(3) By fourteen votes to one,
Finds that it can adjudicate
upon the
merits of the claims of the
Co-operative
Republic of Guyana, in so far as
they fall
within the scope of paragraph
138,
subparagraph 1, of the
Judgement of 18
December 2020.
In votes (2) and (3) above, the
single vote against was that of
the Judge ad hoc appointed by
Venezuela.
In welcoming the Court’s
decision, the President of
Guyana, H.E. Dr. Mohamed
Irfaan Ali, underlined: “that this
means the Court will now
proceed to decide the dispute
between the two States on the
merits, and ultimately issue a
final and binding determination
on the validity of the 1899
Arbitral Award that fixed the
land boundary between
Venezuela and the then British
Guiana.”
President Ali emphasised that
this was the second time the
International Court of Justice
had rejected jurisdictional
objections raised by Venezuela.
He added that Guyana
remained confident that its
longstanding international
boundary would be confirmed
by the Court.
President Ali further
underscored that “all Member
states of the United Nations,
including Guyana and
Venezuela, are obligated
under the United Nations
Charter to comply with the
Court’s binding Judgements.”
