9. The imposition <strong>of</strong> a disciplinary measure (or fulfilment <strong>of</strong> same) does not erase<br />
<strong>the</strong> underlying breach <strong>of</strong> duty. Fur<strong>the</strong>r disciplinary measures may be imposed<br />
in <strong>the</strong> event <strong>of</strong> sustained or renewed breaches <strong>of</strong> duty.<br />
10. The right <strong>of</strong> <strong>the</strong> Banking Association to exclude <strong>the</strong> bank pursuant to Section 9<br />
<strong>of</strong> <strong>the</strong> Banking Association’s <strong>By</strong>-<strong>laws</strong> remains unaffected by Section 12 <strong>of</strong> <strong>the</strong>se<br />
<strong>By</strong>-<strong>laws</strong>.<br />
Section 13 – Dissolution <strong>of</strong> <strong>the</strong> <strong>Fund</strong><br />
The dissolution <strong>of</strong> <strong>the</strong> <strong>Fund</strong> and <strong>the</strong> use <strong>of</strong> <strong>the</strong> <strong>Fund</strong> assets shall be matters for<br />
decision by <strong>the</strong> Members’ Assembly (Mitgliederversammlung) in accordance with<br />
Section 11 <strong>of</strong> <strong>the</strong> <strong>By</strong>-<strong>laws</strong>.<br />
