Limiting of capacity<br />

10A.—(1) An owner or occupier of any shopping centre in which<br />

there are permitted premises must take all reasonable steps to ensure<br />

that the number of customers and other individuals within the<br />

shopping centre at any one time does not exceed the prescribed<br />

threshold for the shopping centre.<br />

(2) In this regulation —<br />

“gross floor area” has the same meaning as “floor area” in<br />

rule 2(1) of the Planning (Development Charges) Rules<br />

(Cap. 232, R 5);<br />

“prescribed threshold”, in relation to any shopping centre,<br />

means one person per 16 square metres of the shopping<br />

centre, computed by dividing the gross floor area (expressed<br />

in square metres) of the shopping centre by 16.<br />

Obligations when permitted premises are open<br />

10B.—(1) A permitted enterprise occupying permitted premises<br />

must take the following measures when those premises are open to<br />

entry by customers or visitors of the permitted enterprise:<br />

(a) as far as is reasonably practicable, allow natural ventilation<br />

of the permitted premises during working hours;<br />

(b) establish and apply appropriate procedures and controls<br />

(jointly with another or otherwise) that ensure, as far as is<br />

reasonably practicable, that every customer or visitor is<br />

assessed, before entering the permitted premises, to<br />

determine whether he or she is a symptomatic case;<br />
