In last month’s OON we were strongly critical of Council’s ‘Wall of Silence’, as we termed it, in not answering our long-outstanding questions in relation to the draft Cessnock LEP 2009. We have now received the answers we sought, but more importantly, at the third community meeting convened by Council on 12 November at Wollombi, Council staff responded fully to all questions raised, and did so in a manner which allowed for good two-way communication. We left the meeting reassured of the merits of the public exhibition process. Priscilla and Paul Flemming Community news for Wollombi and surrounding districts Issue 317 - Our Own News - December 2009 LEP Meeting 12 November Cessnock – Kurri Greens Draft LEP Information Session Cunneen’s Bridge, Paynes Crossing and & Grange Update I realise that there is significant concern within the community of Wollombi that works have not yet commenced on both the replacement of the Cunneens Bridge and the upgrading of the road at Paynes Crossing. I would like to assure you that this project remains the highest priority project within the 2009/2010 capital works program for Council and my staff are spending considerable time ensuring that the relevant designs and studies are completed in accordance with statutory requirements to enable the works to proceed as soon as access to the associated private properties is obtain. I would like to confirm that Council in February 2009 and again in June 2009 confirmed that it believes that the downstream option remains the most appropriate location for this bridge and that both Federal Government's Auslink and Council's moneys are confirmed to fund these works when they commence. I have also reviewed the numerous studies that have been provided and have personally been in discussions with all three land owners affected by works at the bridge and confirm that these studies and discussions indicate that this option (ie the downstream option) remains the most appropriate location for the bridge. CUNNEENS BRIDGE Section 87 and Section 90 Permits from National Parks and Wildlife (NPWS) - Council has received the approved Section 87 permit and the Section 90 permit from the NPWS which has provided conditions to be complied with during the project. No other approval is required from this Department Section 139 - Excavation Permit Exception - Heritage Branch - department of Planning - Council has received the approved permit from the Heritage Branch. No other approval is required from this Department Roads Act 1993, Section 76 approval - Roads and Traffic Authority (RTA)- RTA has issued an approval regarding the construction of the bridge. There were no objections from the RTA to the proposed downstream bridge replacement option Registration of Acquisition Plans - NSW Government Land Property Information (LPI) - Land Titles are still processing the acquisition plans. It is my understanding that the officers of LPI have been seeking advise from the Lands Office regarding the current location of the road boundary and it is hopeful that they will make a determination on this matter shortly. My staff and our legal advises have been inconstant discussion with the officers at the LPI to ensure that they have all of the relevant information to allow the definition of the existing boundaries to be confirmed. It should be noted that the issue doesn't involve the proposed boundary however until the existing boundary is confirmed Council cannot determine the exact amount of private land that it will need to acquire from all land owners. Acquisition of Land Outside Road Reserves and Agreements to Enter for Construction - This process involves 3 property owners and arrangements are in place with two of them over the area required for acquisition and agreements to enter their properties to begin construction work are in place. Discussions on agreements to enter and acquisition are continuing with the remaining owner as we endeavour to come to an agreement to construct the road and bridge. Current negotiations are independent of the determination of the acquisition plan indicated in 4 (above) as Council's current offers to all land owners are not based on the exact location of the current road boundary. Energy Australia - Power Pole Relocation - Energy Australia have advised that they can commence pole replacement as soon as LPI register the Acquisition Plan. Telstra - Cable Replacement - Telstra have advised that they can commence pole removal and cable cut over to new mains laid last month as soon as LPI register the Acquisition Plan. Bridge Design - The final design for the bridge has been received and final documentation tender documents are expected within the next two weeks This now enables the final review of Environmental factors to be completed. Road Design - Road design plans have now been finalised. Final Environmental Review - Council has completed a review of Environmental Factors in accordance with the Cessnock Greens Councillors James Ryan and Chris Parker will present information on the Draft LEP including the E3 and RU2 Zones. To enable works to proceed a review under Part 5 of the EP&A Act is required now that all design works and studies on the downstream alignment has been completed. This review will be carried out by an independent consultant and these consultants are currently submitting proposals to Council to complete the review. This review when completed is the last approval process that is required prior to council calling tenders for the bridge works and to allow road works to commence. Tenders for Bridge Design. It is my intention that tenders for the bridge construction will be called before the end of the year to enable Council to consider the tender submissions at it first meeting in January 2010. The determination of stockpile site and boundary fencing details are being finalised and works will be issued as soon as these are completed to enable fencing work on those properties were agreement has been reached to commence.
