Insurance?
by Ellis Electrique
We have now been living and working in
France for nine years, and our file marked
‘insurance’ is bulging with policies for this
that and the other. I recently went for a game
of golf, and was duly asked for proof of
insurance in case I injured someone with
one of my classic wayward shots! It seems
we need insurance for everything.
As an Artisan, by law I am required to have
both Public Liability and Decennale
Insurance policies as a safe guard to myself
and my clients. In fact, even people carrying
out major works to their own properties, are
required to take a similar policy.
So, why is it then, that in the nine years we
have been working, I have only been asked
for a copy of our Public Liability and
Decennale insurances three times?
In many cases when I have asked clients
about their awareness of the required
insurance, they had no idea such a law
existed.
The Public Liability insurance is as you
would expect from the UK, it would cover the
Artisan if he were to accidentally damage
something whilst working at your property.
Whereas the Decennale insurance is similar
to that of the more familiar NHBC 10 year
guarantee. It will cover you for bad
workmanship for a period of up to 10 years,
and is there to cover minor works for one
year, and major works for 10 years.
Both types of insurance are not restricted to
new build homes, they are required for
renovation also.
When taking out such a policy, Artisans, like
us are sent several ‘Attestations’ which we
can pass on to the client. An Attestation is a
formal document stating the details of the
insurance policy. This means that even if the
Artisan stops trading for any reason, you will
still be able to make a claim should you need
to in the future.
However, if you do need to make a claim,
you will need a facture as proof that the
insured Artisan you are claiming against,
carried out the work in question.
In our experience, it seems that only
genuinely registered Artisans actually bother
with both insurances, and that whilst some
will advertise as ‘fully insured’, it is up to you
to ask to be provided with a copy of the
Attestations as proof of cover.
The important thing to remember, is that
both these policies are law in France, and
all Artisans, including carpenters, plumbers,
electricians and builders, are required to
have them.
