A. Statutory Background<br />
1. Overview<br />
The Toxic Substances Control Act (TSCA) 143 was enacted in 1976 to prevent unreasonable risks of injury to<br />
health or the environment associated with the manufacture, processing, distribution in commerce, use, or<br />
disposal of chemical substances. 144 EPA administers and enforces TSCA and the LBP (and other)<br />
regulations there-under. Title I of TSCA governs chemical substances, and generally provides EPA’s<br />
administration and enforcement authorities. 145 TSCA Title II regulates asbestos in schools, 146 Title III<br />
governs indoor radon, 147 Title IV regulates lead-based paint, 148 and Title V pertains to healthy schools. 149<br />
The Residential <strong>Lead</strong>-<strong>Based</strong> <strong>Paint</strong> Hazard Reduction Act of 1992, 150 known as Title X, 151 created TSCA’s<br />
<strong>Lead</strong> Exposure Reduction subchapter (TSCA Title IV). 152 TSCA Title IV addresses LBP and LBP hazards<br />
in target housing (most pre-1978 housing 153 ), and other buildings and structures. 154<br />
