c. Right to life, liberty and security<br />

A review of the issues associated with the right to life and liberty begins with<br />

statements made by UN organs concerning the use of torture and inhuman treatment in<br />

Georgia. HRC, CAT, CERD and the Special Rapporteur on torture and inhuman treatment<br />

expressed their concern about the persistence of torture and inhuman treatment, but at the<br />

same time welcomed the positive legislative measures, calling on the national authorities to<br />

intensify their efforts to prevent the use of torture and combat with the persisting culture of<br />

impunity. CRC reported cases of torture and arbitrary detention of children. HRC and CAT<br />

also noted adverse conditions in prisons and the need of further work to improve the situation<br />

in detention facilities. HRC, CEDAW and CRC commented on violence against women,<br />

domestic violence and trafficking in human beings. CRC recommended that Georgia take<br />

steps to prevent violence against children and child labour, and to improve the situation of the<br />

“children of the street”.<br />

d. Justice system and right to trial<br />

Concerning the right to trial and the functioning of the justice system, the High<br />

Commissioner for Human Rights and the Human Rights Committee acknowledged the<br />

judicial reforms, but at the same time highlighted the persisting problems associated with the<br />

independence of the judiciary, judicial corruption, legal education and a low level of trust to<br />

the judiciary displayed by the society. CRC noted the growing number of minors summoned<br />

before criminal courts and called to establish an effective juvenile justice system.<br />

e. Right to family life, right to privacy<br />

CRC reported a growing number of children placed in institutions, often due to the<br />

poor financial condition of the family. The Committee suggested strengthening the adoption<br />

system.<br />

f. Freedom of conscience and religion, freedom of expression, freedom of<br />

association and assembly, right to participate in public and political life<br />

The Human Rights Committee noted the different status of various religious groups<br />

and the privileged position of the Georgian Orthodox Church, recommending that Georgia<br />

take measures to ensure religious pluralism and equality. The Committee also recommended<br />

that the State authorities strengthen the protection of the freedom of expression and media.<br />
