transmission of information to personsoutside the government service of aContracting State in connection with theexercise by those persons of functions relatedto the medicines or pharmaceutical legislationof that State.10. Information of the type described inArticle 2, paragraph 2, is, however, in anyevent excluded from the provisions of theConvention. Therefore, the omission of suchinformation does not imply that fullinformation has not been given in accordancewith this Convention. The expression“technical ‘knowhow’” is meant to compriseany technical process in the course ofproduction, which is not generally known.“Personal data relating to the duties of thepersons concerned” are data such as therelevant education, practical experience,functions and duties within the enterprise andwhether the personnel of the enterprise ismedically checked from time to time.11. It is the understanding of the ContractingStates that in exceptional circumstanceswhere the exchange of information has notsatisfied fully the importing country'srequirements, the competent authorities ofthat country and of the exporting countryshould seek practical means of overcomingthe importing country's doubts. Such practicalmeans may include informal discussionsabout the particular outstanding points ofdoubt between officials of the importingcountry and of the exporting country withsuitable participation of representatives of themanufacturer concerned at a place mutuallyagreed by them having regard to the nature ofthose points. The ensuing written report ofthe exporting country's inspector wouldconstitute the information required to beprovided under Article 2 of the Convention.Contractant. Les Etats Contractants conviennentque dans des circonstances exceptionnellesoù 1'échange d'informations n'a passatisfait entièrement les exigences du paysd'importation, les autorités compétentes dece pays et du pays d'exportation doiventchercher des moyens pratiques de dissiperles doutes du pays d'importation. Cesmoyens pratiques peuvent comprendre desdiscussions sans caractère formel sur lespoints particuliers en suspens entre lesreprésentants du pays d'importation etceux du pays d'exportation, avec laparticipation appropriée de représentantsdu fabricant en cause, en un lieu choisid'un commun accord en tenant compte dela nature desdits points. Le rapport écritprésenté ensuite par 1'inspecteur du paysd'exportation constituerait les informationsdemandées au titre de l'article 2 de laConvention.16
