Legal provisions for foreign architects<br />

Legal provisions concerning the practice of architecture by foreign national in Belgium can be divided into<br />

two categories :<br />

Citizens of a Member State of the European Union.<br />

European Council Directive 85/384/EEC of 10 June, 1985, on the mutual recognition of diplomas,<br />

certificates and other evidence of formal qualifications in architecture, including measures to facilitate the<br />

effective exercise of the right of establishment and freedom to provide services - and the list of<br />

qualification it includes - regulates the exercise of the profession of architect by citizens of Member States<br />

of the European Union who possess diplomas recognized by the Directive.<br />

The modalities for the implementation of this Directive are defined by each Member State. It has been<br />

incorporated into Belgian law by the Royal Decrees of July 6, 1990, amending the law of February 20,<br />

1939, on the protection of the title of “architect” and the exercise of the profession; and by the Royal<br />

Decree of September 12, 1990, amending the law of June 26, 1963 on the establishment of an Order of<br />

Architects.<br />

Recognition of the title of architect is granted automatically to any persons who hold a diploma recognized<br />

by these regulations, in keeping with the above-mentioned Directive.<br />

Citizens from countries outside the European Union.<br />

A – The person concerned holds a diploma other than the Belgian qualification for the legal practice of<br />

architect in Belgium.<br />

For authorization to work in Belgium, that person will need to be the object of two successive decrees:


A decree by the Gouvernemnt de la Communauté française (the government of the French-speaking<br />

Wallonie-Bruxelles area) – where the two Belgian sites of <strong>Europan</strong> 5 are concerned – recognizing the<br />

equivalence of the holder’s qualification to that of the legal Belgian architecture diploma; and a Royal<br />

Decree authorizing the practice of the profession of architect in Belgium. Once these two decrees have<br />

been obtained, the person concerned may apply for membership of the Belgian Order of Architects.<br />

B. The interested party holds a legal Belgian diploma for the practice of architecture in Belgium.<br />

To work as an architect, such a person will only be required to obtain the Royal Decree authorizing the<br />

practice of the profession of architect in Belgium.<br />

Legal provisions for foreign architects<br />

The permission and therefore the possibilities to exercise in Czech Republic are defined under the<br />

provisions of the Building Law, by the Act on Engagement of Chartered Architects, law n°360 / 1992, and<br />

on authorization of the Czech National Order of Architects. The Czech National Order of Architects<br />

delivers an authorization according to the rules aforementioned in the following fields : civil engineering,<br />

urban planning, design and landscaping, or an unspecified authorization — i.e. a general authorization in<br />

any field of activity.<br />

If a foreign architect wishes to exercize his profession and to implement buildings in the Czech Republic,<br />

in the fields defined par the regulations, there are two possibilities : 1- To work in association with a czech<br />

architect entitled with a building authorization. In this case, there are two simples possibilities of<br />

association, as an employee of the czech architect, or by creating a joint desk by means of an association<br />

or by creating in common a legal person. The copyrights are detained by both architects. The czech<br />

authorized architect marks this common protection with his official authorization.<br />

2- In a few cases, an exception can be made to these regulations and, under certain circumstances, a<br />

foreign architect can receive the permission to exercise his profession directly from the Order of Czech<br />

Architects.<br />

In this case, the foreign architect must obtain a recognition of his foreign diploma and reference of his<br />

professional activity. Therefore, all the documents must be translated in czech. The cost of this translation<br />

are payable by the applicant.<br />

If the applicant is not able to obtain a recognition of his diploma, he may ask for an exceptionnal<br />

authorization according to paragraph 8, section IV of the law n° 360/1992. The Order of Czech Architects<br />

may recognize a similar qualification and exempt the applicant of the diploma certificate, only if he passes<br />

the examination of professionnal qualification. This examination includes a test of knowledge and of<br />

personal practice, as far as the works submitted allow to do so, and an examination of knowledge of the<br />

czech regulations in the professionnal field of activity under consideration.<br />

An architectural diploma gives the necessary qualification to practice design in the field of architecture. In<br />

order to construct, a permit is required. In order to obtain such a permit the architect must register himself<br />

in a commercial register or be associated with an architect or a firm that possesses this licence. In the<br />

latter case, the author's rights are preserved.<br />

Legal provisions for foreign architects<br />

For practising in Spain, it is compulsory to register with the College of architects corresponding to the<br />

place of commission, subject of the competition.<br />

To register with the College, a spanish diploma of architecture is required, otherwise a foreign validated<br />

or a spanish government recognized diploma.<br />

Foreign diploma approval must be delivered by the ministry of Education and Culture (Ministerio de<br />

Educacion y Cultura). Subdireccion de Titulos, Paseo del Prado, 28. Madrid).<br />

For nationals of the European Union in possession of a diploma in accordance with EU Directive<br />

85/384/EEC, it must be recognized with a certificate issued by the ministry of Education and Culture<br />

(same address).<br />

For architects belonging to countries integrating the European economic space, the recognition of the<br />

diplomas and other formalities compulsory to their professional activity in Spain must submit to the EU<br />

directive 85/384/EEC.<br />

Architects possessing a diploma not recognized or not approved by spanish authorities may set up<br />

temporary cooperations with colleagues graduated and established in Spain, in accordance with<br />

authorized conditions.<br />

Practicing the profession of architect in France<br />

1) Legal provisions for the practice of the profession in general (law 77-2 of January 3, 1977 on<br />

architecture. Articles 10 & 11).<br />

French and European Union citizens with a certificate named in the European Commission list of titles,<br />

compiled in keeping with the Sectorial Directive 85/384/EEC of June 10, 1985 on the mutual recognition<br />

of diplomas, can be registered, at their request, on the tableau regional d’architectes (local register of<br />

architects).<br />

Non-European Union nationals who hold a recognized diploma may be authorized by the government<br />

minister in charge of culture, on the recommendation of the minister of foreign affairs, to practice the<br />

profession of architect (convention of reciprocity or international agreement, decree n° 78-67 of January<br />

16, 1978)<br />

Holders of a French architecture diploma or other qualification recognized by the European Directive can<br />

register with a local register of architects.<br />

Architectural diplomas from countries outside the European Union may be recognized by the minister in<br />

charge of culture on the recommendation of a National Commission.<br />

2) Conditions for occasional service provision for a specific project (directive 85/384/EEC).<br />

An architect from a country of the European Union who holds an architecture diploma, certificate or other<br />

qualification can — without registering — carry out a given project in France after making a declaration to<br />

the Council of the Order of Architects of the area in which the project is to be implemented.


An architect who is neither a citizen of the European Union nor locally registered, may be authorized to<br />

implement a specific project in France either by a decree issued by the minister in charge of culture on<br />

the recommendation of the National Council of the Order of Architects, or after winning a competition.<br />

Legal provisions for foreign architects<br />

• A foreign architect or engineer can perform works of design and expert surveillance in the Republic of<br />

Croatia if during the competition he earned a right of executing competitive work under condition of<br />

gaining permission from the Chamber of Architects.<br />

• When the design and construction of a building were assigned to a foreign person on the basis of<br />

competition, a foreign architect or engineer can perform these works under condition of gaining the<br />

permission from the Chamber of Architects.<br />

• A permission for preforming works quated above can be given to a foreign architect or engineer if he is a<br />

member of foreign Chamber of Architects of engineers under persumption of reciprocity and if he fulfills<br />

other conditions required by special regulations.<br />

• A foreign architect or engineer can temporarily perform the works of design and/or expert surveillance in<br />

the Republc of Croatia on the basis of written contract with authorised Croatian architect or engineer who


individualy performs these works or with legal person registered for performing these works if he gains<br />

permission from Croatian Chamber of Architects and Engineers<br />

• A foreign architect or engineer invited by The Government of Republic of Croatia to prepare a project of<br />

special cultural importance, must inform about it the Chamber of Architects for evidence.<br />

• Permission for performance of works is an administrative act that cannot be appealed to, but it is liable<br />

to administrative dispute. In this case the procedure is carried on before Administrative Court of Republic<br />

of Croatia.<br />

Legal provisions for foreign architects<br />

The EEC 85/384 directive governing the mutual recognition of architectural qualification was not<br />

implemented in Italy until 1992, by legal Decree n° 129 of 27 January.<br />

This decree sets out the procedures that must be followed by architects from other countries wishing to<br />

practice in Italy.<br />

The procedure for recognition follows the text of the directive to the letter, and is probably too<br />

complicated, in that requests for recognition of qualifications are referred to the ministry responsible for<br />

universities which, after consulting with the ministries of foreign affairs and of justice, must in turn obtain<br />

the advice of the national university council and the national council of architects, before finally adopting a<br />

recognition decree for every diploma.<br />

Once the interministerial decree has been issued, the Order registers the architect, in its usual register if<br />

the architect in question is resident in Italy, or in a special register if temporarily practising in Italy.<br />

Architects who, at the time of the 1985 directive, had already qualified and/or were exercising their<br />

profession before the 1987/1988 academic year, have no requirement to fulfil, as their diplomas are<br />

already recognised on an interim basis by the directive itself. They simply have to apply directly to the<br />

Order. The Order and the CAN (art.10) are responsible for providing architects from other countries with<br />

information on the legislation and the deontology of the profession, and for any language training foreign<br />

architects may need in order to practice in Italy.<br />

Although anyone is free to set up practice as an architect in the Netherlands, the title of architect has<br />

been professionally protected since 1988. This means that anyone wishing to use the title in the<br />

Netherlands must be registered with the Stichting Bureau Architectenregister (Architects' registration<br />

Legal provisions for foreign architects<br />

In Austria architects are entitled to draw up plans and design projects if they are graduates of universities<br />

where these disciplines are taught. As well they must have passed a state exam and have proof of three<br />

years experience working in an architect´s office or in an appropriate professional field. Under these<br />

conditions the federal ministry of economic affairs awards the title "architect", which is indispensable to<br />

being registered with the chamber of architects and civil engineers. The title "architect" is, however only<br />

given to EU-citizens.<br />

In Austria European Union regulations are valid. According to these rules professionals who are qualified<br />

in their own country can practice their profession in Austria. Basically two possibilities are at hand: either<br />

the architect lives in a EU-country outside Austria and offers a cross-border service, or the architect is


free to settle in Austria in order to exert his/her profession. In both cases the architect is authorized to<br />

draw up plans in accordance with Austrian regulations. The division of skills and the extent of<br />

responsibilities is a matter of choice and can be appropriate to each individual case and as a function of<br />

the project. Several exemplary projects have already been implemented without any major problems.<br />

<strong>Europan</strong> 5<br />

1-Dietger Wissounig: Graz. New proposal for a site close to the competition site for the „OEWG“,a nonprofit<br />

housing organisation. Implementation was proceeding well until 2003 and will be relaunched in 2005<br />

getting strong support from part of the province of Styria.<br />

<strong>Europan</strong> 6<br />

1-POPO AG:Vienna. The architects already have finished a study commissioned by the developer in<br />

November 2001. The city wants to support a favourite implementation-climate, though a discussion about<br />

mixed use and the integration of the neighbouring sites in the project have delayed development. The<br />

legal development conditions (new zoning) are now being passed which takes the project to the phase of<br />

physical implementation.<br />

<strong>Europan</strong> 7<br />

1 – yañeziborracapdevila architecture office/Vicente Iborra Pallarés, Ivan Capdevila Castellanos, Javier<br />

Lorenzo Yánez Molina: Vienna. The first phase of reworking the competition project (accompanied by<br />

several meetings and implementation workshops) will be finished in March 2005. After that, housing<br />

developers will apply for getting the commission. They have to submit a realization-proposal on the basis<br />

of the project’s quality criteria. The most suitable/intelligent proposal will get the commission which will<br />

integrate the architects in the realization.<br />

2 - OFFSEA (Office for Socially Engaged Architecture)/Andrea Benze, Anuschka Kutz: Graz. In<br />

cooperation with the university of applied sciences the winners implemented the concepts of the project<br />

as a design studio. Players from other disciplines (developers, province, industry, users …) have been<br />

involved in this strategic anchoring of the project on a local level. An exhibition and symposium in June<br />

2005 will be the next step to create a lobby for implementing the project which is now developed further<br />

on by the winners. The goal is to occupy a niche on the market of prefabricated housing dealing with<br />

wood as a construction material.<br />

3 –Florian Sammer/Karoline Streeruwitz (first prize) / SMAQ, Sabine Müller/Andreas Quednau (2nd<br />

prize): Krems. Both winning teams have been involved in a long term implementation concept which is<br />

launched by the city. On the urban level the teams participate in the huge development area of “Krems-<br />

Ost”, which is guided by a local spatial planning office. On the architectural level the first prize-team has<br />

been cooperating with a developer. They adapted the competition project in order to meet the regulations<br />

for housing subsidies.<br />

4 - architektur.bn | bradic.nizic: Innsbruck. The winners adapted the project in order to meet the density<br />

demands which were given in the competition brief. After an unsuccessful meeting with the city officials<br />

and the site owner in 2004 the winners and <strong>Europan</strong> will now offer an implementation workshop to the city<br />

and the site owner.<br />

5 - touzimsky herold architects: Salzburg. As the project’s program (senior citizen home) is based on a<br />

project concerning the general housing program. In 2004 the result was presented to the public. Right<br />

now (February 2005), the ongoing negotiations between site owner, developer and city-officials have to<br />

Legal provisions for foreign architects<br />

In Switzerland, competitions are open to any architects located in Swiss or in any country belonging to the<br />

ones that signs the OMC agreements on public markets and if architects meet the following requirements:<br />

- to have a diploma or a diploma equivalence with the Zürich and Lausanne federal polytechnical schools,<br />

or with the Institute of Architecture of the Geneva University (IAUG or EAUG), or with High Specialized<br />

Studies (HES or ETS).<br />

- to be registered with the architects professional register REG A or B (Swiss Foundation of engineers,<br />

architects or technicians Registers.<br />

In Europe, the swiss conditions are available ; therefore, European conditions precise more in details the<br />

Legal provisions for foreign architects<br />

In Sweden the title "architect" is not protected, nor is the profession. Anyone can apply for a building<br />

permit. The client is responsible for the building and has to choose a "responsible supervisor", who must<br />

be accepted by the local authorities. There are no legal restrictions to foreign architects exercising their<br />

profession in Sweden nor having their projects implemented. It is however common that foreign architects<br />

in this situation collaborate with a Swedish architect, for practical reasons.<br />

In <strong>Europan</strong>, the team leader must be an architect. For the Swedish competition sites, this is defined as<br />

someone who has a university degree in architecture or is adopted as an architect in a professional<br />

architectural organisation affiliated to UIA or ACE. The team leader must be able to show documents to<br />

support this on request.<br />
