ating within <strong>the</strong> periods set by <strong>the</strong> Auditing Association, in compliance with<br />

<strong>the</strong> requirements <strong>of</strong> Section 5 (12). Notwithstanding any fur<strong>the</strong>r consequences<br />

resulting from Section 12 in particular, a bank which fails to present <strong>the</strong><br />

information needed for <strong>the</strong> credit rating or presents information that is<br />

inadequate because <strong>of</strong> its limited meaningfulness shall be assigned to category<br />

C under <strong>the</strong> “Risk Assessment Rules” after expiry <strong>of</strong> a reasonable period <strong>of</strong> time<br />

allowed for subsequent delivery <strong>of</strong> <strong>the</strong> information needed.<br />

3. The information needed to calculate <strong>the</strong> own funds factor and <strong>the</strong> loss<br />

buffer ratio must be obtained on <strong>the</strong> cut-<strong>of</strong>f dates 31 March and 30 June, 30<br />

September and 31 December <strong>of</strong> each year and transmitted to <strong>the</strong> Auditing<br />

Association by no later than <strong>the</strong> 15th calendar day after <strong>the</strong> end <strong>of</strong> <strong>the</strong> following<br />

month, in compliance with <strong>the</strong> requirements <strong>of</strong> Section 5 (12). Notwithstanding<br />

any fur<strong>the</strong>r consequences resulting from Section 12 in particular, <strong>the</strong> legal<br />

consequences <strong>of</strong> failure to deliver <strong>the</strong> required information or <strong>of</strong> delivery <strong>of</strong><br />

inadequate information shall be determined by Section 5a (12).<br />

Section 4b – <strong>Deposit</strong> rating<br />

1. The banks shall undergo a deposit rating annually, to be performed by<br />

<strong>the</strong> Auditing Association or one <strong>of</strong> its subsidiaries in accordance with <strong>the</strong><br />

provisions contained in <strong>the</strong> “<strong>Deposit</strong> Rating Rules”, which form part <strong>of</strong> <strong>the</strong><br />

present <strong>By</strong>-<strong>laws</strong>. In deviation from sentence 1, <strong>the</strong> deposit rating may also<br />

be performed at shorter intervals where <strong>the</strong>re is reason to believe that <strong>the</strong><br />

situation <strong>of</strong> <strong>the</strong> bank or <strong>the</strong> deposits has undergone not only non-material<br />

changes since <strong>the</strong> last deposit rating or without cause where <strong>the</strong> bank was<br />

placed in <strong>the</strong> rating category DR 3 or lower in accordance with <strong>the</strong> previous<br />

deposit rating procedure.<br />
