponsored, donated wine and prizes,
and made a purchase! All proceeds went directly
to our Foundation to provide professional
development opportunities and important
research for our industry. n
