Notice of Oil and Gas Lease Forfeiture Pursuant to<br />

Section 5301.332 of the Ohio Revised Code<br />

Notice is hereby given to Dalton & Hanna Co., which is believed to be a trade or registered<br />

name for Lloyd Dalton, whose collective last known address is 3477 Commerce Parkway,<br />

Suite B2, Wooster, OH 44691, and their successors and assigns of the following:<br />

M/I Homes of Central Ohio, LLC, an Ohio limited liability company (“Lessor”), is the<br />

current lessor under an Oil and Gas Lease by and between Ellen S. Crago and Farrel L.<br />

Crago, wife and husband, as lessors, and Dalton & Hanna Co., as lessee (“Lessee”), dated<br />

June 23, 1992, and recorded in Lease Record Volume X, Page 33 of the Union County,<br />

Ohio Recorder’s Office (the “Lease”). The Lease covers the following premises:<br />

107.3 acres, more or less, located in Virginia Military Survey No. 3743, Jerome<br />

Township, Union County, Ohio and Darby Township, <strong>Madison</strong> County, Ohio,<br />

formerly or presently bounded by Bethel Road Investment Co., Inc. on the North;<br />

Doris W. Cary and Jonas M. Frey on the East; State Route 161 on the South; and<br />

Bethel Road Investment Co., Inc. and Roger Scheiderer on the West.<br />

The Lease has a term of 5 years and continues so long thereafter as oil or gas is produced<br />

from the leasehold premises and royalty or rentals are paid, as provided in the Lease. The<br />

Lease is not recorded in <strong>Madison</strong> County, Ohio.<br />

Lessor is the current owner of the leasehold premises, being <strong>Madison</strong> County, Ohio Parcel<br />

No. 07-00361.000.<br />

Lessor is the current owner of that portion of former Parcel No. 15-0021025.000 (n/k/a<br />

Parcel No. 18-0021025.0000 by virtue of annexation) containing 72.60 acres, more or<br />

less, located in Jerome Township (now Plain City by virtue of annexation), Union County,<br />

Ohio, as described in a Limited Warranty Deed and Fiduciary Deed dated effective as of<br />

September 19, 2022 and recorded in Instrument Number 202209270009100 of the Union<br />

County, Ohio Recorder’s Office. The foregoing property comprises all or a portion of the<br />

leasehold premises.<br />

Pursuant to Section 5301.332 of the Ohio Revised Code, the Lease has been forfeited as<br />

there are no producing or drilling oil or gas wells on the leasehold premises and (i)<br />

covenants of the Lease regarding the drilling of a well and payment of delay rentals have<br />

been breached; (ii) covenants of the Lease regarding production have been breached; and/or<br />

(iii) the term of the Lease has expired. Lessor intends to file for record an affidavit of<br />

forfeiture with the Union County, Ohio Recorder’s Office if Lessee does not release the<br />

Lease of record within thirty (30) days of the publication of this notice.<br />

and that the aforementioned Defendants be required to set up any interest they may have in said premises or<br />

be forever barred, that upon failure of said Defendants to pay or to cause to be paid said judgment within three<br />

days from its rendition that an Order of Sale be issued to the Sheriff of <strong>Madison</strong> County, Ohio, to appraise, advertise<br />
