“DARKENU”- the Yeshiva Way!
16 September 2011 – 17 Elul
NEWSLETTER NO. 30/11
In the middle of “tochechos”, the terrible litany of curses in the parsha, the pasuk says “Because you did
not serve Hashem, your G-d, with gladness and with goodness of heart, out of an abundance of
everything.” In some sense we are being told that the harshest punishments are sometimes borne not out
of terrible aveiros, but out of failure to joyfully fulfill the mitzvos.
One of the essential challenges of chinuch in all ties and particularly in our own turbulent times is to learn
and to teach the joy of mitzvos, the simcha of Torah. If everyone has a mitzvah to be joyous in their
relationship to Hashem, a parent and teacher need to be elated because without that joy – the education is
stunted and thwarted.
We, as people, crave happiness; we thrive on it. Where do we go to find it? The Tzadik finds his simcha
in the knowledge that he serves the King of Kings. He is an important courtier and courier – an
ambassador from the Al-mighty. This fills him with cosmic meaning and simcha.
If we chas veshalom don’t manage to imbue our children with the ‘Geshmack’ of Torah and Mitzvos and
Middos, then we leave them to find consolation wherever it is available. Sadly, this can have lasting
ramifications.

Even in a difficult long passage of Gemara or Tosfos we need to look for ‘our portion’ – one idea or nuance
that speaks to us and makes us feel inspired. If the children see that we really get joy from ‘our portion’ of
Hashem’s Torah – they will continue to pursue their portion.
We only continue to do what we enjoy doing. Therefore the challenge is great for our own personal
progress as for our children. We need to create all educational opportunities in a ‘big’ and exciting and
joyous way.
Wishing you a good Shabbos
DEAN VECHESHBON
Parshat Ki Tavo, to a large degree, concludes Sefer Devarim, a book we refer to as “Mishneh Torah”, as it
essentially was the repetition of the Mitzvoth of the Torah to the next generation who were born and came of age
in the Midbar. Just as the other “Book of Mitzvoth”, Sefer Vayikra, concludes with the “Tochechah” (consequences
of observing the mitzvoth or failure to do so), so too do we find a “Tochechah” in this week’s Parshah. We studied
the observation Rav Hirsch makes that in both cases, the last mitzvoth we are taught are about “ma’asrot” tithes,
given away to those in need, and the beckoning question of why? Rav Hirsch points out how important our
orientation is towards ownership and sensitivity towards others: a “giver” demonstrates this sensitivity as well as
acknowledges that in the broader scheme everything ultimately belongs to Hashem!
Teshuvah, Tefillah and Tzedakkah are our 3 central forms of preparation for the Yamim Norai’m. In terms of
Teshuvah, we have been blowing the shofar daily to awaken ourselves spiritually. For Tefillah, during shiur kelali
this week we looked at the central themes of “Ledavid Hashem Ori” that we say all the way through until Shmini
Atzeret. As for the Tzedakkah of our Parshah, our Grade 9 Chessed Committee have raised R3000 to give to the
Paratrooper unit of Tzahal doing their basic training and the Grade 7’s are running an ice-cream and doughnut
sale this Wednesday to raise money for Arcadia. Shkoyach ladies! (Please support!) In our Halachah classes,
teachers will be devoting time towards revising the halachot of Rosh Hashanah, Yom Kippur and Sukkot until the
end of term.
Shalhevet has been more active than ever. We’re thrilled to have the Grade 6 students join us Friday mornings for
Parshah. Shalhevet has an awesome lineup of special programmes. Grade 10 is off to Pretoria for the YID-
Shalhevet ShabbaTOWN. We thank our Shalhevet head, Morah Tammy and the rest of the Levy family for
bolstering the YID ranks! Grade 9 has a Mishmar this Thursday night at the Chipkins. We thank the Chipkins for
hosting this. Grade 11 has a Shabbat lunch next week at the Feldmans. We thank the Feldmans for this as well.
Shkoyach to Morah Tammy for all these initiatives!
Morah Gerson’s Grade 7 programme has been incredible. This week we were privileged to have Dr. Joanne
Abrams address our students. Her talk was really amazing - thank you!
This Wednesday, our beautiful new Beit Midrash was fitted out with fixed audiovisual equipment. We thank
Darren and Rozanne (nee Turiel) Platsky, both former students of Yeshiva College who made Aliyah many years
ago, for their generosity that has enabled this!
7

After Camp Launch this week, Rugby Friday should blend us in with the South African frenzy of retaining the Web-
Ellis trophy – but there’s another magnificent trophy closer to home in numerous ways that we’re focusing on:
The Israel Quiz trophy! The most recent winner of the 2010 competition, Shira Amar, has presented us with the
challenge of retaining the cup in the Girls’ High. Gabriella Urdang made it to the finals last year – so you already
have the experience and the support of every one of us! You are our best chance – “behatzlachah” for next
Sunday!!!
On a sadder note, we had an emotional farewell for one of our students who is making Aliyah. Tali Kur will pave
the way for the rest of her family. We had a siyum with Divrei Torah in Tali’s honour, a farewell breakfast club for
the Grade 9 class and after Tefillah in the presence of the whole school, our Head Prefect Rivki Bank, present Tali
with a card and Artscroll Tehillim from the class and school, in a very emotional farewell… but Tali remember –
“lehitra’ot” dosen’t mean “goodbye” – it means “see you” in Israel soon, please G-d!
Wishing you all a wonderful Shabbat,
Ilan Raanan
HALACHA ARTICLE
The Snitching Supervisor
by Rabbi Dr. Asher Meir, Business Ethics Centre of Jerusalem
Discussing the shortcomings of your workers.
Q
As a supervisor in my workplace, I often have to discuss workers' performance with other managers. If I discuss
their shortcomings, am I guilty of slander?
A.
Jewish tradition places a particular emphasis on careful speech and avoiding harming others or hurting their
feelings through malicious or even careless speech. The prohibition of harmful speech has its source in the
following verse (Leviticus 19:16): "Don't go about as a talebearer among your people; don't stand idly be the blood
of your neighbour."
What is the connection between the two halves of the verse – "don't go about as a talebearer" and "don't stand idly
by the blood of your brother"? We find two complementary approaches in the commentators.
Maimonides writes that "This is a grave transgression and causes the deaths of many souls of Israel; therefore it is
adjacent to 'don't stand idly by the blood of your brother'". (1) According to this explanation, the two halves of the
verse reinforce each other; I avoid "the blood of my neighbour" precisely by refraining from spreading gossip,
which leads ultimately to enmity and bloodshed.
The Medieval commentary on the commandments, Sefer HaChinukh, takes a different approach. He writes that a
person shouldn't say damaging things about others – unless the intention is to prevent damage or quiet a dispute.
(2) The two halves contrast and balance – we shouldn't relate idle gossip, but we shouldn't refrain from speaking
when silence would be culpable negligence toward a potential victim.
This approach was given precise boundaries by one of the great rabbinical authorities of the late 19th and early
20th centuries, Rabbi Yisrael Meir Kagan of Radin, Poland. Rabbi Kagan was a renowned legal authority as well
as revered for his saintly conduct; he decided that he would compose a strictly reasoned legal work defining the
boundaries of this prohibition and providing binding rulings. He concluded that it is permissible to relate a
damaging statement when the following conditions are fulfilled:
1. The main condition is that the statement is intended to achieve some concrete benefit. Making damaging
statements is permissible only when it is needed and intended to protect someone.
2. In addition, disclosure must be necessary to attain the benefit. If the same benefit can be obtained without
disclosure, for example by a talk with the wrongdoer, then there is no justification for disclosing the
information.
3. You are certain of the truth of the information you relay. Stating hearsay is the essence of gossip. The
information must also be related accurately, without judgment or exaggeration.
16 September 2011 – 17 Elul
14

4. You must also be convinced of the negative implications. We have a general obligation to judge others
favorably, we shouldn't be in a rush to spread negative information to others if we ourselves aren't
convinced that it implies any potential harm to the listener.
5. There must be no undeserved damage to the subject. We will discuss this in detail in upcoming lessons,
but for example a person may have misbehaved at work and deserve a report but not dismissal; a person
may have acted improperly towards a neighbour and deserve a fine but not arrest. If reporting will cause
undeserved damage it is impermissible. (3)
These rules apply equally to a supervisor or a co-worker, but their application is quite different. If you notice some
minor deficiency in the performance of a co-worker, it will be generally be the exception that reporting it will lead to
some concrete benefit. Will management really listen to you? Do they have regard for your objectivity and
judgment? Is this really new information that supervisors are not aware of? So for the average observer, reporting
is the exception, reserve the rule.
But if you are a supervisor, it is the essence of your job to evaluate and report on workers' performance. It is most
likely that your reports are needed for some concrete benefit; otherwise you wouldn't be getting a salary to make
them. For the supervisor, reporting is the rule, reserve the exception.
When despite this should even supervisors keep quiet? If management wants you to report on matters that are not
really of relevance to job performance (for example, political opinions) or to report in an inequitable way (for
example, to actively seek "dirt" on a particular employee), it is appropriate for you to seek clarification of the policy
and the justification for it. If you are convinced the policy is unjustified and counterproductive you may have to
occasionally ignore it.
Worker oversight is certainly necessary and appropriate; the Talmud tells us that someone who has inherited a lot
of money and wants to lose it fast should hire workers and not supervise them. (4) However, this doesn't justify
transmitting unfairly damaging information about them. In most cases, the kind of information supervisors have to
pass on is necessary for a constructive purpose, but supervisors should keep alert for exceptional cases where
the information is improperly used, and request a clarification of inappropriate policies.
